Zoning Code Enforcement
Purpose
Planning Services enforces the City's Zoning Ordinance, Chapter 30 of the Municipal Code, to help protect public health, safety, comfort, convenience, and overall quality of life. Code enforcement also supports the orderly use and development of property throughout the community.
Common Zoning Violations
Common concerns addressed by Planning Services include:
- Unauthorized paving, gravel placement, or expansion of surfaced areas
- Uses not permitted in the zoning district, such as commercial activity in a residential area
- Prohibited outdoor storage
- Prohibited signs or signage
- Prohibited vehicles or equipment
Zoning Inspections
Complaint-Based Inspections
Planning Services investigates concerns reported by residents, property owners, and City staff. Complaints may be submitted by phone, email, or in person. Staff generally conduct an inspection within one week of receiving a complaint, subject to staff availability and workload.
Code Enforcement Process
The City's goal is voluntary compliance. Property owners are provided with notice and a reasonable opportunity to correct violations before additional enforcement action is taken.
Step 1: Initial Inspection and Notice
Staff inspect the property to determine whether a zoning violation exists.
If a violation is found, the property owner receives an Initial Notice identifying the concern and providing a deadline for correction. Compliance deadlines vary based on the type and complexity of the violation but are commonly from two weeks to one month.
Step 2: Re-Inspection and Follow-Up Notice
After the compliance deadline, staff re-inspect the property.
If the violation remains, the City may assess a fee and send a Follow-Up Notice requiring correction.
Step 3: Citation or Abatement
If a violation remains unresolved after multiple notices and inspections, Planning Services may issue a citation to the property owner. Citations are processed through Winnebago County Circuit Court.
Due Process and Compliance
The enforcement process includes required notice and due-process steps to give property owners an opportunity to correct violations. While this can extend the overall timeline, the City's primary objective is to work with responsible parties to achieve voluntary compliance whenever possible.
