Nr�,N�� WITHDRAWN ) ADOPT STATE CODE PERTAINiNG TO PUBLIC SWIMMING PLACES DEPARTMENT OF HEALTH AND W�LFARE A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING AND RECREATING SECTION 15-3•1 OP THE OSHKOSH MUNICtPAL CODE PERTAINtNG TO PUBLIC SWIMMING PLACES. The Common Council of the City of Os(�kosh do ordain as follows: SECTION 1. That Section 15-3•1 oF the Oshkosh Municipal Code pertaining to public swimming places is hereby repealed and recreated to read as follows: A. Chapters H 71 and H 72 of the Wisconsin Administrative Code, Rules of the Department of Health and Social Services, pertaining to the safety, main- tenance and operation of public swimming pools and swimming places, are hereby adopted and by reference made part of this Chapter with the same force and effect as though set out herein in fuit. Failure to comply �aith any of the provisions of said Lode shall constitute a violation of this section and shall be punish- able according to the penalties provided. It shall be the responsibility of the Director of Health and Welfare or his designee to estabiish and carry out require- ments of Chapters H 71 and H 72. B. Definitions. Al1 the definitions contained in Chapters H 71 and H 72 shall apply, and for the purpose of this ordinance, the following terms shali be construed to mean: 1. Owner: A municipality, or other governmental entity, corporation, company, association, partnership, firm or individual owning, controlling or operatirg any public swimming place. 2. Operator. An agent or manager appointed by the owner. The operator shall be designated in writing by the oe�ner to the Director of Health and Welfare. The Director shall be notified in �ariting of any change of operators. C. inspe�tion of Swimminq Pools. l. At least once every three months the Director of Health and Welfare or his designated agent shall inspect every operating swimming pool within the city. In addition, a water sample shall be submitted to the City Health Department laboratory for testing at least once per month when each pool is in operation. - -6- _ -..�r JUL� "L, 19�3 # 3 ORDINANCE - Swimming SECOND READING Pools - Cont'd. 2. In addition to subsection 1., the following activities shall be required: a. Annual sanitary surveys of each licensed facility shall be made to determine conformity with Chapter H 72. b. Reports of sanitary surveys shall be submitted to the department (appropriate district sanitarian) within 30 days of completion of such surveys_ • c. Current copies of local ordinances or local regulations applying to pu6lic poois shall be submitted to the Depart- ment of Health E Social Services. d. The current name and mailing address of the local official(s) responsible for conducting sanitary surveys shall be submitted to the Department of Healtfi b Social Services. e. A listing of all public pools covered by the local program, during April of each year shall be submitted to the department. D. Swimminq Pool License. 1. License Required. It shall be unlawful for any person, organ- ization or governmental agency to operate a swimming pool in the City of Oshkosh without a valid ticense, Licenses sfiall be displayed in a conspicuous lbcation in the pool area. 2. Application. Application for license shall be made to the Director of Health and Welfare and shall state the name and address of the person, firm, municipality, corporation, company or association applying for the license and such otfier information as the Director of Health and Welfare shall require. 3• Fee & Exemptions. a. A fee of $5p charged for each license. Each license issued shall expire on June 30 next following date of issuance and may b� renewed annually thereafter. b. Exemption from fee. Any governmental entity shall be exempt from payment of the required fee, but must stilT obtain the required license. E. Enforcement of Ordinance. l. Suspension of License. The Oirector of Health E Welfare or his designated agent shall suspend a license issued under this chapter and shall order the owner or operator of a swimming pool to prohibit use of the pool until correction of the conditions listed herein are met: — -7- _„■ J?JNP] 2, 1983 �3 ORDINANCE - Swimming ��� ��G Poo1s - Cont'd. a. Failure of the pool equipment, structure or enclosure which may jeopardize the health or safety of persons using or operating it. b. Lack of proper equipment for treating, maintaining or testing pool water. c. Presence of unsanitary conditions or hazardous substances in the pool. d. failure to meet water quality standards. 2. Procedure for Suspension of License. When the Director of Health and Welfare or his designated agent orders a license suspended and ihe closing of a swimming pool, fie sfiall issue a written order to be served on the owner or operator, either personally or by registered or certified mail. Said notice shall state that the license is to be suspended, the specific reason for suspension, tfie corrective actions necessary, and shall order tfie pool to be closed until the corrections are made. After corrective action is completed, the owner, operator or manager shall notify the Director of Hea1tF� b Welfare or his designated agent, in writing, that tlie pool is ready for inspection. tf upon reinspection the corrective action is approved, the license shall be reinstated a�d the pool may be re-opened. tf the corrective action is not comp}eted or approved, the license shall remain suspended and tfie pool shall remai� closed until such corrections are completed. SECTION 2.
