PURPOSE: APPROVE EXTRATERRLTOAIAL PRELIMINARY PLAT KNOWN
AS FIRST ADDITION TO OAK MANOR ESTATES

WHEREAS, [he developer/owner had previously submi[ied an Ex[ra[erritorial
Preliminary Pla[ known as First Addition to Oak Manor Esiates which was
approved <oniingen[ upon condi[ions being me[, and [he Final Pla[ was denied
for failure to compLy wi[h the conditlons of ihe Preliminary Pla[; and
WHEREAS, [he deveLoper/owner resubmit[ed the Preliminary Plat for con-
sidezaiion, and upon referral back hy the Cortunon Council, the Plan Commission
has further reviewed the Preliminary Pla[.
NOW, THEREFORE, BE IT RESOLVED by [he Cortunon Coundl of ihe City of

BE IT FURTHER RESOLVED that approval oE the Exiraterritorial Preliminary
Pla[ known as Firs[ Addi[ion to Oak Manor Esta[es is contingen[ upon [he
following:

1 ) That a storm drainage and grading plan Der section 30-69(H)
be submitted prior to final plat submittal , and be in such form
as to meet requirements of the Subdivision Ordinance, and that
the approval of same be secured prior to final plat submittal.
2) All other applicable requirements of Section 236 State Statutes
and the City of Oshkosh Subdivision Ordinance be met.
3) That all provisions of the City of Oshkosh Subdivision Provisions
Section 30-69, 30-70 and 30-71 be complied with, subject to
Wisconsin Supreme Court dispostion of the appeal of Rice and
Welhouse, d/b�/a �A19o_�m_a� �� Properties vs. Cit of Oshkosh, Winnebago
Count�t o� urt, Case No.�iB -CR-135� ppea No. 87-1521 ,
as it relates to the City' s statutory authority to condition
extraterritorial plat approval upon specific compliance with
Section 30-70(C) , Required Improvements, of the Oshkosh Municipal
Code.
4) That North Oak Manor Drive be changed to Wylde Oak Drive.
5) That a new street right-of-way location be indicated through
proposed Lot 62 running westerly from Wylde Oak Drive to the
plat's westerly boundary.
6) That a street right-of-way be indicated running easterly from
Wylde Oak Drive somewhere between Lots 106 and 109 of the proposed
plat for future street connection, and that said street location
be shown at the time of final plat submittal.
7) After the proposed street right-of-ways are indicated the lots
must be renumbered on the plat.
