Home My WebLink About34882 / 88-74 JUNE 2 , 1988 #74 RESOLUTION (CARRIED IpST LAID OVER WITHDRAWN ) PURPOSE: FINAL RESOLUTION VACATING PORTION OF WEST 23RD AVENUE INZTZATED HY: CITY ADMZNISTRATION PLAN COMMISSION RECOhII2ENDATION: Approved 7-0 WHEREAS, puL�6uant to SeCtion 66.296(2) of WisCOnsin Statutes, the Common Council has heretofore initiated proceedings on April 21, 1988 at a regular meeting of the Common Council to vacate and discontinue the following described portion of West 23rd Avenue: WEST 23RD AVENUE BETWEEN MONTANA STREET AND WISCONSIN CENTRAL RAILROAD TRACKS A part o£ West 23rd Avenue in the Southside Auto Plat, adjacent to Lot 133 , £rom the west right-of-way line o£ Montana Street to the easterly right-of-way line of the old Soo Line Railroad right-of-way, now known as the Wisconsin Central Railroad, 14th Ward, City of Oshkosh, Winnebago County, Wisconsin. WHEREAS, a public hearing on the passage o£ such resolution has been set by the Common Council, which hearing was set for 7 :00 PM in the Council Chambers of the City Hall, Oshkosh, Wisconsin, on the 2nd day of June, 1988, and written notice of such meeting was duly served on the owners o£ all of the frontage of the lots and lands abutting unon that portion thereoP sought to be discontinued as provided by law; and WHEREAS, a public hearing was duly held pursuant to said notice at the time and place therefore affixed and all persons so served and interested were then and there given an opportunity to be heard; and WHEREAS, a proper notice of the pendency of said petition for vacation and discontinuance and map covering the proposed vacation was duly filed in the of£ice of the Register o£ Deeds for winnebago County, as required by the Wisconsin Statutes; and WHEREAS, the lots and lands abutting on said street af£ected by this resolution are all in the 14th Ward, City of Oshkosh, the description o£ said street heretofore set out in this Resolution. - � - SUNE 2, 1988 #74 RESOLUTION (con['d) NoW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that it is hereby declared that since public interest requires it, the following described street in the 14th Ward, City of Oshkosh, Winnebago County, Wisconsin, is hereby vacated and discontinued, reserving unto the City of Oshkosh the right to maintain, service, repair, add or replace all sanitary sewer, storm sewer, water and gas mains and fittings in said vacated street: WEST 23RD AVENUE BETWEEN MONTANA STREET AND WISCONSIN CENTRAL RAILROAD TRACKS A part of West 23rd Avenue in the Southside Auto Plat, adjacent to Lot 133, from the west right-of-way line of Montana Streat to the easterly right-of-way line of the old Soo Line Railroad right-of-way, now known as the Wisconsin Central Railroad, 14th Ward, City of Oshkosh, Winnebago County, Wisconsin.
