HomeMy WebLinkAbout34883 / 88-75 A E V I S E D June 2 � 1988 $ ORDINANCE (CARRIED _______ LOST _______ LAID OVER WITHDflAWN -______) PUAPOSE: AOTHOAIZE NON-ALCOHOL EVENTS ON LICENSED PREMISES; SETTING PENALTIES THEAEFOR INITIATED BY : COUNCIL MEMBER PRESSLEY A GENERAL ORDINANCE OF THE CITY OF OSHKOSH CREATING SECTION 4-24.1 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO AUTHOAIZING UNDERAGED PERSONS TO ATTEND NON ALCOHOL EVENTS TO BE NELD ON LICENSED PAEMISES AND AMENDING SECTION 4-47(A) OF TNE OSHKOSH MUNICIPAL CODE PERTAINING TO PENALTIES. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1 . That Section 4-24.1 of the Oshkosh Municipal Code pertaining to authorizing non-alcohol events on licensed premises is created to read as follows : SECTION 4-24 . 1 NON-ALCOHOL EVENTS; UNDERAGED PEPSONS ON LICENSED PREMISES (A) An underaged person who is not accompanied by a parent � legal guardian or spouse who has attained the legal drinking age may enter and remain on a Class ^B" or "Class H" licensed premises if: ( 1) No alcohol Deverages ineluding ❑onalcoholic beer� wine coolers � antl other similar imitation type beverages, are consumetl , sold , furnished , given away on or carried into the licensetl premises during the hours specified in a prior written notification to the Chief of Police or designee; and (2) During the period of any non-alcohol eve�t, all alcohol beverages , ❑ot stored in a locked portlon of the licensetl premises, shall be stored i❑ a secure place out of the sight and physical reach of anY Patron present antl shall be under the direct and immediate control and supervision of the licensee or agent or the licensed operator in the employ of the lice�see or agent. All beer taps and automatic dispensers of alcohol beverages shall be disconnected , disassembled or made inoperaDle ; and (3) The licensee or agent has notified the Chief of Police or designee at least seven (7) calendar days in advance of any date on which underage persons will be present on the licensed premises. A separate notice shall be made for each tlate a non-alcohol eve�t will be held . The notice shall be on a form prescribed by the Chief of 1 Police antl shall include the tlate and time during which the event is to occur. All notices shall be filetl with the Chief or designee during normal City business hours (weekdays , except holidays , between 8:00 a.m. and 4: 30 p.m.) . After notice of the event has been given , the licensee shall ❑otify the Chief or desig�ee in writing if the event 1s to be cancelled ; and (4) During the period of any non-alcohol eve�t, a notice card issued by the Chief shall be posted at all public entrances to the licensed premises notifying the general publie that no alcohol beverages may be consumed , sold , furnished , or given away on , or carried into the licensed premises during the event; and (5) Closing hours established bY appropriate state statute for such licensed premises shall De observed . (B) This Section shall not apply to those portions of licensed premises which contain bowling alleys where the possession, sale and consumption of alcohol beverages is restrieted to the bowling alley area, where separate ingress/egress and restroom facilities are provided withi❑ the bowling alley area for the exclusive use of those patrons and where all aleohol beverages normally available for sale not located within the bowling alley area are u�der the direct and immetliate supervision of the licensee or agent or a licensetl operator in the employ of the license holder. SECTION 2.
