OYHK IH ON ME WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: May 9, 2013 RE: Approve Conditional Use Permit for Machine ShoplPlumbing Contractors Shop at 1027 Michigan Street (Plan Commission recommends approval) BACKGROUND The subject property is a 0.4- acre117,500 square foot parcel of land located at the northwest corner of Michigan Street and West 11 Avenue. The existing building was developed in 1939 as an industrial /light manufacturing class structure that had most recently been used as Weber Machine Shop. The machine shop use was discontinued and the site has remained vacant greater than 12 months, thereby removing its legal nonconforming status and requiring a Conditional Use Permit for new light industrial uses. ANALYSIS The petitioner is proposing to establish a machine shop and plumbing contractors shop on the currently improved lot which houses .a 5,000 square foot former machine shop and accessory warehouse building. The structure possesses a commercial entrance with an office and four servicelloading bays with 100 feet of frontage on Michigan Street and 175 feet of frontage on West 11 Avenue. No improvements are planned for the site other than new signage and general upkeep on the building and property. The business will only employ the petitioner and will experience infrequent customers with hours of operations between 7 am and 10 pm. The existing site layout contains a main access drive off Michigan Street with two parking stalls and an additional drive off of 11 Avenue with a shared parking area with the adjacent print shop. The petitioner is proposing to use the existing paved or gravel parking and access areas of the site with the condition that no vehicles will encroach upon public sidewalk or right -of -way and no outside storage of material will be allowed. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its May 7, 2013 meeting. Approved, City Manager ITEM: CONDITIONAL USE PERMIT APPROVAL TO ESTABLISH A MACHINE SHOP/PLUMBING CONTRACTOR SHOP AT 1027 MICHIGAN STREET Plan Commission meeting of May 7, 2013 GENERAL INFORMATION Applicant: John Meyer Owner: Jeffrey and Sandra Knutson Action(s) Requested: The applicant is requesting approval of a conditional use permit to establish a-machine shop and plumbing contractors shop within an existing structure in the Central Commercial District. Applicable Ordinance Provisions: Machine shops and contractor service uses are permitted only through the approval of a conditional use permit within the C -3 Central Commercial Zoning District. The Zoning Ordinance establishes criteria and guidelines for establishment and/or amendment of a Conditional Use Permit in Section 30 -11 (D). The property houses an approximately 5,000 square foot former machine shop and accessory warehouse building that has a formal commercial entrance on Michigan Street, office and four service /loading bays (two setback from the Michigan Street frontage and two on the West 11 Avenue facade). The parcel is rectangular with 100 feet of frontage on Michigan Street and 175 feet of frontage on West 11 Avenue. The petitioner has indicated that the property is desirable for his intended uses as it is currently designed/developed for that type of business. The petitioner does not plan to improve the site from its current state except new signage and general upkeep on the building and property. The petitioner has indicated that the business will employ only him and experience infrequent customers with hours of operation anytime between 7 am and 10 pm. The existing site layout contains a main access drive off Michigan Street north of the building leading to two of the service bays /garage doors as well as to two parallel parking stalls next to the building. There is an additional drive to the west of the building on West 11 Avenue accessing an existing gravel driveway and shared parking area with the print shop at 526 West I 1 th Avenue. The petitioner indicates that there is more than adequate space for his parking needs and deliveries and staff recommends that vehicle access, parking and loading be limited to existing paved and nonconforming gravel areas. Site and building elevation plans show that there are two service bays/garage doors on the southern building facade which is located at the West I V t ' Avenue right - of -way line tight against the sidewalk. Access to the building is provided from these service bays /garage doors from the right-of-way which concerns staff in that loading could cause blocking or encroachment on the public sidewalk or West 1 t Avenue right -of -way and staff therefore recommends a condition that no vehicles block or encroach upon the public sidewalk or West 11 th Avenue right -of -way. In general, it does not appear that the proposed use, with conditions, will change the essential character of the area from past use and will not be hazardous or disturbing to the area. RECOMMENDATION /CONDITIONS Staff recommends a finding that the proposed conditional use permit request is consistent with Sections 30 -11(D) of the Zoning Ordinance and be approved with the following conditions: 1) Parking and vehicle access is limited to paved or gravel areas of the site. 2) No vehicles will block or encroach upon the public sidewalk or West 11 Avenue right -of- way. 3) No storage of material or equipment outside of the building. The Plan Commission approved of the conditional use permit as requested with conditions noted. The following is the Plan Commission's discussion on this item. Mr. Buck presented the item and reviewed the site and surrounding area as well as the zoning classifications and land use in said area. He stated that the property is zoned C -3 Central Commercial District and discussed the former use of the site. He further stated that the property has been vacant for some time now so a new conditional use permit must be approved to allow the Item -1027 Michigan - Machine Shop /Contractor CUP proposed use. He discussed the current proposed use and reviewed the site plan, elevations, and the conditions recommended for this request. Mr. Thorns questioned if the petitioner was planning on utilizing the service bay /garage doors on l 1 1h Avenue which are covered in condition #2 that vehicles could not encroach upon the sidewalk or public right -of -way. Mr. Buck responded that the petitioner could utilize the doors to access the building however there would be no loading allowed in that area. Jack Meyer, 1928 McCurdy Street, petitioner for the request, stated that he would be cutting in a door on the opposite side of the building that would be used for loading purposes so the condition relating to the doors on 11 Avenue should not be an issue. Motion by Vajgrt to approve the conditional use permit to establish a machine shop /plumbing contractor shop at 1027 Michigan Street with the following conditions: 1) Parking and vehicle access is limited to paved or gravel areas of the site. 2) No vehicles will block or encroach upon the public sidewalk or West IP Avenue right -of- way. 3) No storage of material or equipment outside of the building. Weber Machine has since moved and has sold the building to Jeffrey and Sandra Knutson The building was used for metal fabrication on first shift and second shift. I would like to use the building for antique engine rebuilding and My plumbing business. Identification of All Structures on the Property There is only one building on the property. There is not any signage on the property. I will not be changing any of the building configurations and not changing any of the existing paving. Projected Number of Residents, Employees, and /or Daily Customers I plan on having no employees and very few clients. No residential units are planned at this time. Proposed Amount of Dwelling units, Floor Area, Landscape Area, and Parking Area No dwelling units at this time. Floor are is 6940 Sq. Ft. (5185 first floor, 1755 second floor) .1190312 acre footprint. Paved and concrete area 36045q. Ft...0827364 acre. Grass and gravel 8712 Sq. Ft. .1876033 acre. Total lot 175 X 100 = 17500 Sq. Ft. .4017447 acre. Parking information is not required on C -3. Effects on Adjoining Properties I have spoken with all of the neighbors to this property. To the direct west of this building is a print shop. They had no concerns at all. To the direct north of the property is a residential dwelling. They expressed no concerns as well. There is a thick tree line and bushes in between the properties. I asked him if he would like a fence. He said that he would prefer no fence so that he can still walk his dog. The other home seemed to be abandoned and un- occupied that was across the street. They had no problems with the hours of operation as the last time the building was used there was a first and second shift. The hours of operation will be 7am to 10 pm maximum. The noise would be a minimum, less than the last occupants. Glare, odor, fumes and vibration will be minimal to non - existent.. There will be no vibrations from any of my tools and equipment. The hours of operation will be 7am to 10 pm maximum. 5 Compatibility of the Proposed Use with Adjacent and other Properties in the Area This area is spotted with businesses and residential areas. We believe that we would fit into the community quite easily, much better than a vacant building. Traffic Generation The traffic to and from this building would be minimal. There would not be many deliveries. I pick up most of my materials at the supply house. It would not be open to the public. i or one of my wholesalers would also have deliveries and pick -ups occasionally and a waste management service. Use of areas of building: The West side of the building we would use as storage and garage space. The front entrance of the building would be used as a lounge for myself, family, and customers. The basement would be used for storage and the upstairs would not be used at this time. The room behind the office will be where the main shop will be located. l have already spoken with the neighbors and they seem to have no problems . I would like to install surveillance cameras as there seems to be a graffiti artist in the area. A sign John E Meyer co. would be installed on the front of the building.
