PURPOSE: APPROVAL OF CHANGES IN PERMIT PARKING AND SHORT-
TERM PARKING AREAS IN 8TH AVENUE PARKING LOT
INITIATED BY: PARKING UTILITY COMMISSION
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 27-48
AND 27A-11 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PERMIT
PARKING AREAS AND PARKING REGULATIONS ON DESIGNATED STREETS AND
ALLEYS.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 27-48 of the Oshkosh Municipal Code pertaining to
permit parking areas is hereby amended as follows:
SECTION 27-48 PERMIT PARKING AREAS

Remove Therefrom: (M) West 8 Avenue Lot: All stalls except the five
southernmost stalls in the westernmost row.

Add Thereto: (M) West 8 Avenue Lot: The easternmost row of stalls.
SECTION 2. That Section 27A-11 of the Oshkosh Municipal Code pertaining to
parking regulations on designated streets and alleys is hereby amended as follows:

Remove Therefrom: 90-minute parking in the most westerly row from the third
most northerly stall to the sixth most northerly stall, between
the hours of 9:00 a.m. and 6:00 p.m. daily, except on
Sundays and holidays.
Add Thereto: 2-hour parking except for the easternmost row of stalls,
between the hours of 9:00 a.m. and 6:00 p.m. daily, except
on Sundays and holidays.
SECTION 3. This ordinance shall be in full force and effect from and after its
passage, publication and placement of the appropriate signage.

SECTION 4. Publication Notice. Please take notice that the City of Oshkosh
enacted ordinance #13-121 (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH
AMENDING SECTIONS 27-48 AND 27A-11 OF THE OSHKOSH MUNICIPAL CODE
PERTAINING TO PERMIT PARKING AREAS AND PARKING REGULATIONS ON
DESIGNATED STREETS AND ALLEYS), on March 12, 2013. The ordinance converts
some permit parking spaces in the 8t" Avenue lot to short-term parking, and changes
the duration of free parking in the lot from 90 minutes to 2 hours.

RE: EXPLANATION OF CHANGES TO PERMIT PARKING AND SHORT-
TERM PARKING AREAS IN 8th AVENUE PARKING LOT

This is a business request.
Inner Sun Yoga is relocating from downtown to 716 Oregon Street this year. The business owner
is concerned that the 8th Avenue parking lot, which is the public parking lot closest to the studio,
has only a handful of free, short-term parking spaces with the remainder being permit parking.
She indicates that this will be inadequate for customers who are often at the studio for more than
90 minutes at a time. She requested that, given the lot's relatively low usage, most of the permit
parking spaces be converted to 4-hour parking. (Please find attached a schematic showing the
current space layout within the 8th Avenue lot.)
Table 1 summarizes utilization data for this lot in the last three studies conducted of this area. As
can be seen, the lot has seen limited usage regardless of the duration of parking.

Only one other lot managed by the Parking Utility currently has 4-hour parking: the 10th Avenue
lot. In general, 4-hour parking can create a situation where enforcement of the parking ordinance
becomes challenging if not impossible. Moreover, the 4-hour parking would be open to anyone,
which means that the spaces could be occupied on a first-come-first-serve basis by any employee,
resident or customer in the area. This would likely frustrate the desire of her customers and
contract employees to park in this lot. In addition, the 4-hour parking would create a precedent
that could lead to its adoption at lots with higher utilization levels, where it could prove even
more detrimental. Therefore, staff recommends denial of this request as originally presented.
Recognizing the lot is underutilized, staff instead recommends converting all but the eastern row
of stalls to free, short-term parking. Staff recommends keeping the current parking duration at 90
minutes, as free, all-day on-street parking is available immediately east of the 8th Avenue lot,
which should provide significant capacity for area customers who need more than 90 minutes to
transact their business. Staff estimates that on-street parking capacity on 8th Avenue between
Oregon Street and Nebraska Street includes 9 2-hour spaces and 23 spaces without any time
limit.
