PURPOSE: DISALLOWANCE OF CLAIM FOR EXCESSIVE ASSESSMENTS BY
WALGREENS / 950 SOUTH KOELLER ROAD AND 315 WEST
MURDOCK AVENUE
INITIATED BY: LEGAL DEPARTMENT
WHEREAS, pursuant to §74.37 Wis. Stats., Walgreen Co., the tenant of parcels
1308480200 – 905 South Koeller Street, and 1501840000 – 315 West Murdock Avenue,
filed claims for excessive assessments of each of these two parcels, respectively; and
WHEREAS, upon further review of the documentation filed with the Claim and within
the City’s files, the Assessor believes that the City’s original assessment which was
affirmed by the 2012 Board of Review after a public hearing is correct and recommends
that this claim be denied.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the following claims against the City of Oshkosh are disallowed:
Claimant: Walgreen Co.
Property: 905 South Koeller Street
PIN: 1308480200
Claimant: Walgreen Co.
Property: 315 West Murdock Avenue
PIN: 1501840000
Date Claims Received: 1/22/2013
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to notify each
claimant by certified mail of the disallowance. Notification shall include this statement:
The claimant may commence an action in Winnebago County Circuit Court
to recover the amount of the claim not allowed. This action shall be
commenced within 90 days after the claimant receives notice by registered
or certified mail that the claim is disallowed, pursuant to §74.37(3)(d).
