HomeMy WebLinkAbout06. 13-109 MARCH 12, 2013 13-109 RESOLUTION (CARRIED___7-0_____LOST________LAID OVER________WITHDRAWN________) PURPOSE: AMEND SPECIAL ASSESSMENT POLICY RELATIVE TO SANITARY SEWER LATERAL INSTALLATIONS INITIATED BY: PUBLIC WORKS DEPARTMENT BE IT RESOLVED by the Common Council of the City of Oshkosh that the following amendments to the Policy for Special Assessments are approved From Page 2, Section I Street Construction and Reconstruction, Section I.A.3: Delete: I.A.3. The City will assume the entire cost of improving all intersections, utility replacement (including storm sewer installation) associated with the improvement. Any utility laterals installed to vacant properties shall be assessed at full cost to the abutting property. Utility laterals found necessary to be replaced during street construction shall have 50% of the cost assessed to the abutting property. Replace with: I.A.3. The City will assume the entire cost of improving all intersections, and utility replacement (including storm sewer installation) associated with the improvement. From Page 6, Section III Sanitary Sewers, Section III.C., Sanitary Sewer Laterals: Delete: 1. For sanitary sewer installed in streets, which necessitate the installation of lateral connections to the right-of-way line, the cost of the lateral shall be determined and shall be assessed at 100% of the estimated cost. If the sanitary sewer is not located in the center of the right-of-way, the lateral costs for each side shall be equalized so each side pays the same amount as if the sewer main were at the centerline of the right-of-way. For sanitary sewer installed in streets, which necessitate the installation of lateral connections to the right-of-way line, the cost of the lateral shall be determined and shall be assessed at 100% of the estimated cost. 2. For active sanitary sewer laterals which need to be reconstructed or relined on a city funded paving or utility construction project, the cost of the lateral shall be determined and shall be assessed at 50% of the cost as explained in Item I.A.3. 3. When the installation of lateral connections or reconstruction of active sanitary sewer laterals is not part of a city funded paving construction project, the cost to remove and restore the pavement will be assessed to the benefitting property owner. 4. The special assessment charge for the cost of the lateral will be averaged so each property owner pays the same special assessment charge on a given project. As an exception, City funded sanitary sewer lateral relining projects will assess the actual lateral footage lined to the benefiting property. All special assessment charges shall include a factor of 12% of the construction cost, which shall be considered to reimburse the city of all engineering and administrative costs. BE IT FURTHER RESOLVED that these changes shall be effective for all projects beginning on or after the date of passage and publication of this resolution. Patek, Director of Public Works P DATE: March 7, 2013 RE: Amend Special Assessment Policy Relative to Sanitary Sewer Laterals BACKGROUND The current wording pertaining to sanitary sewer laterals in the "Policy for Special Assessment" relates to utility improvements on street construction projects. On street reconstruction projects, the property owners pay special assessments for the paving and they pay another assessment for repair of their sanitary sewer lateral. ANALYSIS The policy needs to be clarified as to the financial responsibility for pavement repair on projects that don't involve a special assessment for street construction. An example of this type of situation would be the sanitary sewer lateral lining project. The proposed clarification would keep the property owner responsible for 100% of the sanitary lateral cost for a new building, would maintain the property owner responsibility for sanitary lateral costs as 50% on City-funded projects, and would clarify that the property owner pays for pavement repair when lateral repair involves a street that is not being paved. FISCAL IMPACT These revisions would allocate pavement repair costs to the benefitting private properties for lateral repair projects that don't involve paving of the street. RECOMMENDATIONS I recommend approval of the proposed amendment to the Special Assessment Policy. Approved: Mark A.
