HomeMy WebLinkAboutRe_bid_Invitation_to_Bid_for_Electrical_Service_Equipment_ProcurementINVITATION TO BID CITY OF OSHKOSH CONTRACT NO. 24-03 (RE-BID) WASTEWATER TREATMENT PLANT TERTIARY TREATMENT ELECTRICAL SERVICE EQUIPMENT PROCUREMENT OSHKOSH, WISCONSIN GOODS AND SPECIAL SERVICES: The City of Oshkosh hereby gives notice that bids will be received for Electrical Service Equipment Procurement for the Wastewater Treatment Plant. The Goods of this Procurement Contract are generally described as medium voltage transformers and medium voltage switchgear. The City intends to enter into an Agreement with a Supplier or Suppliers of electrical equipment for the Goods and Special Services of this Procurement Contract. PROCUREMENT CONTRACT TO BE ASSIGNED: The City of Oshkosh as “Buyer” will execute the Procurement Contract with electrical equipment Supplier(s) as “Seller” for the procurement of Goods and Special Services in this Procurement Contract. The Goods in this Procurement Contract are to be furnished and delivered to the Wastewater Treatment Plant site for installation by the construction contractor. The construction contract will be awarded and executed at a later date. This Procurement Contract will be assigned by the Buyer to the construction contractor. The Seller for this Procurement Contract will accept the assignment and become a subcontractor to the construction contractor. BID DUE DATE: Bids for the Procurement of the City of Oshkosh Wastewater Treatment Plant Electrical Service Equipment will be received up to 11:00 a.m., Monday, May 12, 2025, through the online bidding service of Quest Construction Data Network, www.QuestCDN.com. Bids will be opened and publicly read in Room 310 of City Hall, 215 Church Avenue, Oshkosh, Wisconsin, and through a Zoom virtual meeting described in the Instructions to Bidders. Bids will be evaluated on the basis of submitted information as described in the Instructions to Bidders. REQUEST FOR BIDS: Complete digital project Bid Documents will be available at www.questcdn.com. You may download the digital plan documents for $15 (Fifteen Dollars) by inputting Quest Project No. #9672547 on the website’s Project Search page. It is the Bidder’s sole responsibility to ensure the Bid is received by QuestCDN.com prior to the deadline set forth in this invitation. No bids will be accepted after the deadline. Plans and Specifications may be reviewed at the office of the City Engineer, Room 301 of City Hall, beginning May 2, 2025. These documents are also available for inspection in the office of the City Clerk, Room 104, 215 Church Avenue, Oshkosh, Wisconsin. Each bid must be submitted on the prescribed Bid Form and accompanied by a Bid Bond, qualifications, and financial information as prescribed in the Instructions to Bidders and Supplements. LEGAL PROVISIONS: This Procurement Contract and its Contract letting shall be governed by the laws of the state of Wisconsin. BIDDER BID SECURITY: The Bid Security shall be payable to the Buyer in an amount of not less than five percent (5%) of the amount Bid as a guarantee that if the Bid is accepted, Bidder will execute and file proper Contract and Bond within ten (10) days after the award of the Contract. The Bid Bond can be presented in pdf format. If the successful Bidder executes the Contract and files the necessary bond within the allowed time, then the Bid Bond shall be released. If the successful Bidder fails to execute the Contract and file the Contract bond within the allowed time, then the Bid Bond shall be forfeited to the City as liquidated damages. PROCUREMENT CONTRACT SECURITY: The Bidder to whom a Procurement Contract is awarded shall furnish a Supply Contract Bond in an amount equal to the Procurement Contract Price. BUILD AMERICA BUY AMERICA ACT: This project is being funded by the Clean Water State Revolving Fund that is subject to the Build America, Buy America Act (BABA) requirements under Title IX of the Infrastructure Investment and Jobs Act (“IIJA”), Pub. L. 177-58, §§ 70901-52. Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in this project must be produced in the United States as further outlined by the Office of Management and Budget’s Memorandum entitled Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure, latest edition. The Bidder shall comply with the requirements of the Infrastructure Investment and Jobs Act. 1. Title VI of the Civil Rights Act of 1964 (P. L. 88-352), the Rehabilitation Act of 1973 (P. L. 931123, 87 Stat. 355, 29 U.S.C. Sec. 794), the Older Americans Amendments of 1975 (P.L. 94-135, Sec. 303, 89 Stat. 713, 728, 42 U.S.C. Sec. 6102), and subsequent regulations that ensure access to facilities or programs regardless of race, color, national origin, sex, age, or handicap. 2. Executed Orders 11246, as amended by Executive Orders 11375 and 12086 and subsequent regulations that prohibits employment discrimination on the basis of race, color, religion, sex, or national origin. Inclusion of the seven clauses in Section 202 of E.O. 11246 as amended by E.O. 11375 and 12086 are required in all Project-related contracts and subcontracts for municipalities over 3,000 population. BID REJECTION/ACCEPTANCE: The City reserves the right to negotiate final Procurement Contract terms with the Bidder that best serves the interests of the Buyer. The City reserves the right to reject all Bids or any Bid not conforming to the requirements of the Bidding Documents. BID WITHDRAWAL: No Bidder’s Bid shall be withdrawn for a period of sixty (60) days after the scheduled Bid Due Date without the consent of City of Oshkosh.
