WAUKAU AVENUE) GENERAL INFORMATION Applicant: Precision Land Surveying, Inc. Owners: Koeppler Family Limited Partnership Action Requested: Two-lot land division/certified survey map from one existing 2.900 acre parcel. Sizes of the proposed lots are as follows: Lot 1 =0.990 Acres Lot 2= 1.910 Acres Applicable Ordinance Provisions: Land division criteria are located in Section 30-441 of the City's Subdivision Regulations. Property Location and Type: The subject site consists of one 2.900 acre parcel, located at the southeast corner of Fond du Lac Road (U.S. Highway 45) and E. Waukau Avenue. The site is currently developed with two six-unit apartment buildings and accessory structures on the north half of the property, while the south half is undeveloped. The surrounding area consists of single-family residential used to the east, south and west and a series of three duplexes to the north. West Single-Family Residential Single-Family Residential-5 (SR-5) Comprehensive Plan Land Use Recommendation Land Use 2040 Comprehensive Plan Recommendation Light Density Residential Page 1 ANALYSIS The purpose of this land division is to separate the developed area containing the two six-unit apartment buildings from the remainder of the undeveloped property. Original plans called for three additional six-unit apartments on the southern half of the property,however, construction did not occur. Lot 1 is irregularly shaped and proposed to be divided as an approximately 158-foot wide by 250- foot deep,43,120 square foot (0.9990 acre) lot. The lot meets the minimum Multi-Family Residential - 12 (MR-12) standards of 60.00 feet wide and 100 feet deep but is slightly deficient (80 square feet deficient) in the area requirement of 43,200 square feet (3,600 square feet required per unit x 12 units =43,200). Staff will require the final Certified Survey Map (CSM)be modified to meet the minimum MR-12 area requirement prior to acceptance. Proposed Lot 2 is also irregularly-shaped, approximately 200 feet wide by 375 feet deep and 83,196 square feet in area, meeting minimum requirements of the MR-12 District. Based on the 3,600 square foot per unit requirement for residential development, the lot is sized to allow the originally proposed three six-unit apartment buildings, should that development or something similar move forward. The City does not provide access rights onto Fond du Lac Road which is U.S. Highway 45 controlled by the Wisconsin Department of Transportation. Fond du Lac Road is classified as an arterial upon which the Comprehensive Plan and Subdivision Regulations recommends minimizing direct access to these classed streets. The prior Certified Survey Map for the property (Number 6081, Winnebago County Register of Deeds)has an access restriction on the northerly half of proposed Lot 1 along Fond du Lac Road. Staff will require the restriction be included on the final version of this map, and is also recommending extending the restriction the entire length of this CSM along Fond du Lac Road. Access to Lot 2 can be made via cross access easement through Lot 1 which staff is proposing as a condition. This has been communicated to the property owner and he did not object to this recommendation. The Department of Public Works has reviewed the proposed two-lot land division and reported city water and sanitary sewer is available to serve the lot directly from Fond du Lac Road. They have no additional concerns with the CSM. RECOMMENDATION/CONDITION S Staff recommends approval of the two-lot land division/Certified Survey Map at the southeast comer of Fond du Lac Road and E. Waukau Avenue as proposed with the following conditions: 1. Place a vehicular access restriction on Lots 1 and 2 along entire length of Fond du Lac Road for vehicles entering and exiting the property. 2.
