RECEIVED And EEC- 202018 OSHKOSH SENIORS CENTER CITY CL::•::;'S OFFICE PURPOSE: The Winnebago County Nutrition Program funded through the Older Americans Act is administered by ADVOCAP, Inc. through a contract with the Winnebago County Department of Human Services. In consideration of the mutual agreements,ADVOCAP, INC., hereinafter referred to as "Program," having a corporate office at 19 W. 1st Street, P. O. Box 1108, Fond du Lac WI 54936-1108 and a local office at 181 E. North Water Street, Suite, 210, Neenah WI 54956, and the OSHKOSH SENIORS CENTER elderly facility, located at 200 N. Campbell Road, Oshkosh WI 54902, hereinafter referred to as "Facility," agree as follows: FACILITY SHALL PROVIDE: 1. Use of the Oasis West Room, kitchen and storage areas and/or storage cupboards at the Oshkosh Seniors Center facility for meal service Monday through Friday from 9:30 AM to 1:00 PM at no charge to the Program. The Facility may adjust the time this space is available to the Program on a given day or require that the Program not serve meals on a specific day by providing the Program with a minimum of one week's notice. 2. Use of the Oasis West Room at the Oshkosh Seniors Center facility for program activities in conjunction with meal service for social and recreational activities. 3. Use of kitchen utensils and equipment available at the Facility, such as NSF approved dishwashing machine, refrigerator, freezer, utility carts, pails, dishpans and small kitchen utensils such as coffee makers, serving spoons, ladles, coffee servers, salt and pepper shakers, dishes, salad bowls, cups, silverware, etc., owned by the Oshkosh Seniors Center. 4. Payment of utility charges and garbage removal. 5. Janitorial service for setting up of tables, major cleaning of Oasis West Room, kitchen and storage areas including floors, walls, etc., and maintenance. Nutrition Program staff will assist Facility janitor with setting up tables when necessary, unless restricted to do so for medical reasons. 6. Facility will not charge the Program rent for the use of the facility. 7. Facility will observe any and all applicable Federal and State laws and regulations pertaining to civil rights/discrimination in the provision of services and/or in employment practices. PROGRAM SHALL PROVIDE: 1. Meal site management including recruiting, training and scheduling of ADVOCAP volunteers who shall be responsible for hosting, serving, cleanup, light sweeping daily in the kitchen and dining room area, taking trash to exterior dumpster, record keeping, etc. and shall follow health and sanitation procedures. The Meal Site Manager at the Facility is responsible for all meal site operations. 2. Meals that meet the most current Dietary Guidelines for Americans, and provide at least one-third of the current DRI's (RDA's/AI's), as established by the Food and Nutrition Board of the Institute of Medicine of the National Academy of Science. Meals served shall also meet the nutrient standards required for Nutrition Program meals as stated in A Manual of Policies, Procedures, &Technical Assistance for the Wisconsin Aging Network, Last Revised June 30, 2011. Planning and coordination of various social and recreational activities in conjunction with the meal service as agreed and in cooperation with Oshkosh Seniors Center staff. 4. Additional consumables such as salt, pepper, ketchup, napkins, garbage bags, other disposable food service supplies, detergent, sanitizer, dish washing machine detergent and rinse agent. 5. Steam table for food service, serving trays, one (1) storage cabinet for supplies, and four (4) utility carts. 6. Replacement of small facility equipment (such as coffee makers, salt and pepper shakers, etc.) that becomes damaged during regular use by the Program. The maximum total amount in replacement cost will be a total of two hundred ($200.00) dollars per year for documented equipment breakage. 7. Replacement of upright freezer with one that is substantially similar. The replacement may be different if it is acceptable to Facility. The Program is responsible for repair of the freezer, and may remove it from the Facility when the Program no longer provides these services at this location. The Facility will be allowed to reasonably use the freezer while it is located at this location. 8. Laundering of dishcloths and towels provided by ADVOCAP. The Program will pay an annual amount of one-hundred dollars ($100.00) to the Facility for the use of its washer and dryer by February of the current contract year. The Program will provide its own laundry detergent, bleach and fabric softener. 9. Safety Data Sheets will be provided for chemical products brought into the facility. 10. Provide cellular phone for the use at the meal site. 11. Provide supplies for personal sanitation such as hairnets, gloves, and aprons. FACILITY AND PROGRAM SHALL AGREE AS FOLLOWS: 1. Individuals who are eligible to receive congregate meals are: a) Aged 60 or older. b) Any spouse who attends the dining center with their spouse who is aged 60 or older. c) A person with a disability, under age sixty (60), who resides in housing facilities occupied primarily by older individuals at which congregate nutrition services are provided. d) A disabled individual who resides at home with an eligible older individual participating in the program. 2. Individuals who are eligible to receive home delivered meals (HDMs) are: a) A person aged 60 or older who is frail and essentially home bound by reason of illness, disability, or isolation, for which an assessment concludes that participation is in the individual's best interest. b) A spouse of a person eligible for a HDM as described above, regardless of age or condition, if an assessment concludes that it is in the best interest of the home bound older individual. c) A disabled individual who resides at home with an eligible older individual participating in the program. 3. Other individuals who are permitted to receive either congregate or home delivered meals are: a) Individuals granted a Non-Elderly Waiver by Greater Wisconsin Agency on Aging Resources. b) Volunteers of the Nutrition Program. c) Staff of the Nutrition Program. d) Informal caregivers of persons who are eligible to receive either congregate or home delivered meals. OSHKOSH SENIORS CENTER Page 3 2019 CONTRACT AND AGREEMENT 4. Various rules and regulations may be established as necessary by the Facility in cooperation with ADVOCAP, Inc. 5. No meals will be served on-site on the following holidays: New Year's Day, Good Friday, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, the day before Christmas and Christmas Day. If any of these holidays fall on a Saturday, the meal site is closed on Friday. If the holiday falls on Sunday, the meal site will typically be closed on Monday. 6. When selecting a new Meal Site Manager for the Oshkosh Seniors Center, the Facility's Manager of Senior Services or designee will be part of the selection committee of final candidates for the position. 7. Comprehensive general liability insurance will be maintained by both parties with certificate of insurance coverage being furnished mutually by each party. If changes should occur, a new certificate of insurance should be submitted immediately. This Contract represents the Agreement in effect between the Facility and the Program. This Agreement is in effect from January 1, 2019, through December 31, 2019. However, either party may, at any time during the life of the Agreement, terminate this Agreement by giving thirty (30) days notice in writing to the other party of the intention to do so.
