BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized to enter into and take those steps necessary to
implement an appropriate professional services agreement with AECOM for the for pre
and post demolition assessment and remedial options report for 43 E. Th Avenue in the
amount of$85,742.

SUBJECT: Professional Service Agreement with AECOM for Environmental
Remediation Services For Pre- and Post-Demolition Assessment and
Remedial Options Report/43 East 7th Avenue ($85,742)
BACKGROUND
In anticipation of beginning several projects related to the South Shore Redevelopment
Plan and the Sawdust District, and specifically the demolition of 43 East 7th Avenue, the
Redevelopment Authority (RDA)/City retained AECOM to perform Phase I and II
environmental site assessments on various parcels within the South Shore Redevelopment
Area and Sawdust District, as well as assist with the environmental aspects of a WEDC
Site Assessment Grant application for 43 E. 7th Avenue. The RDA was successful in
obtaining a$125,000 WEDC Site Assessment Grant (SAG) to offset costs associated with
demolition activities at 43 East 7th Avenue.
The next phase of work to be completed prior to demolition which requires additional
environmental services, is pre- and post- demolition hazardous materials assessment, soil
borings following demolition, and a site assessment and remedial options plan to be
submitted to the Wisconsin DNR. This is required in order for the RDA/City to continue
the work to clean-up the site for future redevelopment.
A few years ago City staff requested qualifications from firms to perform Phase I and II
environmental site assessments on properties associated with acquisition, demolition
and/or redevelopment projects. Interviews were held with four of the eight companies
submitting proposals. Based on that process, staff selected AECOM as the preferred
environmental consultant.

ANALYSIS
AECOM's fees are based on an hourly contract, not to exceed $85,742. Specific elements of
the services to be performed for the project are:
• Hazardous materials assessment
• Geotechnical work/soil borings
• Submittal of a site assessment and remedial options plan to Wisconsin DNR
This work must be completed for compliance with the WEDC SAG grant, as well as any
future State or Federal grants the RDA/City would pursue for the redevelopment of this
area. Since the sites in this area have been historically filled and industrial uses occupied
the sites for more than a hundred years, these issues must be explored and documented.
In addition, staff will be reviewing the possible use of the Voluntary Party Liability
Exemption program offered through the Wisconsin DNR for this area.
FISCAL IMPACT
The cost of these professional services will be paid out of TIF #20 funds that the City had
set aside for environmental remediation in the 2019 CIP and reimbursed from the WEDC
SAG grant funds awarded.
RECOMMENDATION
Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional
services of a specialized nature including environmental remediation services, may be
procured without the use of competitive bidding or quotation process. In accordance with
Section 12-16 of the Code, I am hereby submitting this report regarding this environmental
remediation agreement in the amount of$85,742.
