Potratz Action Requested: Two-lot land division/certified survey map from one existing 39.926 acre parcel. Sizes of the proposed lots are as follows: Lot 1 =5.003 Acres Lot 2=34.923 Acres Applicable Ordinance Provisions: Land division criteria are located in Section 30-441 of the City's Subdivision Regulations. Property Location and Type: The subject site consists of one 39.926 acre parcel, located on the north side of State Highway 91 in the Town of Omro, approximately 1/4 mile west of James Road and Oshkosh city limits. The site is currently being used for residential and agricultural purposes. The majority of the property is being farmed with exception of a single family house and several agriculturally-used outbuildings. The surrounding area consists mostly of agricultural uses with exception of an ethanol plant to the south. West Agricultural General Agriculture District (A-2) Comprehensive Plan Land Use Recommendation Land Use 2040 Comprehensive Plan Recommendation Industrial(front 1/3) & Rural Residential (rear 2/3) Page 1 ANALYSIS The purpose of this land division is to separate the existing home and outbuildings from the agriculturally-used land. The applicant did not indicate any plans for sale or development of the land. Land divisions such as these are quite common as it gives property owners greater flexibility for future use of the agricultural portion of the land. Lot 1 is proposed to be divided as a 225.00-foot wide by 968.50-foot, 5.003 acre lot which exceeds the Town of Omro's width-to-depth ratio (depth shall not exceed 2 1/2 times the width)for newly created lots. On June 20f, 2019 the Town of Omro granted a subdivision variance to exceed the width-to- depth ratio for the creation of this lot. The 5.003 acre size of proposed Lot 1 meets the minimum area of 5.000 acres in Town's Rural Preservation area per the Town of Omro's Comprehensive Land Use Plan. The proposed two-lot land division will not immediately alter the existing land use patterns in the area. Although the Comprehensive Plan recommends industrial use along the front 1/3 of the subject site, the proposed land division will not hamper the ability for future development of the land per the Plans industrial land use recommendation. The Department of Public Works has reviewed the proposed two-lot land division and did not have any additional concerns. RECOMMENDATION/CONDITION S Staff recommends approval of the two-lot extraterritorial land division in the Town of Omro as proposed.
