SOUTH PARK AVENUE GENERAL INFORMATION Applicant/Property Owner: OPT Properties LLC Action Requested: The petitioner is requesting an access control variance to permit 30' lateral clearance from W. South Park Avenue where code requires a minimum 75' lateral clearance. Applicable Ordinance Provisions: The Access Control Ordinance, Section 25-104.1(I) of the Municipal Code. Property Location and Background Information: The subject site consists of one irregularly shaped parcel, approximately 4.44 acres in size, located on the north side of W South Park Avenue, west of Knapp Street. The subject site includes a manufacturing use to the rear of the lot (Oshkosh Plating) and an office building fronting W. South Park Avenue. The surrounding area consists of mostly residential uses to the east,west and south and quarry to the north. The 2040 Comprehensive Land Use Plan recommends Mixed Use for the subject site. South Park Avenue. A new parking area is being proposed in front of the office building. The parking area will be accessed from an existing driveway and as proposed will have a 30' front setback and lateral clearance. An Access Control Variance (ACV) is required for the lateral clearance of the new parking area as code requires a minimum 75' lateral clearance. In this particular case, staff does not have concerns with the requested reduction as the proposed parking lot only has four (4) stalls and should not result in traffic concerns related to stacking of vehicles in the driveway. However, staff is recommending a condition that the additional gravel driveway/entrance that was poured to the southwest of the subject driveway be removed as it is not in compliance with surfacing and access standards. The Department of Public Works has reviewed the proposal and did not note any concerns. The parking lot plans will be reviewed for compliance with zoning and storm water requirements during the site plan review process. RECOMMENDATION/CONDITIONS Staff recommends approval of the access control variance for reduced lateral clearance from W South Park Avenue to 30' where code requires a minimum of 75' with the condition listed below. Condition: 1. Gravel driveway/entrance to the southwest of existing driveway must be removed. SOUTH PARK AVENUE Relief from Oshkosh Municipal Ordinance Section 25-104.1(1), Restricted Lateral Clearance of 75 feet is requested. The project involves the upgrading of an existing gravel parking lot at 1222 W. South Park Avenue. Site constraints makes establishing the 75 feet lateral clearance indicated in Section 25- 104,1(1) impractical. It is proposed to provide 30 feet of lateral clearance. Since the proposed parking lot is only 4 spaces in size,the potential for vehicle conflicts that would cause the back up of vehicles into South Park Avenue is extremely low,therefore the variance would not be detrimental to the public interest. The parking lot meets the other right-of-way and property line setback requirements, having no negative impacts on neighboring property.
