Amendment to Professional Services Agreement- AECOM City of Oshkosh MEMORANDUM TO: Honorable Mayor and Members of the Co n Council FROM: James Rabe,Director of Public Works DATE: June 6,2019 RE: Amendment to Professional Services Agreement to Complete the Final Plat and Establish Lot Corners for the Southwest Industrial Park Expansion / AECOM Technical Services,Inc. (AECOM) (+$17,180) A professional services agreement with AECOM for developing six (6) lot and two (2) outlot descriptions, providing several revisions to the plat to include a potential future street extension, developing eight (8) utility easement descriptions, providing adjustments to the street right-of- way limits to all for an intersection, and adding navigable waterway information to the plat for the Southwest Industrial Park Expansion was approved by staff in May 2018. During the course of the project, City staff determined utilizing multiple certified survey maps (CSM's) in lieu of a Plat Map would be a better course of action and would provide more flexibility to the City in the long term. AECOM utilized the remaining funds on the agreement to start the preparation of CSM No.1 and its thirteen (13) associated easements. Two (2) additional CSM's with associated easements are anticipated to be completed to fully develop the anticipated lots and easements. This amendment is for additional funds necessary to complete the preparation of CSM No. 1 and CSM No. 2, the removal of the plat map lot corner pins previously installed, and the installation of the lot corner pins for CSM No. 1 and CSM No. 2. The anticipated future CSM No. 3 preparation costs will provided under separate proposal when further lot divisions may be required. Staff has reviewed the amendment and the proposed costs and has found the costs consistent with the level of effort that will be expended in order to complete this project. The amount of this contract amendment is $17,180. This will raise the total agreement amount to $27,640 (not to exceed). Private and public infrastructure projects in TID #23, which have been funded with a State Trust Fund Loan and General Obligation debt,have created a funding source for this amendment. Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature, including engineering services, may be procured without the use of formal, sealed quotes. In accordance with Section 12-16 of the Code, I am hereby submitting this report regarding this amendment. (AECOM) is proposing Amendment No 1 to Proposal Number OPP-813123, dated May 11, 2018,to change the scope of work from completing a Plat Map to preparing two(2)Certified Survey Maps(CSM), associated easements, and pinning the lot corners per State of Wisconsin requirements. Project Background AECOM began assisting the City in preparing a draft plat and associated legal descriptions under a Task Order as part of the 2017 General Structural Services Agreement. That approved budget and associated scope of work was completed in late 2017. After completing that scope of work, subsequent revisions to the Plat beyond the original approved scope of work were requested by the Planning Services and Engineering Divisions. The work involved in those revisions was completed under a separate agreement, dated May 11, 2018. These revisions in general included: • Development of six(6) lot and two(2) out lot descriptions and multiple revisions. • Providing several revisions to the plat to include a potential future street extension. • Development of eight(8)utility easement descriptions. • Providing adjustments to the street Right-of-Way(ROW) limits to allow for an intersection. • Addition of navigable waterway information to the Plat. This scope of work was completed and final draft documents submitted to the City by June 2018. During the summer of 2018, City staff determined utilizing Certified Survey Maps(CSM)in lieu of a Plat Map would be a better course of action and provide more flexibility to the City in the long term. This change in direction was the result of increased interest in development of some of the available land including three(3) potential rail road spurs. The CSM approach allowed for an expedited method for creation of lots and easements to meet the property development schedules. As a result, with City staff permission, AECOM utilized remaining funds not utilized in Proposal Number OPP-813123 to start the preparation of CSM No. 1 and 13 associated easements. We anticipate two additional CSM's(CSM No. 2 and CSM No. 3)with associated easements will be completed to fully develop the anticipated lots and easements. This amendment is requesting additional funds to complete the preparation of CSM No. 1 and CSM No. 2, and removal of the Plat Map lot corner pins previously installed and the installation of the lot corner pins for CSM No. 1 and CSM No. 2. The anticipated future CSM No. 3 preparation costs will be provided under a separate proposal, or amendment,when further lot divisions may be required. We anticipate this will occur several years in the future and do not have enough information to logically create CSM No. 3 lots or easements currently. After development of the draft CSM, the following revisions occurred: • Changing of termination of Compass Way from a straight railroad crossing to Global Parkway into a cul-de-sac. This was required as the railroad crossing was not approved by the Wisconsin&Southern Railroad and the Office of the Commissioner of Railroads. This potential change was also identified during the preparation of the Plat Map but was not fully developed. • Eliminating the cul-de-sac area referenced above and adding Transit Drive ROW. This additional ROW will eliminate the dead-end street which would be problematic for truck traffic to navigate. • Updating the Wetland Delineation per information provided by City staff. This was a more recent delineation and reduces the wetland area. • Changing the existing six(6) lot Plat Map configuration into three(3) lots, one(1)outlot, and right-of way for Compass Way and Transit Drive. • Preparation of 13 easements descriptions. Easements included preparation of seven(7) Municipal Utility, four(4) Public Utility, and two(2) railroad easements. There were several revisions to each easement during the multiple reviews to try and accommodate potential development requirements. We request an additional 30 hours of a PLS, and 6 hours of a Senior PLS to complete CSM No. 1. The total estimated budget request is approximately$3,600. CSM No 2 The City has requested AECOM prepare CSM No. 2. This CSM will further divide Lot 3 created in CSM No. 1. We anticipate creating up to four(4)additional lots. One(1) outlot for the storm water ponds and ditches,two(2)outlots for the Transload Facility, and one(1)outlot for the balance of Lot 3 not accounted for in the outlots. In addition, we anticipate creating up to four(4)easements. The CSM documents have been and will be prepared by a Professional Land Surveyor(PLS)licensed by the State of Wisconsin. In addition,the documents will be reviewed by an independent AECOM PLS as part of a quality review. We anticipate approximately 60 hours of a PLS, 6 hours of a Senior PLS, and 4 hours of a Project Manager will be required to complete CSM No. 2. The total estimated budget request is approximately$7,180. This budget includes one(1) meeting at City Hall with our staff. Lot Pinning AECOM surveyors, under direction of a PLS, will establish all lot corners created by CSM No. 1 and CSM No. 2, prior to the CSM being registered with the State of Wisconsin. In addition,AECOM staff will remove the previously-installed Plat Map lot and ROW corners that will no longer be required. Several of these pins must be removed because they are no longer correct. AECOM will only remove the ones no longer required. The Plat Map Lot and ROW pins were installed in 2017, as the Plat Map at that time was considered final and was to be submitted for State of Wisconsin for approval. The pins had to be installed prior to registering the Plat Map with the State of Wisconsin. We anticipate it will take approximately one(1) 8-hour day with a 2-person crew under the direction of a PLS (2 hours) to removal all pins that are not required. The cost for pin removal, including equipment, is estimated to be$2,200. In addition, we anticipate it will take approximately two(2) 10-hour days for a 2-person survey crew under the direction of a PLS(2 hours)to install all required lot pins. The cost for installing of lot pins including equipment and direction of PLS is estimated to be$4,200. We estimate approximately $7,180 to complete CSM No. 2, and approximately$6,400 for Lot pin removal and installation. Therefore,we are requesting a total budget increase of$17,180. As with all our agreements,AECOM will only bill for actual time incurred. We reserve the right to request changes in budgets if the scope of work varies from our project assumptions. This includes increases as well as decreases in our budget. Please note the AECOM Fee Schedule will not be increased for 2019. The fees will remain the same as the 2018 Approved Fee Schedule. The services provided will be performed in accordance with the approved Fee Schedule and conditions of the General Conditions of Service—City of Oshkosh,April 2009, which are expressly incorporated into, and are an integral part of, our agreement for professional services.
