HomeMy WebLinkAbout07. 19-292 MAY 28, 2019 19-292 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) AS AMENDED PURPOSE: APPROVE PLANNING SERVICES FEE SCHEDULE INITIATED BY: CITY ADMINISTRATION BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached revised fees for Zoning Ordinance copies, Conditional Use Permit Recording Fee, Short Term Rental Fee*, Zoning Code Enforcement Fees and commencing work without a permit fee, is hereby approved, effective June 1, 2019. All other permit fees for Planning Services remain unchanged. *AMENDED SHORT TERM RENTAL FEE INDICATED ON ATTACHMENT. COUNCIL WILL REVIEW AFTER THE FIRST YEAR. City 0f Oshkosh TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: May 23, 2019 RE: Approve Planning Services Fee Schedule BACKGROUND The Planning Services Division charges various fees related to project reviews, permit and license issuance, and code enforcement as well as fees related to purchase of various division documents. Fees are periodically adjusted based on need especially or when new fee categories are created. Staff is proposing to update 5 fee categories as part of this action in an effort to offset administrative costs related to the various cost categories proposed to be updated as part of this resolution. ANALYSIS The proposed fee increases are meant to recover administrative costs related to various actions covered in the relation. Staff is proposing a fee of$100 to cover the cost of issuance of a license for a new short term rental. At this point staff cant anticipate how many licenses will be issued as it is a new requirement and the applicability date for the local license first applies at 16 days, which will not apply until after August 1, 2019. Staff if proposing what appears to be a significant increase in services fees related zoning code enforcement. The rationale for the change is to bring the service fees in line with Inspection Services service fees as there are many similarities in the codes being enforced. The existing initial service fee of $20 generally does not cover the amount of staff time that is put into the enforcement process such as the initial inspection and issuance of orders nor dealing with the persons or companies creating the violations. Service fees are generally only issued after the initial correction orders have been issued with a compliance date along with a re-inspection. Recording the CUPs ensures that when property ownership changes,but the use doesn't, that the new owner will be notified of the conditions in effect on the property. Other changes include increasing the cost of selling hard copies of the Zoning Ordinance which has increased due to the increased number of pages in the new Ordinance. As the Zoning Ordinance is available on line there are almost no hard copy sales so there will be very little fiscal impact. The last fee description involves changing the work without a permit fee from a triple fee basis to a flat fee of $100. The triple permit fee can be too punitive when looking at some of the Division's higher fees that could range into the several thousand dollar neighborhood. The$100 is also consistent with Inspection work without a permit fee. Other new fees include a notification and/or publication fee for some items going before the Plan Commission and Board of Appeals and a Historic Tax Credit research fee to be charged on an hourly basis versus a flat fee which is the most common fee on the schedule. The temporary use permit fee has not changed since 2006 and that has been at $75 for up to 90 days. A new three tiered system is being proposed ranging from $75-$125 depending on the time period requested and for the first time a "quantity discount" for up to 4 separate sites is being proposed that reduces the additional fee by 50% per site (maximum of 4 sites) if the permits are all obtained at one time. The sign category has expanded to reflect the various categories of signs that are put up and each may require a different level of review depending on type and location. FISCAL IMPACT Revenue from the new fees will help offset overall Division operations and should add another $5,000-$8,000 in annual revenue depending on activity.
