Applicable Ordinance Provisions: Guidelines for the releasing and granting of easements are located in Article XIII: Subdivisions of the Zoning Ordinance. Subject Site Existing Land Use Zoning Riverfront Mixed-Use in Planned Development and Riverfront Overlays Vacant Land/Undeveloped (RMU-PD-RFO) Adjacent Land Use and Zoning Existing Uses Zoning North Fox River NA Two Flat Residential-10 (TR-10), Central Mixed-Use(CMU) &Urban South Mixed Residential&Commercial Mixed-Use (UMU) Riverfront Mixed-Use in Planned Development and Riverfront Overlays East Commercial (RMU-PD-RFO) Two Flat Residential-10 (TR-10), Riverfront Mixed-Use in Planned Low Density Residential,Vacant Development and Riverfront Overlays West Land/Undeveloped (RMU-PD-RFO) Comprehensive Plan Land Use Recommendation Land Use 2040 Land Use Recommendation Center City ITEM IX—Release/Accept Easements,Morgan District Page 1 BACKGROUND INFORMATION/ANALYSIS On October 23, 2018,the Common Council approved a Conditional Use Permit and Specific Implementation Plan for a multi-family development located at the northwest corner of W. 6th Avenue and Oregon Street, commonly referred to as the Morgan District. Part of the site preparation involves the release of City-held easements and the City's acceptance of easements from the property owner for proposed City access and infrastructure placement. This request also includes lands east of Oregon Street, owned by Morgan District,LLC and Riverfront Development II, LLC and Riverfront Development III,LLC. Release of Utility Rights in Discontinued Right-of-Way The lands owned by Morgan District, LLC is a conglomerate of several blocks within the City's Original Third Ward. The City vacated numerous street segments in the area throughout the 20th Century with the land being dispersed to adjacent properties. Upon the vacations or discontinuances,the City retained rights to access and maintain City infrastructure within the vacated areas. The City is proposing to release these rights to allow for Morgan Development's project to proceed unimpeded. The following is the list of proposed release of utility rights in discontinued right-of-way. Release Area 1-Rights retained from the Common Council action dated February 1, 1961 for W. 51h Avenue from Oregon Street to Minnesota Street; and Minnesota Street from W.51h Avenue to the Fox River. Release Area 2-Rights retained from the Common Council action dated December 6, 1954 for that part of W.51h Avenue from the west line of Minnesota Street to the east line of Iowa Street and Minnesota Street from the north right-of-way line of W.51h Avenue to the north right-of-way line of W. 61h Avenue. Release Area 3-Rights retained from the Common Council action dated November 24, 1965 for that part of W. 3rd Avenue lying between the extended west line of Lot 10 of Block 76 and the Fox River,that part of W. 41h Avenue lying between the extended east line of Lewis Street and the west line of Minnesota Street; and that part of Iowa Street lying between the north line of W. 5th Avenue and the Fox River. Release Area 4-Rights retained from the Common Council action dated December 15, 1988 for that part of W. 51h Avenue lying between Oregon Street and Nebraska Street. Release of Access Rights in Discontinued Right-of-Way Release Area 5-Access Rights retained from the Common Council action dated February 1, 1961 for W. 51h Avenue from Oregon Street to the east line of Minnesota Street; and Minnesota Street from the north line of W.51h Avenue to the Fox River. This access was retained for the purpose ITEM IX—Release/Accept Easements,Morgan District Page 2 and use of the Oshkosh Fire Department to access the fire deck at the foot of Minnesota Street and reserving fire hydrants for exclusive use of the Fire Department. Mutual Release of Interests Release Area 6—On January 5, 1.955 the City entered into an agreement with the property owner at that time related to the interactions of the property owner's use of the vacated right-of-way with the City's use of its statutory utility easement with in the right-of-way. The vacated right- of-ways in question are those vacated November 24, 1965 for that part of W. 3rd Avenue lying between the extended west line of Lot 10 of Block 76 and the Fox River, that part of W.41h Avenue lying between the extended east line of Lewis Street and the west line of Minnesota Street; and that part of Iowa Street lying between the north line of W. 5th Avenue and the Fox River. Release of Recorded Easements (Landscape) Release Area 7—On May 11, 1981, the Common Council accepted an easement for the purpose to access the property, plant,maintain and repair a planting plan. The location of the easements are south of the bulkhead line of the Fox River, approximately 35 feet wide on both sides of Oregon Street as described in Document 565479,Winnebago County Register of Deeds. Release of Recorded Easements (Public Sewer) Release Area 8—On March 11, 1941,the Common Council accepted an easement for public sewer purposes. The easement is a ten-foot strip of land across Lots 4 and 16 of Block 62 of the Original Third Ward as described in Volume 497,Page 169,Winnebago County Register of Deeds. The Department of Public Works has reviewed the proposed releases and confirmed retaining these easements are no longer necessary. The property owner has reviewed the proposed releases and do not have any concerns. Easement documents are being prepared by the City Attorney's office and will be recorded at the Winnebago County Register of Deeds upon Common Council approval. Acceptance of Storm Water Drainage and Access Easement. The City is proposing the acceptance of two easements within the Morgan District Property. The first easement is a storm water drainage easement generally located between Vacated W. 41h and W.5th Avenues, east of Vacated Iowa Street. The purpose of the easement is to use the property for storm water management facilities, including construction of new infrastructure and continued access and maintenance. The second easement is a storm water drainage and electrical easement to be used by both the City and Wisconsin Public Service Corporation(WPS). The City's use of the easement is the same as the first easement related to storm water management facilities. The WPS benefit is to provide them access to its adjacent electrical easement for placement, access and maintenance of electrical ITEM IX—Release/Accept Easements,Morgan District Page 3 infrastructure. It is noted in the easement language that the City and WPS will coordinate their activities to avoid any conflicts with each other's facilities. Acceptance of Electric Utility and Access Easement. The City is proposing the acceptance of two easements within the Morgan District Property. The first easement will be shared with WPS for the transmission of electric facilities from adjacent easements to serve the City's adjacent riverwalk easement. The proposed easement is primarily eight feet wide located from the north line of Vacated W. 51h Avenue to just north of the south line of W.4th Avenue. The second easement is a small trapezoidal shaped easement located within Vacated W. 4th Avenue adjacent to Iowa Street. The easement will be part of the adjacent city storm water drainage easement. The easement will also be used by the City and WPS for placement of electrical infrastructure. RECOMMENDATION/CONDITIONS Staff recommends approval of the release and acceptance of the various described easements within and east of the Morgan District as proposed.
