AS AMENDED
PURPOSE: APPOINTMENT OF INDIVIDUAL TO FILL VACANT COUNCIL
SEAT
INITIATED BY: CITY COUNCIL
WHEREAS, the election of Council Member Lori Palmeri to the position of Mayor
has created a vacancy in the position of Council Member for the City of Oshkosh; and
WHEREAS, it is necessary to fill that vacancy; and
WHEREAS, state statutes provide that such vacancy may be filled by appointment
by the Common Council of an individual to serve the remaining term of a vacant council
position; and
WHEREAS, City of Oshkosh Municipal Code section 2-5 sets forth a procedure for
filling a vacant council position; and
WHEREAS, applications have been solicited, filed and all proceedings in
accordance with state statute and city ordinance have been complied with.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that William Miller is hereby appointed to fill the remaining term of Council
Member Lori Palmeri, which will expire in April of 2020.

RE: Appointment of Individual to Fill Vacant Council Seat
On its May 14, 2019 agenda the Council will have a resolution to appoint an individual to fill the
vacant Council Seat created when Council Member Palmeri was sworn in as Mayor.
Pursuant to the discussion at Monday's Special Council Meeting when this item is called, we
will follow the following procedure:
• Applicants make a brief presentation with questions and answers to Council (There will
be no video presentations as none have been submitted). Following is the order of
presentations which was determined by random selection:

• Selection Procedure —
o Mayor will solicit nominations from the applicant pool
o Any Council Member may make a nomination, if a Council Member wishes to
nominate another person he/she may make such nomination after all Council
Members have had an opportunity to make an initial nomination
o Motion to close nominations / second / vote to close nominations
o City Clerk will poll council members who shall respond with the name of the
applicant that they are casting their vote for
o Successful applicant must receive a majority vote — four (4) votes are required
O If there are more than two nominations, a first ballot will be taken. If no one
receives a majority (4 votes), all but the top two nominees will be eliminated and
a second vote will be taken on the two remaining nominees.
O In the event of a tie or other failure to obtain a majority (4 votes), council may
decide to re -vote or to re -start the nomination process.
• Move the resolution reflecting the name of the prevailing candidate, second, vote
"I move to adopt Resolution 19-269 appointing _(name of prevailing candidate) _ to
fill the vacant council seat."
• Clerk will swear in the new Council Member
• New Council Member takes seat on dais
• Business meeting continues
