HomeMy WebLinkAbout24. 19-153 FEBRUARY 26, 2019 MARCH 12, 2019 19-129 19-153 ORDINANCE FIRST READING SECOND READING (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE CLOSURE OF OREGON STREET FROM WEST 16TH AVENUE TO WEST 21ST AVENUE, INCLUDING THE INTERSECTION OF WEST 20TH AVENUE/OREGON STREET INITIATED BY: DEPARTMENT OF PUBLIC WORKS A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AUTHORIZING A VARIANCE TO SECTION 25-23 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO STREETS TO REMAIN OPEN TO TRAFFIC DURING THE COURSE OF EXCAVATION WORK. WHEREAS, the City of Oshkosh Municipal Code Section 25-23 requires a passageway of not less than ten(10)feet in the travelled portion of the street to remain open on various streets within the City of Oshkosh,including Oregon Street and 201h Avenue;and WHEREAS, the City has previously entered into a Contract with PTS Contractors, Inc. which includes the full reconstruction on Oregon Street from West 161h Avenue to West 21s' Avenue, including the intersection of West 201h Avenue/Oregon Street and which permits the closure of West 201h Avenue/Oregon Street at the intersection to accommodate this reconstruction; and WHEREAS, it is necessary therefore to grant a variance from the terms of section 25- 23 for this purpose; and WHEREAS, the timing of the closure is dependent upon progress of the work, weather and other factors. NOW, THEREFORE the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. PTS Contractors, Inc. is hereby granted a variance from the provisions of Section 25-23 of the City of Oshkosh Municipal Code to close the intersection of West 201h Avenue/Oregon Street for full reconstruction subject to the following conditions: FEBRUARY 26, 2019 MARCH 12, 2019 19-129 19-153 ORDINANCE FIRST READING SECOND READING CONT'D A. PTS Contractors shall provide all necessary and required signage for the closure of the street and detour of traffic. B. PTS Contractors, Inc. shall at least seven (7) days prior to the anticipated closure provide notice to the Department of Public Works and install advance warning signs for motorists. C. PTS Contractors, Inc. shall work with the Department of Public Works to minimize the effects of the street closure upon emergency services and the public. D. The Director of Public Works is hereby authorized to approve such closure, approve such closure with conditions or take such other action as may be necessary and appropriate in consultation with the Police and Fire Chiefs of the City of Oshkosh to protect the health, safety and welfare of the citizens. SECTION 2. This ordinance shall be in full force and effect from and after its passage, publication and placement of the appropriate temporary signage indicating the closure. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #19-153 A GENERAL ORDINANCE OF THE CITY OF OSHKOSH TO APPROVE CLOSURE OF OREGON STREET FROM WEST 16TH AVENUE TO WEST 21ST AVENUE, INCLUDING THE INTERSECTION OF WEST 20TH AVENUE/OREGON STREET on March 12, 2019. The ordinance allows the temporary closure of Oregon Street from West 161h Avenue to West 21s' Avenue, including the intersection of West 201h Avenue/Oregon Street, for purposes of full reconstruction. The ordinance makes the contractor responsible for advance notice of the closure to motorists and for installation of all signage and detour signage during the closure. Gohde, Assistant Director of Public Works DATE: February 21, 2019 RE: Approve Closure of Oregon Street from West 161h Avenue to West 21s' Avenue, including the intersection of West 2011, Avenue/Oregon Street BACKGROUND The bid award for Contract 19-05 to PTS Contractors, Inc. (PTS) will be presented to Council at the February 26, 2019 meeting. The project includes the full reconstruction of Oregon Street from West 161h Avenue to West 21St Avenue, including relay of storm sewer, sanitary sewer, and water main, and their respective laterals. The reconstruction includes the intersection of Oregon Street with 201h Avenue. Section 25-23 of the Municipal Code of the City of Oshkosh requires Oregon Street and 201h Avenue to remain open during excavation. The Contract documents allow for construction work on Oregon Street from West 16th Avenue to West 18th Avenue to be completed in sixteen (16) weeks; West 18th Avenue to West 20th Avenue to be completed in sixteen (16) weeks; and West 20th Avenue to West 21s' Avenue to be completed in eight (8) weeks. The Contract documents allow the closure of West 20th Avenue/Oregon Street intersection for a period of eight (8) consecutive weeks. The Contract documents further require work be scheduled such that, at a minimum, every other cross -street intersection of Oregon Street is open to east -west traffic and that the Contractor is to have no traffic restrictions of any kind at the intersection of West 201h Avenue during EAA Air Venture 2019. L\ Engineering \2019 CONTRACTS\ 19-05 2nd Page 1 of 2 Paving \ Project_Information\ Correspondence \ Memo \ 19-05 Memo for Oregon St & 20th Ave Closure 2-21-19.docx Detour routes will be posted for the duration of the construction on Oregon Street using West 9th Avenue, South Main Street, West 24th Avenue, West South Park Avenue, and Ohio Street. However, we recognize that local, non-commercial traffic will identify and use different routes around the construction area. The Contractor is required to maintain access to businesses for the duration of the project. The initial closure of Oregon Street from West 161h Avenue to West 21s' Avenue is anticipated to start middle to late March 2019, with additional closures occurring as the work progresses. Advanced warning signs will be placed seven (7) days prior to any of the closures' beginning to warn drivers. ANALYSIS Based on the excavation limits necessary for utility construction, staff determined the intersection of West 201h Avenue with Oregon Street would need to be closed to traffic. Additionally, worker safety and driver safety will be compromised during the construction work if done under traffic and additional time will be necessary to complete the work. FISCAL IMPACT The closures were included in the Contract documents, so there are no fiscal impacts to this ordinance. RECOMMENDATIONS I recommend approval of the request to close Oregon Street from West 1611, Avenue to West 21St Avenue, and the intersection of West 201h Avenue/Oregon Street. Approved: Mark A.
