PLAN COMMISSION STAFF REPORT MARCH 5,2019 ITEM IV: APPROVAL OF A SPECIFIC IMPLEMENTATION PLAN AMENDMENT TO ALLOW TWO NEW ELECTRONIC MESSAGE CENTER (EMC) SIGNS AT 501 E. PARKWAY AVENUE GENERAL INFORMATION Applicant: Jamie Wilcox Owner: Boys and Girls Club of Oshkosh, Inc. Actions Requested: The applicant requests approval of a Specific Implementation Plan amendment to allow two Electronic Message Center (EMC) signs at 501 E.Parkway Avenue. Applicable Ordinance Provisions: Planned Development standards are found in Section 30-387 of the Zoning Ordinance. The original Planned Development did not address signage;EMC signage is subject to the standards listed in Figure 30-290b of the Zoning Ordinance. Code Reference Regulation Figure 30-290b Electronic Message Boards: Maximum Area(per side): Institutional Zoning District-100 sq. ft., Maximum Quantity: One (1) Electronic Message Board per lot. Section 30-280(A)(8) In addition to the setback requirements of this Chapter,no sign containing an electronic message board shall be located within 100 feet of any parcel within a residential zoning district. Property Location and Background Information: The subject site consists of one parcel approximately 3.44 acres in size, recently rezoned to Institutional-Planned Development(I-PD). The subject property consists of the Boys and Girls Club of Oshkosh. The surrounding area consists primarily of single and two-family residential land uses to the north, east and west. A mixture of commercial and residential land uses are located to the south. The 2040 Comprehensive Land Use Plan recommends Community Facility use for the subject area. The Plan Commission recommended approval of a General Development Plan(GDP) and Specific Implementation Plan (SIP)with conditions at the December 181h, 2018 Plan Commission meeting. The City Council approved the GDP and SIP at the January 22nd,2019 Council meeting. Subject Site Existing Land Use Zonn Boys and Girls Club of Oshkosh,Inc. All uses on site were covered in the original GDP/SIP. Site Design The subject site consists of one parcel with approximately 149,846.4 sq. ft. of community facility space. The parcel contains the Boys and Girls Club facilities and associated parking on the northern and central portions of the site and a ball field on the southern portion of the site. The applicant recently received approval to increase the size of the playground area and create a community garden area. Access and Circulation No changes are proposed to access and circulation at the site. Parking No changes are proposed to the parking on the site. Signage and Lighting No changes are proposed to the existing lighting on the site. No changes are proposed to any off-building signage on the site. On-Building Signage Currently the on-building signage consists of wall signage primarily near the building entrances and visually compatible with the building. The applicant is requesting an SIP amendment to allow the addition of a 17"x 99" digital EMC on the south side of the building (at the entry near Broad Street) and the addition of a 17"x 99" digital EMC to the north side of the building (at the north building entry off of E. Parkway Avenue). In both cases the new EMCs would supplement the existing on-building wall signage. The intent of the applicant is to use this signage to provide information to visitors on hours the facility is open and events occurring there. Item IV—PD Amendment—501 E.Parkway Avenue 2 Page 2 Staff reviewed the proposed EMCs, their placement on the building and their sizes. The combined area of both proposed EMCs is approximately 23.44 sq. feet. The zoning ordinance allows a maximum of 100 sq. ft.per side for an EMC on an Institutional-zoned parcel. The combined area of the two proposed EMCs is less than one-fourth of the total area allowed by base zoning. The ordinance does only permit one (1) EMC per lot so the applicant will require a base standard modification(BSM) to allow two EMCs on this site. The Plan Commission should also note Section 30-280(A)(8) of the zoning ordinance. This section states that, "In addition to the setback requirements of this Chapter, no sign containing an electronic message board shall be located within 100 feet of any parcel within a residential zoning district." Staff examined this provision as it relates to the placement of EMC signage on this site. The intent of the provision is to minimize the potential adverse visual impact on neighboring properties that an unregulated bright EMC might have. The EMC on the north facade of the building would be located approximately 200 feet from the nearest property to the north(across E. Parkway Avenue). The EMC on the north facade would be primarily visible to visitors arriving in the parking lot to the north as they enter the building. The applicant's property serves as a buffer between this sign and the nearest residential properties to the north. The railroad serves as a buffer between this sign and the nearest residential properties to the west and the applicant's property serves as a buffer between the sign and the residential properties to the east(across Monroe Street). In all cases, the sign on the north is at least 200 feet away from residential properties. The EMC proposed for the south facade of the building would be located near the entry off of Broad Street. This EMC would be over 200 feet away from any neighboring properties to the west(across the railroad). It would be approximately 130 feet away from the neighboring properties to the east and screened from view by the recess of the Boys and Girls Club building facade. The EMC would be approximately 300 feet away from the property to the south and buffered there by the Boys and Girls Club ball field and parking lot. This sign too would be visible from the parking lot and walkway as visitors approach the building entry. Due to the height and size of the EMCs the primary intention of the signage proposed appears to be that of providing information to visitors once they are on the property. Staff does not see issues and believes the visual impact for any neighboring properties should be minimal due to the reasons described above. The applicant's site,building and adjacent railroad all serve as buffers that should minimize potential problems for neighboring properties. Staff is supportive of granting a BSM to permit two (2) EMCs on the site. Landscaping No changes to the existing landscaping are proposed. Storm Water Management No changes are proposed to the existing storm water situation on the site. Item IV—PD Amendment—501 E.Parkway Avenue 3 Page 3 FINDINGS/RECOMMENDATION/CONDITIONS In its review and recommendation to the Common Council on an application for a Planned Development district, staff recommends the Plan Commission make the following findings based on the criteria established by Chapter 30-387(C)(6): (a)The proposed Planned Development project is consistent with the overall purpose and intent of this Chapter. (b) The proposed Planned Development project is consistent with the City's Comprehensive Plan and other area plans. (It is the responsibility of the City to determine such consistency.) (c) The proposed Planned Development project would maintain the desired relationships between land uses,land use densities and intensities, and land use impacts in the environs of the subject site. (d) Adequate public infrastructure is or will be available to accommodate the range of uses being proposed for the Planned Development project, including but not limited to public sewer and water and public roads. (e) The proposed Planned Development project will incorporate appropriate and adequate buffers and transitions between areas of different land uses and development densities/intensities. (f) The proposed Planned Development project design does not detract from areas of natural beauty surrounding the site. (g) The proposed architecture and character of the proposed Planned Development project is compatible with adjacent/nearby development. (h)The proposed Planned Development project will positively contribute to and not detract from the physical appearance and functional arrangement of development in the area. (i) The proposed Planned Development project will produce significant benefits in terms of environmental design and significant alternative approaches to addressing development performance that relate to and more than compensate for any requested exceptions/base standard modifications variation of any standard or regulation of this Chapter. (j) For Planned Development projects that are proposed to be developed in phases, the applicant can provide a timeline for development and can demonstrate that the project would be successful even if all phases were not or could not be completed. Staff believes that the development meets the standards set forth in Section 30-387 of the Zoning Ordinance and has a positive impact on surrounding lands,will be harmonious with the intended character of the general vicinity, and will not be detrimental to neighboring properties or the community as a whole. Staff also feels that the proposal reflects the city's development and planning policies, enhances the appearance of the area and is architecturally compatible with nearby and adjacent structures lending a positive contribution to the physical appearance of land uses and buildings in the community. Staff recommends approval of the Specific Implementation Plan amendment with the findings listed above and the following conditions: Item IV—PD Amendment—50I E.Parkway Avenue q Page 4 1. Base standard modification to allow the addition of two (2) EMCs on the site in accordance with the locations provided by the applicant. 2. No additional freestanding or on-building signage shall be installed on site without applying for and receiving approval from the Plan Commission and Common Council. 3. No modifications shall be made to other aspects of the site. Any future modifications shall be filed as separate requests and be reviewed by the Plan Commission. 4. Proposed EMCs shall meet all ordinance standards for Electronic Message Boards, as explained in Section 30-280 of the Zoning Ordinance.
