Applicable Ordinance Provisions: Guidelines for the granting of easements and right-of-way dedication criteria are located in Article XIII: Subdivisions of the Zoning Ordinance. Subject Site Existing Land Use -Zoning Heavy Industrial(HI) (In process to add Planned Development Overlay Vacant Land/Agricultural, Railroad Transload Facility (PD)) Adjacent Land Use and Zoning Existing' Uses Zoning Single Family Residential—3 (SR-5), Low Density Residential,Institutional Institutional(I) &General Agricultural North (YMCA),Vacant Land Extraterritorial(A-2ETZ) Manufacturing,Wisconsin Southern Heavy Industrial(HI) &General South Railroad Industrial Extraterritorial(M-3ETZ) East Vacant Land/Agricultural Rural Holding (RH) Heavy Industrial(HI),Light Agricultural Extraterritorial(A-1ETZ) Low Density Residential,Vacant &Single Family Residence West Land/Agricultural Extraterritorial(R-1ETZ) Comprehensive Plan Land Use Recommendation Land Use 2040 Land Use Recommendation Industrial ITEM III—Grant Easements,Right-of-Way Dedications,SoutJnvest Industrial Park Expansion Area Page 1 BACKGROUND INFORMATION/ANALYSIS The city is in the process of preparing a Certified Survey Map as part of the Southwest Industrial Park expansion. The map will consolidate lands owned by the city,create four new lots and dedicate new streets to provide access to the area. The city started acquiring this land in the early 2000s. Since then, construction of public and private utilities have occurred which follow the proposed street layout. Additional industrial park preparation included the construction of several storm water facilities to serve anticipated industrial development. Lastly, the city completed construction of a railroad transload facility,which will anchor the expansion area and attract development to the area. Granting of Easements With the city having a large amount of public infrastructure in place, the city has decided to include the granting of a variety of easements to itself to serve various purposes. This will ensure that the city will have continued access to its facilities after the city no longer maintains ownership of the underlying land. Easements will also be granted to provide secured rail access and provide locations for public utility providers such as Wisconsin Public Service,AT&T, etc. The following is the list of the proposed easements, which includes the purpose, general location and size. Easement Area 1—A municipal utility easement south of Compass Way covering existing city storm sewer. The proposed easement is triangular, approximately 12 feet by 105 feet and 576 square feet in size. Easement Area 2—A municipal utility easement southeasterly of Compass Way covering existing city storm sewer. The proposed easement is irregular shaped, approximately ten feet by 246 feet and 1,819 square feet in size. Easement Area 3-A municipal utility easement northwesterly of Compass Way covering existing city storm sewer. The proposed easement is rectangular shaped, approximately 30 feet by 146 feet and 4,368 square feet in size. Easement Area 4-A municipal utility easement northeasterly of Compass Way covering existing city sanitary sewer. The proposed easement is irregular shaped, approximately 30 feet by 800 feet and 29,322 square feet in size. Easement Area 5-A storm drainage easement northwesterly of Compass Way covering existing city storm sewer and storm drainage feature. The proposed easement is irregular shaped, approximately 30 feet by 785 feet and 26,452 square feet in size. ITEM III—Grant Easements,Right-of-Way Dedications,Southwest Industrial Park Expansion Area Page 2 Easement Area 6-A municipal utility easement northwesterly of Compass Way covering existing city sanitary sewer. The proposed easement is irregular shaped, approximately 66 feet by 446 feet and 7,863 square feet in size. Easement Area 7-A municipal utility easement southeasterly of Compass Way north of the railroad right-of-way covering existing city sanitary sewer storm sewer and water main. The proposed easement is irregular shaped, approximately 25 feet by 796 feet and 40,902 square feet in size. Easement Area 8-A railroad easement east of Compass Way for future rail spur expansion. The proposed easement is irregular shaped, approximately 40 feet by 275 feet and 10,999 square feet in size. Easement Area 9-A railroad easement north of Transit Drive for future rail spur expansion. The proposed easement is irregular shaped, approximately 40 feet by 1,732 feet and 39,133 square feet in size. Easement Area 10—A public utility easement buffered 12 feet from the proposed"inside" right- of-way lines of Transit Drive,Compass Way and Clairville Road encompassing Proposed Lot 1. The easement will provide locations for private utility providers such as Wisconsin Public Service,AT&T,etc. Easement Area 11 -A public utility easement buffered 12 feet from the proposed "outside" right- of-way lines of Transit Drive, Compass Way and Clairville Road adjacent to Proposed Lots 2 and 3. The easement will provide locations for private utility providers such as Wisconsin Public Service,AT&T, etc. Easement Area 12-A public utility easement buffered 12 feet from the proposed east right-of- way line of Clairville Road adjacent to Proposed Lot 3. The easement will provide locations for private utility providers such as Wisconsin Public Service,AT&T,etc. Easement Area 13-A public utility easement north of the railroad right-of-way located over the prior street extension of Global Parkway. The easement will provide locations for private utility providers such as Wisconsin Public Service,AT&T, etc. The proposed easement is rectangular,50 feet by 66 feet and 3,300 square feet in size. Easement documents are being prepared by the City Attorney's office and will be recorded at the Winnebago County Register of Deeds. Street Right-of-Way Dedications The city is proposing a right-of-way dedication of a looped street to access lands east of Clairville Road and north of the Wisconsin Southern Railroad (Department of Transportation-owned) right- of-way. The initial layout had an extension of Global Parkway crossing the railroad and loop ITEM III—Grant Easements,Right--of-Way Dedications,Southwest Industrial Park Expansion Area Page 3 around to Clairville Road. The city however, was not able to get approval of a rail crossing so the city modified the layout to loop around resulting in two connections to Clairville Road. The proposed street is approximately 6,600 feet or 1.25 miles long consisting of a 66-foot right-of- way. To avoid having two intersections on Clairville Road with the same street name, two names are being proposed, Compass Way and Transit Drive. The street names change at the proposed rail crossing. Compass Way will start north of the crossing,head north then loop west to Clairville Road. Transit Drive will start south of the crossing and head west to Clairville Road. Winnebago County has reviewed the proposed street names and has given approval for their use. The city is also proposing right-of-way dedication of Clairville Road. The existing 33-foot mapped right-of-way is not officially dedicated to the public. The city is proposing to widen the right-of-way by another 17 feet to obtain a 50-foot width east of the centerline of Clairville Road. This will allow for the construction of a turn lane into the industrial park and provide ample area for sidewalk,terrace trees and snow storage. Eventually, similar action will be taken on city- owned land on the west side of Clairville Road to obtain a 100-foot right-of-way. RECOMMENDATION/CONDITIONS Staff recommends approval of the granting of the various easements and the street right-of-way dedications of Compass Way,Transit Drive and Clairville Road as proposed.
