HomeMy WebLinkAbout09. 19-75 FEBRUARY 12, 2019 19-75 RESOLUTION (CARRIED 5-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AMENDMENT TO PROFESSIONAL ENGINEERING SERVICES AGREEMENT FOR CONSTRUCTION MATERIALS TESTING FOR THE 2018 CAPITAL IMPROVEMENTS PROGRAM /PROFESSIONAL SERVICE INDUSTRIES, INC. ($4,406.66) INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the City and Professional Service Industries (PSI) previously entered into a professional services agreement for construction materials testing; and WHEREAS, additional services are required to complete testing for a couple of CIP projects and it is most advantageous for the City to add these projects to the existing contract with PSI. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are authorized and directed pursuant to Section 12-16 of the Municipal Code to enter into an amended agreement with PSI and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the final agreement. BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated from: Acct. Gohde, Assistant Director of Public Works tW__-)J-U DATE: February 7, 2019 RE: Approve Amendment to Professional Services Agreement for Construction Materials Testing for the 2018 Capital Improvements Program (CIP) / Professional Service Industries, Inc. (PSI) ($4,406.66) BACKGROUND A Professional Engineering Services Agreement for construction materials testing services for the 2018 CIP with PSI was reported to the Common Council on February 22, 2018. Additional services are required to complete the testing for a couple of CIP projects. ANALYSIS The amendment includes work on one (1) site not included in the original agreement and performing additional testing at another site. The project not included in the original agreement is the Oshkosh Avenue Area Redevelopment Infrastructure Improvements. Additional testing was required to complete the relay of water main and laterals on Columbia Avenue, Roosevelt Avenue and Minerva Street. FISCAL IMPACT Staff has reviewed the amendment and the costs. The amount of this amendment is not to exceed $4,406.66. This will raise the total agreement amount to $78,994.16. These costs will be split among the Street Paving, Storm Water, Water, Sanitary Sewer, and Property Improvement CIP sections. Funding was budgeted in all five (5) sections of the 2018 CIP. RECOMMENDATIONS Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature, including engineering services, may be procured without the use of formal, sealed quotes. In accordance with Section 12-16 of the Code, I am hereby recommending the Common Council approve this professional services amendment. Approved: Ma`rZ A. Rohloff City Manager SMG/tlt I:\Engineering\ Density Testing\ 2018 \Mark R Memo -PSI CA 111_2-7-19.docx Page 1 of 1 AMENDMENT NO. 1 The CITY OF OSHKOSH, hereinafter referred to as CITY, and PROFESSIONAL SERVICE INDUSTRIES, INC., 608 North Stanton Street, Ripon, WI 54971-1182, hereinafter referred to as the CONSULTANT, entered into an agreement for CONSTRUCTION MATERIALS TESTING SERVICES FOR 2018 CAPITAL IMPROVEMENT PROJECTS on March 12, 2018. Paragraph C in ARTICLE XII. PAYMENT included the provision that costs for additional services shall be negotiated and set forth in a written amendment to this AGREEMENT executed by both parties prior to proceeding with the work covered under the subject amendment. THEREFORE, the CITY and the CONSULTANT agree to insert the following paragraph after the first paragraph in ARTICLE III. SCOPE OF WORK: The CONSULTANT shall provide the services described in the CONSULTANT's letter dated January 4, 2019 The CITY and the CONSULTANT further agree to insert the following bullet point after the first bullet point in Paragraph A of ARTICLE XII. PAYMENT: • Payment for Amendment No. 1 shall be a Time and Materials Sum not to exceed $4,406.66 (Four Thousand Four Hundred Six Dollars and Sixty Six Cents). All other terms contained within the March 12, 2018 agreement remain unchanged and in effect.
