PLAN COMMISSION STAFF REPORT FEBRUARY 5,2019 ITEM IV: AMEND FINAL PLAT—FOURTH ADDITION TO CASEY'S MEADOW SOUTH The Plan Commission previously approved this plat on 12118118 and after further discussion staff is requesting to amend that previous approval before the Plat is forwarded to Council for approval. GENERAL INFORMATION Applicant: City Administration Property Owners: Casey's Meadow, LLC,Thomas N. Rusch Action(s) Requested: Staff is requesting the Plan Commission to approve an amendment to the Fourth Addition to Casey's Meadow South that was approved by the Plan Commission on 12/18/18 with conditions. Specifically, staff is requesting to remove the proposed 20 foot midblock pedestrian crossing running between Casey Trail and Wyatt Way located on Lots 85, 86, 91, and 92. The pedestrian crossing is approximately 240 feet in length. Applicable Ordinance Provisions: Subdivision regulations are located within Section 30-441 of the City of Oshkosh Zoning Ordinance. Property Location and Background Information: The proposed plat is generally located north of Sawyer Creek, south of West 91h Avenue, east of Clairville Road and north of W.20th Avenue. The plat creates extensions of Casey Trail,Wyatt Way and Mockingbird Way and creates a new street, Sage Crossing with lots to be located on both sides of the proposed rights-of-way. The 11.485 acre plat is zoned Single Family Residence-5 District(SR-5). An overall preliminary 105 lot development and final plat(20 lots)was approved for this development in 2005 followed by the First Addition (12 lots) in 2008, Second Addition (24 lots)in 2012 and Third Addition(20 lots) in 2017. Single Family Residence West Vacant Land Extraterritorial Zoning(R-1ETZ) Comprehensive Plan Comprehensive Plan Land Use Recommendation Land Use 2040 Land Use Recommendation Li ht Densit Residential ANALYSIS It appears the proposed pedestrian way was placed on the subdivision plat in order to act as a midblock pedestrian crossing to access the future trail system to the south along Sawyer Creek due to the block being rather long. The pedestrian way would align with Sage Crossing which will likely continue to the north towards 91h Avenue as the areas to the north of Casey's Meadow are eventually developed. The proposed pedestrian way would serve as an alternative to either extending Sage Crossing through to Casey Trail as a street with sidewalks(staff thought this unnecessary given this is a local street system)or for pedestrians to walk to the east around the block to Cloe Jude Drive to Wyatt Way and to Sage Crossing. In further discussions at the city staff level,staff has raised concerns about future ongoing maintenance and reconstruction when needed. While the Parks Department accepts responsibility for maintaining that portion of the pedestrian way south of Casey Trail because that will serve as direct access to a future regional trail system along Sawyer Creek. The pedestrian way to the north is more of"convenience"that is a local benefit to residents within the subdivision. The City may have difficulty compelling the adjacent property owners to maintain(clear of snow)the pedestrian way unlike other sidewalks where a property may be assessed for that service. Additionally,at the point where the pedestrian way needs to be replaced there is no mechanism to assess adjacent property owners for a pedestrian way that is not a sidewalk so once the pedestrian way falls into disrepair there will be an expectation that the City will fix the problem. While a short 240 feet of pedestrian way isn't that expensive (approximately$14,000), these pedestrians ways around the City can start to add up. From a pedestrian circulation standpoint,eliminating the pedestrian way as proposed will not significantly alter a user's ability to access the regional trail. It simply adds about 1,000 feet to a person's journey if they are looking to use or come down Sage Crossing from the north. Anybody wishing to leave or access the regional trail system will link into a street and sidewalk network at Casey Trail and will be able circulate east, west(eventually), and north to Mockingbird Way if the mid-block crossing does not exist. In researching past plat approvals staff could not find any staff or Plan Commission recommendations for the proposed path,which should have come at the preliminary plat level. However,having a direct link to the regional trail south of Casey Trail has been a consistent recommendation and one that has been shown on previous plats. How this particular pedestrian way got added is unknown but if the developer wanted to install the path and maintain that they could form a Homeowners Association or create another legal mechanism to make the adjacent property owners care for the path.This could however diminish the value of those lots. The basic premise is that the City doesn't want to be in the position of maintaining and improving local pedestrian ways like the one proposed between Wyatt Way and Casey Trail and recommends its removal of a requirement of the final plat. RECOMMENDATION/CONDITIONS Staff recommends an amendment to the final plat for the Fourth Addition to Casey's Meadow South to eliminate the proposed 20 foot wide pedestrian way easement on lots 85, 86, 91, 92 connecting Wyatt Way with Casey Trail.
