PURPOSE: APPROVE OFFICIAL MAPPING FOR THE WIDENING OF
NORTH KOELLER STREET RIGHT-OF-WAY NORTH OF
OSHKOSH AVENUE
INITIATED BY: DEPARTMENT OF COMMUNITY DEVELOPMENT
PLAN COMMISSION RECOMMENDATION: Approved
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 30-
440 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO THE OFFICIAL MAP.
WHEREAS, a public hearing, after due and proper notice, was duly held before
the Plan Commission of the City of Oshkosh concerning the adoption of this amendment
to the Official Map of the City of Oshkosh, and the Plan Commission having duly
recommended the adoption of this Ordinance.
NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as
follows:
SECTION 1. That Section 30-440 of the Oshkosh Municipal Code pertaining to the
Official Map of the City of Oshkosh and its extraterritorial jurisdiction, is hereby
amended by officially mapping additional right-of-way on the east and west sides of
North Koeller Street, north of Oshkosh Avenue, per the attached Exhibit A and Exhibit
S, thereby making revisions to the 161h Ward official maps on file in the City of Oshkosh
Public Works Department.
SECTION 2. Immediately upon these amendments to the Official Map becoming
effective, the City Clerk shall file a certified copy of this Ordinance and Exhibit A and
Exhibit S with the Register of Deeds for Winnebago County showing that the City has
amended its official map; and the City of Oshkosh Public Works Department shall file a
copy of this Ordinance and the attached Exhibit A and Exhibit S with the 161h Ward

official maps on file in its office, indicating the official map of the City of Oshkosh was
amended by action of the Common Council on this date.
SECTION 3. This Ordinance shall be in full force and effect from and after its
passage and date of publication.
SECTION 4. Publication Notice. Please take notice that the City of Oshkosh
enacted Ordinance #19-59 APPROVE OFFICIAL MAPPING FOR THE WIDENING OF
NORTH KOELLER STREET RIGHT-OF-WAY NORTH OF OSHKOSH AVENUE on
January 22, 2019. This ordinance officially maps the widening of N. Koeller Street north
of Oshkosh Avenue. The full text of the Ordinance may be obtained at the Office of the
City Clerk, 215 Church Ave. and on the City's website at www.ci.oshkosh.wi.us. Clerk's

of Oshkosh Avenue (Plan Commission Recommends Approval)
BACKGROUND
The subject site consists of part of two parcels located on either side of N. Koeller Street, on the
north side of Oshkosh Avenue and south side of Rath Lane. The eastern parcel is a narrow
vacant lot and the western parcel is a commercial lot with an oil change garage and car wash.
The surrounding area consists of mostly low density mixed uses including single family and
commercial along Oshkosh Avenue with Lakeshore Park and the new Oshkosh Corporation
Headquarters to the north.
ANALYSIS
The City requests approval to officially map approximately 10 feet of additional right-of-way
(each side) on the east and west sides N. Koeller Street, north of Oshkosh Avenue to Rath Lane.
This request is the result of a recommendation that was made as part of a Traffic Impact Analysis
(TIA) that was conducted in anticipation of the Oshkosh Global Headquarters being built and
private properties along Oshkosh Avenue being redeveloped. The TIA includes detailed
recommendations on how the intersections and corridors should be constructed in order for
them to function properly with the increased traffic volume.
The purpose of the official mapping is to expand N. Koeller Street in order to add a dedicated
turn lane for southbound traffic on N. Koeller Street going west at the roundabout. This
dedicated turn lane is needed as the majority (over 80%) of Oshkosh Corporation employees
come and go from Interstate 41, N.Koeller Street or State Highway 21. Adding a dedicated turn
lane heading west will assist in moving the majority of Oshkosh Corporation employees
westward through the roundabout quicker. In addition to officially mapping the right-of-way
on the west side of N. Koeller Street for the dedicated turn lane, City staff recommends
additional right-of-way on the east side of N. Koeller Street to ensure there is enough right-of-
way to handle the traffic that Oshkosh Corporation is proposing. If additional development

occurs on the privately owned parcels to the east and Oshkosh Corporation expands, an

FISCAL IMPACT
Official mapping may result in the city acquiring all or part of the mapped area from the
property owners. The subject properties are located in TID # 35.
RECOMMENDATION
The Plan Commission recommended approval of the official mapping at its December 18, 2018
meeting.

GENERAL INFORMATION
Applicant/Owner: City of Oshkosh
Action(s) Requested:
The City of Oshkosh requests approval to officially map additional right-of-way on the east and
west sides of N. Koeller Street,north of Oshkosh Avenue.
Applicable Ordinance Provisions:
Section 62.23(6)(b) of the Wisconsin Statutes regulates official mapping by municipalities.
Section 2-52 of the Municipal Code and Article XII of the Zoning Ordinance designate a
function and duty of the Plan Commission to make recommendation on the establishment and
amendment to the City's Official Map.
Property Location and Background Information:
The subject site consists of part of two parcels located on either side of N. Koeller Street, on the

ANALYSIS
Official mapping is the process by which a municipality can designate or reserve areas for
specific public uses for future acquisition and development. Once officially mapped,those
areas are essentially treated as right-of-way from a setback perspective and no building permit
may be issued for new construction or expansion that does not conform to the location of the
official map unless otherwise authorized by the local legislative body. In Wisconsin,
municipalities may use official mapping to establish an official street network and future
streets,historic districts,parks and playgrounds,railroad right-of-way,public transit facilities,
and waterways.
The City requests approval to officially map additional right-of-way on the east and west sides
N. Koeller Street,north of Oshkosh Avenue to Rath Lane. The proposed additional right-of-

The Comprehensive Plan recommends the subject site suitable for commercial development.
Staff is of the opinion that the proposed mapping action is consistent with the Plan's
recommendation as it will provide for improved traffic flow for future commercial uses in the
area.
RECOMMENDATION/CONDITIONS

Planning staff recommends approval of the official map action as requested.
The Plan Commission approved of the official map action as requested. The following is the
Plan Commissions discussion on this item.
Mr. Slusarek presented the item,reviewed the site and surrounding area and discussed the
need for officially mapping a 10 ft. wide additional right-of-way on the east and west sides of N.
Koeller Street,north of Oshkosh Avenue. This request is the result of a recommendation that
was made as part of a Traffic Impact Analysis (TIA) that was conducted in anticipation of the
Oshkosh Global Headquarters being built and private properties along Oshkosh Avenue being
redeveloped. The purpose of the official mapping is to expand N. Koeller Street in order to add
a dedicated turn lane for southbound traffic on N.Koeller Street going west at the roundabout.

Mr. Burich commented that staff did meet with the property owner on the west site of the street
and notified him about the project.
Motion by Kiefer to approve the public hearing: official mapping for zvidening of North Koeller Street
right-of-zvay, north of Oshkosh Avenue.
Seconded by Mott. Motion carried 8-0.
