PURPOSE: AUTHORIZE THE DIRECTOR OF FINANCE TO ISSUE CITATIONS
INITIATED BY: CITY ADMINISTRATION
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 1-5.3(4)
(first unnumbered paragraph) OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO
ISSUANCE OF CITATIONS FOR VIOLATIONS OF ORDINANCES
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That the first unnumbered paragraph of section 1-5.3(4)of the Oshkosh
Municipal Code pertaining to issuance of citations for violation of ordinances is hereby
amended to read as follows:
(4) ISSUANCE OF CITATION. Law Enforcement Officer. Any law enforcement officer may
issue citations authorized by this municipal code. In addition, the following are hereby
designated as City officials who may issue citations with respect to ordinances directly
related to their official responsibilities: Finance Director, Fire Chief, Fire Inspector,
Building Inspector, Electrical Inspector, Weights and Measures Inspector, Plumbing
Inspector and Plumbing Supervisor, Housing Inspector, Sanitation Superintendent,
Director of Community Development, and Director of Public Works/City Engineer. In
addition, the above mentioned individuals may delegate, with the approval of the City
Manager, the authority to their assistants or other designee.
SECTION 2. This ordinance shall be in full force and effect from and after its
passage, and publication.

ISSUANCE OF CITATIONS FOR VIOLATIONS OF ORDINANCES) on January 22, 2019.
The ordinance authorizes the Director of Finance to issue citations for violations of
ordinances directly related to her/his official responsibilities,including for violation of room
tax permitting and reporting requirements.

BACKGROUND
The City of Oshkosh Municipal Code generally authorizes police officers and certain other city
officials to issue citations within the scope of their official duties.
ANALYSIS
The Finance Director has not been previously included in the list of officials authorized to write
citations. With the changes to the Room Tax provisions it was identified that citations may be a
possibility for persons or entities that do not comply with permitting or reporting requirements.
The proposed ordinance will permit the Finance Director to issue citations directly for violations
within her/his official duties.
FISCAL IMPACT
There is no anticipated fiscal impact related to this proposed ordinance.
RECOMMENDATION
Staff recommends that the Council adopt the proposed ordinance and authorize the Finance
Director to issue citations within her/his official responsibilities.
