HomeMy WebLinkAboutItem III PLAN COMMISSION STAFF REPORT DECEMBER 18,2018 ITEM III: FINAL PLAT-FOURTH ADDITION TO CASEY'S MEADOW SOUTH GENERAL INFORMATION Applicant: Chet Wesenberg Property Owners: Casey's Meadow, LLC, Thomas N.Rusch Action(s) Requested: The applicant is requesting approval of a final plat containing 40 single family lots and right-of-way identified as the Fourth Addition to Casey's Meadow South. The 11.485 acre plat is zoned Single Family Residence-5 District(SR-5). An overall preliminary 105 lot development and final plat(20 lots)was approved for this development in 2005 followed by the First Addition(12 lots) in 2008, Second Addition (24 lots) in 2012 and Third Addition(20 lots) in 2017. Applicable Ordinance Provisions: Subdivision regulations are located within Section 30-441 of the City of Oshkosh Zoning Ordinance. Property Location and Background Information: The proposed plat is generally located north of Sawyer Creek, south of West 9th Avenue, east of Clairville Road and north of W. 201h Avenue. The plat creates extensions of Casey Trail, Wyatt Way and Mockingbird Way and creates a new street, Sage Crossing with lots to be located on both sides of the proposed rights-of-way. Single Family Residence West Vacant Land Extraterritorial Zoning (R-1ETZ) Comprehensive Plan Comprehensive Plan Land Use Recommendation Land Use 2040 Land Use Recommendation I Light Density Residential ANALYSIS The owner is proposing to subdivide this area consistent with the previous preliminary plat approved by the City in 2005. The original preliminary plat involved 41.05 acres and 105 lots, of which 76 lots have been final platted to date. All lots meet or exceed minimum lot requirements for the SR-5 District and all lots front on a public street. The lot configurations differ slightly from the preliminary plat in regard to lot widths for the proposed parcels along Wyatt Way and Sage Crossing. These alterations are minor, the basic configuration is similar and the lots still meet minimum requirements of the SR-5 District(60 feet wide, 100 feet deep, and 7,200 square feet in area). Also, the plat extends to the southwest more than the preliminary plat resulting in nine additional lots over the preliminary plat. Staff does not have concerns with the additional lots as the layout follows the development's master plan which extends west to Clairville Road. The City's Comprehensive Land Use Plan 2040 identifies this area as appropriate for low density residential development and approval of this plat is consistent with the plan's recommendation. Temporary cul-de-sac easements have been placed at the west ends of Casey Trail,Wyatt Way and Mockingbird Way. This is to provide a turnaround area for emergency, Public Works and other large vehicles. As the subdivision develops to the west, the easements will be released as they are no longer needed. A terrace tree and street lighting plan has been submitted. The Department of Public Works and the Forestry and Electric Divisions will review to ensure it meets subdivision regulations. The developer has chosen to pay parkland dedication fees in lieu of land dedication which would have totaled 41,800 square feet of land area. The payment fee is$200 per lot at plat acceptance ($7,600 total) and an additional$200 per lot at building permit issuance. The Parks Department reviewed the proposed plat and indicated per the Rusch Park Master Plan (map attached), a trail connection to the subdivision is recommended somewhere along Lots 77 to 82. Staff is recommending the Municipal Access Easement between Lots 79 & 80, 85 &86 and 91 &92 be expanded to include Pedestrian Access. The developer shall be responsible for construction of a 10- foot wide pedestrian trail (3" asphalt over 8" base) centered on pedestrian easement between Lots 79 &80 and a 5-foot wide pedestrian trail(3" asphalt over 8" base) centered on pedestrian easement between 85 &86 and 91 &92 at time of public improvement installation. ITEMS OF CONCERN THAT NEED TO BE ADDRESSED: 1. Easement notes need to be updated. All Public Utility easements need to be renamed to Municipal Utility. All 12'Private Utility easements need to be renamed to 12'Public Utility easements. 2. An orphan substandard parcel will be created south of Lots 80 and 81 from part of Lot 3 of Certified Survey Map 4762. The area must be included in the plat and made into an Outlot or combined with Lots 80 and 81. 3. The parent parcels of the plat area involve two ownerships, Casey's Meadow, LLC and Thomas N. Rusch. All lands underlying the plat must be under one ownership. ITEM III—Final Plat—Fourth Addition to Casey's Meadow South 2 The Department of Public Works has reviewed the final plat and does not have any concerns with the general parcel configuration. Public Works did comment that the backs of Lots 85 &86 and 91 &92 should have a common property corner instead of the minor jog to accommodate the proposed pedestrian trail and is recommending the lots and corresponding easements be adjusted. The grading and drainage plan and erosion control plan have been submitted for review as well as engineering plans for utility and street construction. The Department of Public Works and City Attorney will work with the developer to enter into a developer's agreement for construction of public infrastructure and prepare all necessary easements. The Fire and Police Departments and Oshkosh Area School District have been notified of this request and have not expressed any concerns with being able to serve the additional housing units. RECOMMENDATION/CONDITIONS Staff recommends approval of the final plat for the Fourth Addition to Casey's Meadow South with the following conditions: 1. Orphaned parcel area south of Lots 80 &81 shall be include in plat and incorporated into said lots or made an outlot; 2. Revise all easement notes and indicators on plat: All Public Utility easements need to be renamed to Municipal Utility. All 12'Private Utility easements need to be renamed to 12'Public Utility easements; 3. Ownership of parent parcels underlying the plat shall be changed to one common ownership. 4. Modify municipal access easements between Lots 79 &80, 85 &86 and 91 &92 to include pedestrian access. 5. Modify the backs of Lots 85 &86 and 91 &92 to have one common property corner and adjust affected easements accordingly. 6. Developer to install 10-foot wide pedestrian trail(3" asphalt over 8" base) centered on pedestrian easement between Lots 79 &80, and a 5-foot wide pedestrian trail(3" asphalt over 8" base) centered on pedestrian easement between 85 &86 and 91 &92 at time of public improvement construction.
