HomeMy WebLinkAboutItem 7 - Historic Preservation OrdinanceTO: Landmarks Commission FROM: Steven Wiley, Staff Liaison DATE: December 511,, 2018 SUBJECT: Item 7: Historic Preservation Ordinance Revisions (Recent Demolition Issues), Permitting Process for Historic Properties 1.) Initiated by: Shirley Brabender Mattox, Chair -Oshkosh Landmarks Commission a.) The item is within the purview of the Commission per the Historic Preservation Ordinance. It involves the preservation ordinance and is a priority of the Commission. The Commission voted at the August 81h Landmarks meeting to table the cost analysis and potential grant while working on the Historic Preservation Plan. In light of the recent developments concerning the mural ordinance and murals, staff is proposing a potential ordinance amendment for the historic preservation ordinance that would address painting on historically unpainted masonry. This would still require public input sessions as part of the process. Properties in historic districts are flagged in the permitting software the City uses. Staff has had conversations with John Zarate, Chief Building Official, Darryn Burich, Director of Planning Services, and Allen Davis, Director of Community Development. Mr. Davis stated that staff would have to put together a list of potential scenarios where proposed work should be referred to the Commission for review, and before a new process is to be adopted, a public input component would have to occur to gauge the public's opinion on adding a Commission review step to the permitting process for historic properties. 2.) Is the item related to an Historic District/contributing, listed individually, Landmarked or eligible? The item will pertain to Historic Districts, individually listed properties, and Landmarked properties. 2a.) Does item conform with all Local, State, or other Ordinances, Statutes? Yes the item would conform with all applicable ordinances. The Historic Preservation Ordinance does and will continue to comply with the State Statutes. 2b.) Has the State Historical Society been notified or involved? Joe DeRose has been notified and has visited to discuss ordinance revisions. Daina Penkiunas has also been notified (regarding the demolition of historic properties). 2c.) Are other organizations or entities involved? Yes - Private property owners of at least one historic district will be involved. If you are unable to attend this meeting, it is important to notify Steven Wiley (920-236-5062) in case a quorum cannot be attained. 3.) Are Historic Tax Credits applicable for this item? Not at this time. 4.) Does this pertain to municipally -owned structures? Potentially, but the item pertains primarily to privately -owned properties. Any incentives would be for private property. 5.) What is the Commission priority # for this item? The Historic Preservation Ordinance Revisions are the #2 priority of the Commission. 5a.) Does the Commission have enough information for action(s)? The Commission has moved forward with the preservation ordinance but should have more information before approving a historic preservation grant program. The cost analysis has not been completed and more research is needed. Discussion Considerations 1.) More research or follow up on Item? Yes-commission/staff research and assistance. The Commissioners all received a copy of WI Act 317, a list of Landmark designated properties in Waukesha, and some information on different siding types. 2.) Evidence of "original"? Restore to what time period? 3.) Replacement Materials: accepted by State Historical society? The Commission discussed WI Act 317 and the provision in the new legislation that allows restoration work to use materials similar in appearance to the original materials. 4.) Consideration of 'undo hardship on ownersT Funding sources? The grant program and Landmarks discussions focused on potential hardships owners may face when undertaking restoration work on historic properties. 5.) Take actions? The Commission decided at the August 81h Landmarks meeting to table the grant and materials portion of this item and include these as goals in the Historic Preservation Plan. Once the plan is complete, the Commission could undertake the cost analysis for different siding types and finish creation of the grant program. 6.) Follow up? The Commission can revisit the grant and materials portion of this item after the completion of the historic preservation plan and should have the means to devote more time and dedication to it then. The Commission and staff can prioritize the preservation ordinance revisions and permitting process portion of the item. This workshop could be coordinated as part of the historic preservation plan development but would also gauge property owners' support for specific ordinance revisions. Such input is desired before staff revises the ordinance and permitting process for work proposed for historic properties. List of Potential Work for Commission Review Demolitions Windows / Doors — removal or replacement of existing Siding with materials different than existing Additions Entrances, Porches, Exterior Steps Soffits, Fascia, Exterior Trim — Alterations, removal, additions.
