COUNTY ROAD Y GENERAL INFORMATION Applicant/Owner: Winnebago County Action(s) Requested: The petitioner is seeking approval of a two -lot land division/certified survey map from one existing lot located at 601 W. County Road Y. Sizes of the proposed lots are as follows: Lot 1= 00.165 Acres Lot 2 = 94.875 Acres Applicable Ordinance Provisions: Land division criteria are located in Section 30-441 of the City's Subdivision Regulations. County Road Y is the location of several county facilities including the Winnebago County Sheriff's, Highway and Recycling Departments. Development of the property began in the early ITEM II— Land Division/CSAII-601 W. County Road Y 1990s with the recycling center, followed by the Highway Department and Sheriff's Department in 1995 and 2002, respectively. The applicant is proposing to divide off a small lot for a potential residential institutional use. Proposed Lot 1 is sized at 60 feet wide by 120 feet deep and 0.165 acres which meets the minimum size requirements in the Institutional Zone District. The lot is located approximately 1,500 feet west of Jackson Street. Access to Lot 1 is available via the driveway entrance for the County Highway Department. City water is available on County Road Y. Sanitary sewer is located on County Road Y, however, the pipe is a force main and connection to it is not allowed. Staff evaluated other options such as connecting to Jackson Street's sewer (1,600+ feet away) or a sewer located near the west line of the subject site (1,000+ feet away). Unfortunately, these options are probably not feasible due to the great lengths to these facilities. The last option is constructing either holding tanks or an on -site septic system. If the county were to construct a septic system, the proposed size of the lot may not be adequate and would need to be increased as well as meet state and county regulations for on -site sewerage systems. Proposed Lot 2 is approximately 1,667 feet by 2,545 feet and 94.875 acres in size, greatly meeting minimum size requirements of the Institutional District. There are currently no plans to expand or modify the existing uses on the site. Jackson Street (State Highway 76) is a Wisconsin Department of Transportation -controlled highway while County Road Y is a Winnebago County -controlled Highway. Generally, the city prefers to restrict access to arterial and collector streets, therefore staff is recommending placing access restrictions along Jackson Street and County Road Y along the entire frontage besides where exiting openings exist. County Road Y is identified as a collector -classed street per the city's Comprehensive Plan which recommends a 66-foot right-of-way (33' on both sides of the centerline). Currently, County Road Y has a variable right-of-way width with 33 feet on the western edge of Lot 2, expanding to over 37 feet at the eastern edge, therefore no additional right-of-way is required. Jackson Street, classified as a principal arterial exceeds the minimum 80-foot wide right-of-way recommendation. RECOMMENDATION/CONDITIONS Staff recommends approval of the two -lot land division/certified survey map at 601 W. County Road Y with the following conditions: 1. County owns approximately 296.81 acres of land at the intersection of Highway Y and Jackson (also known as Highway 76). That land currently is zoned as and used for institutional purposes. County seeks to subdivide a small parcel of that land. The subject parcel is located on and surrounded on all sides by this larger, County -owned plot of land. The parcel is approximately 10,000 square feet, located between the Sheriff's Department, Highway Department and Transfer station. The address of the portion sought to be subdivided is: 601 West County Road Y, Oshkosh, Wisconsin 54901. County submits as Exhibit A hereto a Certified Survey Map of the larger County -owned plot of land, also showing the location of the parcel County seeks to subdivide. County also has submitted an Application for a Conditional Use Permit, seeking permission to use this subdivided parcel as a residential plot. Location of Proposed Project: 601 West County Road Y, Oshkosh, Wisconsin 54901 Zoning Classification: County owns 296.81 acres of land zoned as and used for Institutional purposes. As set forth in County's Application for Conditional Use Permit filed with the city of Oshkosh earlier this week, County seeks to use a small parcel on that land for residential purposes. Reason for Division: Applicant proposes the parcel at issue be used as a residential plot for a County resident convicted of offenses pursuant to Wis. Stat. § 980 and deemed ready for release. Section 980 of the Wisconsin Statutes requires County to identify a suitable place of residence for this offender. This parcel meets the parameters set forth in § 980.08(4)(dm), returns the offender to his local community, and is close to law enforcement who can monitor the situation. Proposed Number of Plots: One Propose Lot Sizes (Minimum, Maximum, and Average): There is only one plot of land at issue. It is approximately 10,000 square feet in size. Acres in Parcels: The larger plot of land surrounding the parcel at issue is approximately 296.81 acres in size. The parcel sought to be subdivided from the larger plot of County -owned land is approximately 10,000 square feet. Proposed Proiect Type: County seeks to use the subdivided parcel as a residential site for a single resident. County intends to install a pre -manufactured housing structure on the parcel to house the resident. Applicant does not need nor intend to do any construction in order to make the parcel habitable as a residence, apart from establishing connections for necessary utilities. Current Use of the Property: The parcel County seeks to subdivide from its larger plot of land currently is unused. The surrounding County -owned land is used for institutional purposes and is occupied by Page 4 various institutional occupants, including the County,sheriffs department, highway department, and waste management. Significant Natural Amenities (slope, vegetation, large tree stands, etc.): As seen in Exhibit A, the subject parcel does not contain any significant natural amenities. In addition, the larger plot of land owned by County, which surrounds the subject parcel on all sides, also contains very few significant natural amenities. Floodplains, navigable streams, wetlands, and other Developmental Restrictions: There are no Developmental Restrictions of any kind that impact the proposed subdivision of the subject parcel. (See Exhibit A). While there are wetlands on the larger plot of County -owned land that surrounds the subject parcel, the wetlands are not contingent to the parcel at issue; the nearest mapped wetland is located approximately 450 feet from the subject parcel. To County's knowledge, there are no other developmental restrictions even on the larger, County -owned land that surrounds the parcel it seeks to subdivide. Variances —List and explain any requested variances from the Subdivision Regulations: At this time, Applicant does not anticipate requesting any variances from the Subdivision Regulations.
