Acct No. 0323-0740-7216-04910 Property/Equipment Fund- Land Improvement TO: Honorable Mayor and Members of the Common Council FROM: Allen Davis, Community Development Director DATE: November 20, 2018 RE: Approve Professional Service Agreement with AECOM for Design, Engineering, Permitting and Construction documentation - Lakeshore Riverwalk ($176,845) BACKGROUND The City is required to complete construction of the lakeshore riverwalk from the Tribal Heritage Trail east to Punhoqua Street in 2019 as part of the Oshkosh Corporation Global Headquarters Development Agreement. The Community Development Department solicited a Request for Qualifications (RFQ) for this project earlier this fall, and received five Statements of Qualifications from Wisconsin engineering firms. Based on the review of the qualifications of the firms and selection criteria, City staff is recommending the award of the professional services agreement to AECOM. The Wisconsin Department of Natural Resources (WisDNR) has tentatively granted the City of Oshkosh about $793,000 which should fund about half the cost of this riverwalk segment. The balance of the project will be funded by a $600,000 Oshkosh Corporation donation and $200,000 in land sales proceeds from Lakeshore. ANALYSIS The proposed Agreement is based on an hourly contract, not to exceed $176,845. Specific elements of the services to be performed for the project are: • Final Construction drawings and Plan Specifications • Permitting - WisDNR and Army Corps of Engineers, as required. • Bidding • Construction survey stake out • Construction observation/documentation • Civil/Structural engineering, as needed • Environmental/geotechnical engineering, as needed City Hall, 215 Church Avenue P.O. It is anticipated that the riverwalk construction will be bid in late winter, construction would start in the spring, and construction will be complete east to Punhoqua Street in 2019. The timing for design, bidding and construction is critical in order to stay on schedule according to the Oshkosh Corporation Global Headquarters Development Agreement. FINANCIAL ANALYSIS The hourly rates charged by AECOM are not the highest, nor are the fees the lowest. The cost of these professional services was included in the Lakeshore riverwalk project originally listed in the adopted 2019 Capital Improvement Plan for the Oshkosh Corporation Global Headquarters. The design and permitting fees are reimbursable expenses for WisDNR grant administration purposes. (AECOM) is pleased to present the City of Oshkosh (City) with the following proposal. We understand that AECOM was selected to provide this proposal based on a City staff review of our Statement of Qualifications (SOQ) for Professional Services for the Lakeshore Riverwalk Project — Design, Engineering, Permitting and Construction Documentation/Management and other SOQs that were submitted by several consultants on October 15, 2018. This document presents our understanding of the project and information regarding the following: • AECOM's Background and Oshkosh Presence • Project and Community Understanding • Experience and Project Examples • Permitting Experience • Grant Requirements and Administration Experience • Project Approach and Proposed Scope of Work • Key Project Staff and Project Fees Background and OshkoshPresence AECOM is a worldwide, multi -disciplined engineering and consulting services firm that serves municipal, industrial and institutional clients nationally and worldwide. AECOM has maintained a strong and growing office in Oshkosh, Wisconsin since 1976; AECOM is proud to have served the City on multiple fronts over the past 42 years. The Oshkosh office is currently comprised of 20 full time -staff that provide construction management, civil engineering, geotechnical engineering, environmental engineering and environmental compliance services. More than 200 additional staff in our Milwaukee, Green Bay, Middleton and Stevens Point, Wisconsin offices can be called upon to support the AECOM Oshkosh team. Several members of our team grew up in the area and still reside within the City of Oshkosh. For over 10 years, our Oshkosh office has been located on North Main Street, within walking distance of Oshkosh City Hall. This centralized location within the City allows our team to provide rapid response to projects, including attending meetings at City Hall. AECOM specializes in design, bidding assistance, construction documentation, environmental services and material testing. By providing these services locally, the City receives: • A streamlined, cost-effective approach; • Consistent design goal understanding and implementation; • Rapid response to unanticipated project conditions; and • Elimination of multiple contracts and service providers on projects. Our high level of familiarity and understanding combined with our office location, skill of our local and Wisconsin - based staff, extensive project experience and site knowledge is instrumental in the success of the projects. AECOM brings additional value by reviewing multiple City projects' objectives and site knowledge of the area to facilitate reuse of materials, project symmetry and disposal of excess materials in an effort to reduce costs and provide cost savings and benefits to the City. An example of a past success was AECOM facilitating the beneficial reuse of the concrete and masonry material from the demolition of the former Buckstaff facility. The beneficial reuse of this material as base course provided a substantial savings on disposal of this material and additional savings on the use of the material in lieu of imported material on other City construction projects. This material was successfully utilized on the South Shore Riverwalk project. AECOM has successfully worked with City survey crews on multiple past projects to obtain the required topographic information to complete design and stake -out for construction. This work is critical for the design process and is important to collect prior to winter conditions. • Have the Subsurface Geotechnical Evaluation completed by the drilling firm selected for the 2019 CIP Street Improvement Program. By using a firm already under City contract, time will be saved at the early stages of the project. • Transport all excess topsoil/fill to the Kienast-Paulus Quarry site to be incorporated into the future Landfill Gas System project. The Landfill Gas System project will require a substantial amount of imported topsoil. Excess topsoil or fill from the Lakeshore Riverwalk project will likely save the cost of disposal and purchase of topsoil related to the two projects. • Combine this project with the proposed Rainbow Park Multimodal trail project as a phased approach. This will save on duplicate bidding documents and efforts. In addition, the expanded size of the project may attract additional bidders. We anticipate that both projects will have grant bidding requirements. • Combine this project with the proposed baseball diamond reconstruction on the corner of Rainbow Drive and Punhoqua Street. The baseball diamond reconstruction requires filling and regrading prior to construction of the new infield. There are potential cost savings related to combining the potential regulatory permits and site grading, as all the equipment required will already be mobilized for construction of the Riverwalk. These ideas are just examples of the thought process AECOM's staff invests into all of the City's projects. The project type, timing, funding and grant requirements all dictate the possibility or effectiveness of any of the above ideas. The proposed Lakeshore Riverwalk segment will be positioned along the northern property boundary of the former, municipally owned, Lakeshore Golf Course site. Oshkosh Corporation recently acquired a portion of the former Lakeshore Golf Course for development as their new World Headquarters campus. The property has been divided into two (2) separate lots. The City will retain approximately 65.56 acres of the original 98.37 acre lot, with the remaining 32.81 acre area to be used by Oshkosh Corporation for their Global Corporate Headquarters. The City - retained portion of the site will be redeveloped into a new City park. There are mapped wetlands in various locations on the site and along the entire border of the Fox River. Some of the former golf course ponds, along with a new pond, will be utilized for the new park, street improvements, and Oshkosh Corporation development storm water management. The current plan for storm water management is to discharge overland to the Fox River. This change in use of the property has been a controversial topic for the City. The development of the Lakeshore Riverwalk and park is critical to meet the site redevelopment plan, the Oshkosh Corporation developer's agreement, and public acceptance. Included in this document is AECOM's recommendation regarding community outreach. A presentation via a work shop with the Advisory Park Board, Oshkosh Plan Commission and Common Council is recommended. The workshop should occur in the planning and design phase of the project. This would allow for consideration of any comments and ideas received from the City boards and community, and help build project consensus and demonstrate a willingness to consider public input on the project. We have included a summary of likely challenges for the project and AECOM's proposed approach in the Project Approach and Scope of Work section. Examples of our similar project experience are included in the attachments. The City of Manitowoc, Wisconsin and City of Watel experiences with these types of projects outside of the City of Oshkosh, Wisconsin. The Oshkosh AECOM team has extensive experience in all aspects of the already completed segments of the Riverwalk system in Oshkosh. AECOM has been working with the City since 2005 in developing, designing, permitting, providing grant assistance, and construction management of the Riverwalk system. Our Oshkosh team has been a consistent part of all of these projects. We have attached a brief summary description of the Oshkosh Riverwalk system we have been involved with. All of the Riverwalk projects have met grant reimbursement criteria which lead to 100% maximization of grant funds. We have project specific experience with the Lakeshore Riverwalk project. AECOM previously assisted the City in developing several concept plans and opinions of probable cost during the development of the overall site plan. The final concept plan was refined into 30% design plans and opinion of probable cost, and included in the Stewardship Grant application. During the completion of this work, AECOM staff have visited the site on several occasions to document the existing vegetation and storm water flow patterns. AECOM has completed preliminary discussions with Winnebago County and the Wisconsin Department of Transportation (WisDOT) regarding the easement required for the proposed bridge connection to the Heritage Trail Parkway. r AECOM has a very good relationship with the Wisconsin Department of Natural Resources (WDNR) (Storm water, ERRP, VPLE and Solid Waste Groups), the U.S. Army Corps of Engineers (USCOE), and the U.S. Coast Guard (USCG). We have assisted in obtaining numerous permits from all the regulatory agencies in and around the Oshkosh area related to new public and private developments, parking lot reconstructions, and Riverwalk's. Specifically for the Oshkosh Riverwalk system, we have worked closely with the various regulatory agencies in permitting the Riverwalk system. Our team has been instrumental in securing multiple WPDES General Permits, Chapter 30 and General permits from the WDNR, the USCOE, and one permit from the USCG for construction of the Riverwalk system. Each permit has been complex and has varied due to existing conditions, a variety of Riverwalk designs and proposed shoreline treatments or docks, and by the various regulatory agencies claim of ultimate jurisdiction. The permits we have successfully obtained have allowed approximately 1.5 miles of continuous Riverwalk pathway with construction of a bathroom, parking lot, bridge over navigable water way, dredging of the Fox River, addition and/or reconstruction of multiple storm sewer outfalls, construction of docks, installation of sheet pile sea walls, rip -rap revetments, fishing pier reconstruction, construction of board walk over wetlands, and coir -log shoreline improvements. We have site specific experience dealing with the wetlands on the former golf course as AECOM secured the disturbance of wetlands permits from the WDNR and USCOE for the construction of the Mary Jewell Sanitary Lift Station and Park Shelter which was completed in September, 2018. We anticipate the Lakeshore Riverwalk project to require the following permits: WPDES Discharge Permit (Notice of Intent to disturb more than one acre) KAPROPOSAL\City of Oshkosh\OPP-786325_Lakeshore Pedestrian Trail\Proposal for AECOM Design & CM\OPP-786325_Lakeshore Riverwalk Design & CM Proposal.docx 3 Proposal for Design, Engineerng, Permitting and Construction Documentation and Management Lakeshore Riverwalk Project City of Oshkosh, Wisocnsin As has been successfully used on previously Riverwalk project segments, AECOM anticipates that the following items or activities will be developed for the bidding process: Project Manual (to be uploaded onto the Quest System for distribution to interested bidders). This will contain: — Bidding and Contract Documents (EJCDC, Davis Bacon Wage Standards (grant requirement) and City Standard Specifications will be utilized). Technical Specifications. Bid Form. Pre -Bid Meeting (Recommend because of the need to express the construction project challenges to bidders) — Prepare a draft bid invitation, which the City will publish as an advertisement for bids. — Answer Contractor questions during bidding. — Prepare Addendum, if needed. — Prepare meeting agenda and minutes. Review bidding results and provide a Contractor selection recommendation via email. Deliverables: 95% bidding documents will be provided in electronic format to the City for review. 100% Project bidding documents consisting of one (1) plan set and project manual will be provided in electronic format for upload to Quest. AECOM will provide a part-time Resident Project Representative (RPR) services. Our budget assumes a construction time frame of 16 weeks. AECOM will provide a RPR and on-site testing staff as -needed to document construction. Field and laboratory testing will be provided as necessary to document compliance or noncompliance with project plans and specifications. In addition, we will work with the City and contractor on contract administration issues. A summary of tasks is provided below AECOM's past experience with construction documentation/management of Riverwalk projects indicate that the following services are needed to successfully complete the project and maintain Grant reimbursement eligibility: • Provide as needed or part-time Resident Project Representative (RPR) services during construction events as project requirements dictate to evaluate and document compliance with the Construction Documents. • Provide on-site material testing staff as -needed to document construction and compliance or noncompliance with project plans and specifications. • Coordinate with survey crews to provide stakeout locations and cut sheets for Contractor's use during construction. • Review contractor's progress schedule, schedule of submittals/submissions, and schedule of values prepared by contractor, and consult with the City concerning their appropriateness. • Review contractor submittals and material samples for conformance with contract documents. • Maintain correspondence files, reports of job conferences and meetings, shop drawings and sample submissions, reproductions or original contract documents including all addenda, change orders, field orders, and additional drawings issued subsequent to the execution of the contract. • Maintain reports for the construction contractor activities; weather conditions when on the job site; data relative to questions of extras or deductions; list of visiting officials, representatives of manufacturers, fabricators, suppliers and distributors; daily activities; decisions; observations in general; and specific observations in more detail as in the case of observing test procedures. Provide vehicles, necessary equipment, and material for inspection. Conduct a final inspection in the company of the City and contractor, and prepare a final list of items to be completed or corrected. Provide an As -Built Construction Documentation as -built surveyed data. Deliverables: AECOM will provide As -Built Record Drawings for the project. One hard copy and electronic copy. AECOM will prepare graphics, construction cost estimates and review as required to assist the City in administering the grant. The bid cost summary will be broken into grant eligible components. Project cost recording will be maintained to follow grant reimbursement submittal requirements. We will work with City staff and the Contractor to obtain the required documentation of construction costs to be submitted to the grant regulatory agency. AECOM will notify City staff on the Contractor's anticipated work schedule including subcontractors in an effort to assist the City with sufficient notice to complete the required on-site grant wage rate interviews. A budgetary allowance is included for layout work associated with walkway alignments, grading and electrical features. We have included six (6) 8 -hour trips to the site in the budget, along with survey data set up, associated truck and equipment rental. Please note if the construction schedule changes, AECOM reserves the right to submit an amendment request for consideration to increase or decrease the budget based on the actual Construction Schedule. As always, AECOM will only bill for actual time incurred. Deliverables: As -Built Record Plan Set prepared from site observations, survey and contractor's red -lined set. The following highlights challenges (C) anticipated to be encountered through the duration of the project and AECOM's Approach (A). (C) The schedule is anticipated to include two separate construction phases to be in compliance with the developer's agreement with Oshkosh Corporation. The main hurdle is working in conjunction with the Oshkosh Corporation facility that is currently being constructed with site access and completion of the Riverwalk dates as the main topics of concern. (A) AECOM proposes to work closely with City and Oshkosh Corporation staff to minimize the impact to the construction of the Oshkosh Corporation facility. The construction schedule and site access will be reviewed, negotiated, and approved by all stake holders prior to commencement of the project. The ultimate goal is to complete the entire Lakeshore Riverwalk construction by October 1, 2019 with the initial phase by July 1, 2019; We understand these dates are critical based on the developer's agreement with Oshkosh Corporation. In addition, AECOM intends to prepare a detailed schedule of milestones or critical path items, which will layout a pathway for a successful project completed on time. (C) The permit process with WDNR and USCOE can take a considerable amount of time. A minimum of 30-45 days should be anticipated for a review time after submittal to the regulatory agencies. K:\PROPOSAL\City of Oshkosh\OPP-786325_Lakeshore Pedestrian Trail\Proposal for AECOM Design & CM\OPP-786325_Lakeshore Riverwalk Design & CM Proposal.docx 7 Proposal for Design, Engineerng, Permitting and Construction Documentation and Management Lakeshore Riverwalk Project City of Oshkosh, Wisocnsin (A) Based on our extensive Riverwalk experience we propose to meet with the regulatory agencies early in the project at the site to discuss the project and verify any concerns they may have with permitting the project. We will discuss solutions and modify the concept plan accordingly in an attempt to expedite the permit review process. (C) The Lakeshore Riverwalk construction access will likely by limited to the east end of the project. The west end of the project is limited by the HWY 41 corridor drainage ditch and an extended landscaped area from the parking lot of the La Quinta Inn & Suites to the pathway location. In addition, a premanufactured bridge is anticipated to be installed to connect to the Heritage Parkway Trail. This bridge will likely be pre -constructed in one piece and require semi -truck access for delivery. (A) A possible solution is to allow construction of a temporary access road on the west end of the project to facilitate pathway and bridge construction. This access road could eventually be converted into an extension of the lake shore path as part of the development of the new parkland area. In addition, this access point should reduce the amount of construction vehicles on the east end of the project that may interfere with the Oshkosh Corporation facility construction. Retaining Upland Trees and Shore Line Vegetation (C) The tree and vegetation growth along the anticipated pathway is well established along both the shoreline and immediately upland. (A) We propose to minimize any tree and vegetation impacts by adjusting the location of the pathway to avoid as much as possible. Possible relocation of trees maybe considered also as an option. We do not anticipate improvement to vegetation and shoreline along the Lake shore, with the exception of normal maintenance activities that have been previously completed by City staff during the former golf course operation. (C) The redevelopment of the former Lakeshore Golf Course is very controversial. We anticipate the location and aesthetics of the Lakeshore Riverwalk and park development will be highly scrutinized and commented on. (A) We propose a work shop to include the Advisory Parks Board, Plan Commission and Common Council members be considered during the design phase of the project in an attempt to build consensus on the final design and aesthetics. The more stakeholder input we solicit will likely generate a more positive opinion of the final project. (A) We propose to avoid wetland disturbance by positioning the Lakeshore Riverwalk a minimum of 10 feet upland of the wetlands. This will avoid impacting the wetland area and the necessity of obtaining WDNR and USCOE wetland disturbance permits. A possible design element is to provide an elevated boardwalk viewing area to allow access to the Lake shore. This use of elevated boardwalk over wetland areas to avoid disturbance approach will likely be approved by the WDNR and USCOE. We successfully used this approach on the recently completed South Shore Riverwalk section. There are also wetlands in various locations on the site; therefore, we also highly recommend the WDNR and USCOE be included in the initial design phase of the project in an effort to identify any concerns they may have for the project. This approach has been highly successful in identifying regulatory concerns and possible solutions on all previous Riverwalk projects. (C) Coordinating with WisDOT and WDNR to gain permission to connect to Tribal Heritage Crossing Trail. (A) AECOM is aware of initial discussions with Winnebago Count to verify WisDOT ownership of the trail. In addition, we anticipate that the WDNR may require permission or a permit to connect the pathway. Our approach will be to verify ownership and communicate the necessary information to facilitate the permit. At a minimum, we anticipate a Work in Right-of-way permit to be required.
