BACKGROUND INFORMATIONANALYSIS
The site located udthe southwest comer otOhio Street and VV. 3rdAuxsnuc
currently contains anauto fueling station with convenience store and associated improvements
primarily fronting onOhio Street. Iothe west, located mzthe same parcel, isunapproximately
4.200square foot storage building with VV.3'aAvenue frontage. Mrapplicant i*proposing to
divide the lot into two lots toseparate the existing uses.

Proposed Lot 1 is sized at 0.351 acres and contains the existing storage building. besides the
building, the majority of the lot is covered by off-street parking area and driveway.
Proposed Lot 2, sized at 0.502 acres is located at the corner of Ohio Street and W. 3rd Avenue and
contains the fuel station and convenience store. Similar to Lot 1, Lot 2 is almost entirely paved
with the exception of some landscaped areas along Ohio Street and the south lot line.
Both proposed lots meet minimum dimensional requirements of the Urban Mixed -Use (UMU)
District.
The newly created parcels will result in a zero -foot setback of the existing off-street parking area.
The UMU District allows either a 0-foot or five-foot setback for parking areas. The applicant has
the option of creating a cross -access easement for the proposed parcels to maintain the existing
pavement, otherwise five feet of pavement on both sides of the new common lot line will need to
be removed and restored/landscaped per code.
A number of features are missing from the Certified Survey Map (CSM) including paved areas,
structures, locations of underground storage tanks and utilities. These items will be required on
the final CSM prior to final city approval.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the two -lot land division/certified survey map at 305 Ohio Street
with the following conditions:
1. Cross access easement shall be provided for both lots, otherwise five feet of pavement on
both sides of the new common lot line shall be removed and restored/landscaped;
2. All structures, including but not limited to paved areas, canopy, underground storage
tanks and utilities shall be placed on the final certified survey map.
