HomeMy WebLinkAbout22. 18-560 NOVEMBER 14, 2018 18-560 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE TRANSFER OF JURISDICTION AND MAINTENANCE OF PORTIONS OF THREE SEPARATE COUNTY HIGHWAYS FROM WINNEBAGO COUNTY INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, Winnebago County has adopted a resolution transferring jurisdiction and maintenance of County Highway "I" (Oregon Street) from Waukau Avenue to 241h Street, County Highway "K" (West 201h Avenue) from South Park Avenue to Oakwood Road, and County Highway"E" (Witzel Avenue) from Koeller Road to Westhaven Drive from Winnebago County to the City of Oshkosh; and WHEREAS, the City of Oshkosh must pass a resolution accepting jurisdiction and the Wisconsin Department of Transportation must record the transfer to complete the transfer of jurisdiction of these segments of highway to the City of Oshkosh. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the City of Oshkosh hereby accepts jurisdiction of County Highway "I" (Oregon Street) from Waukau Avenue to 241h Street, County Highway "K" (West 201h Avenue) from South Park Avenue to Oakwood Road, and County Highway "E" (Witzel Avenue) from Koeller Road to Westhaven Drive from Winnebago County. BE IT FURTHER RESOLVED that the appropriate city officials and staff shall have the authority to take all necessary actions to complete transfer of jurisdiction to the City of Oshkosh including but not limited to signing and submitting any documentation required by the State of Wisconsin to accomplish the transfer. City of� Oshkosh MEMORANDUM TO: Honorable Mayor and Members of the o on Council FROM: James Rabe, Director of Public Work DATE: November 8, 2018 RE: Approve Transfer of Jurisdiction and Maintenance of Portions of Three Separate County Highways from Winnebago County BACKGROUND As the City of Oshkosh has continued to expand, portions of the County Trunk Highway (CTH) system have become completely surrounded by parcels that are within the City of Oshkosh corporate limits. Over the years, Winnebago County has reconstructed these CTH's to conform to urban requirements. Among other items, these urban requirements include concrete streets with curb and gutter, storm sewer, and sidewalks. The Winnebago County Highway Department is not well situated to maintain urban street sections. The vast majority of CTH's within the Highway Department's area of responsibility are asphalt rural section roads, with shoulders and ditches. State of Wisconsin Statute §83.025 enables counties and local municipalities to mutually agree to transfer jurisdiction of roadways. The governing body of both entities must pass a resolution authorizing the transfer of jurisdiction of the roadways. After both governing bodies authorize the transfer, the County Highway Commissioner then prepares the appropriate paperwork to submit to the Wisconsin Department of Transportation to approve the transfer. The three (3) CTH segments in question for this jurisdictional transfer are: • CTH I (Oregon Street) between West 24th Avenue and West Waukau Avenue, approximately 4,000'. • CTH K (West 201h Avenue) between West South Park Avenue and South Oakwood Road, approximately 7,600'. • CTH E (Witzel Avenue) between South Koeller Street and South Westhaven Drive, approximately 3,600'. 1:\ Engineering\Tracy Taylor\Memos to Mayor & Common Council\2018\ Winnebago Co Jurisdictional Transfer\ Winnebago Co Jurisdiction Transfer_11-8-18.docx Page 1 of 2 ANALYSIS These CTH segments are completely within the City of Oshkosh corporate limits. Bringing these streets under the jurisdiction of the City of Oshkosh will help reduce confusion on the part of residents, developers, and private utility companies. Currently, individuals performing work come through the City Site Plan Review Process, but then must also obtain permit approval from the Winnebago County Highway Department for work within the right-of-way adjacent to their property. Bringing these segments of street under the jurisdiction of the City of Oshkosh will reduce this confusion, and reduce the number of entities that the development community will need to coordinate with. Additionally, since all adjacent properties are now within the City of Oshkosh, the City's Special Assessment Policy would apply to all adjacent properties for any street reconstruction work that would occur in the future. There is currently no street reconstruction work planned for West 201h Avenue and Witzel Avenue. Oregon Street is planned for reconstruction as far south as the Glatz Creek Bridge, just south of West 25th Avenue. Beyond that, the sanitary sewer interceptor project will patch the street. FISCAL IMPACT The fiscal impact of this jurisdictional transfer will be minimal. State of Wisconsin Statute §83.025 (2) requires local municipalities to be responsible for construction and maintenance costs of CTH's that are of a greater width within the local municipality than the CTH has outside the local municipality. Since these portions of CTH being transferred are all four -lane roads, the City has already assumed much of the maintenance responsibilities for these segments of streets, without them being considered a part of our street mileage report with the Wisconsin Department of Transportation. RECOMMENDATIONS I recommend approving this resolution authorizing the jurisdictional transfer of these portions of CTH from Winnebago County to the City of Oshkosh. Approved: Mark A. Rohloff City Manager JER/tlt 1:\ Engineering\Tracy Taylor\Memos to Mayor & Common Council\2018\ Winnebago Co Jurisdictional Page 2 Of 2 Transfer\ Winnebago Co Jurisdiction Transfer 11-8-18.docx 1 075-102018 � ED PE �OTE Va it 2 RESOLUTION: Authorize Transfer of Jurisdiction and Maintenance of Segments of Three 3 Separate County Highways to the City of Oshkosh 4 5 6 TO THE WINNEBAGO COUNTY BOARD OF SUPERVISORS: 7 WHEREAS, the Winnebago County Highway Department has determined that the public interest is best 8 served by transferring jurisdiction and maintenance of County Highway "I" from Waukau Avenue to 24th Street, 9 County Highway "K" from South Park Avenue to Oakwood Road, and County Highway "E" from Koeller Road to 10 Westhaven Drive from Winnebago County to the City of Oshkosh; and 11 WHEREAS, the City of Oshkosh must pass a resolution accepting jurisdiction of the aforementioned 12 roadway segments; and 13 WHEREAS, the Wisconsin Department of Transportation must record the jurisdictional transfers in the state 14 records; and 15 WHEREAS, §83.025, Wis Stats, enables Winnebago County and the City of Oshkosh to enter into a 16 jurisdictional transfer agreement, thereby facilitating the changes in the highway system. 17 18 NOW, THEREFORE, BE IT RESOLVED by the Winnebago County Board of Supervisors that it hereby 19 approves transferring jurisdiction and maintenance of the roadway segments described below from Winnebago 20 County to the City of Oshkosh: 21 1. An existing segment of County Highway "I" between Waukau Avenue and 241h Street, a distance of 4,000 feet; 22 2. An existing segment of County Highway "K" between South Park Avenue and Oakwood Road, a distance of 23 7,600 feet; 24 3.
