A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 30-32
OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO ZONING DISTRICTS.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 30-32 of the Oshkosh Municipal Code pertaining to
Zoning Districts and the map therein described is hereby amended by changing the district
character of the described property, Outlot 1 & 2 of Certified Survey Map 7398 from
Institutional (I) to Corporate Business Park with Planned Development (CPS-PD)
SECTION 2. This Ordinance shall be in full force and effect from and after its
passage and publication.
ALL OF OUTLOT 1 & 2 OF CSM 7398 AS RECORDED IN THE REGISTER OF DEEDS
OFFICE AS DOCUMENT NUMBER 1774474 ALL IN THE 16TH WARD, CITY OF
OSHKOSH, WINNEBAGO COUNTY, WISCONSIN.
SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted
Ordinance #18-533 APPROVE ZONE CHANGE FROM INSTITUTIONAL (I) TO
CORPORATE BUSINESS PARK WITH PLANNED DEVELOPMENT (CPS-PD);OUTLOT

on October 23, 2018. This ordinance changes the zoning of Outlot 1 & 2 of CSM 7398 from

Approval)
BACKGROUND
The approximate 1.14 acre subject site consists of two parcels which were created during the
dedication of the N. Koeller St. extension right-of-way. Outlot 1 is sized at 0.83 acres and was
recently disposed to H2Oshkosh Ave, LLC to the south. The outlot will be incorporated into a
new lot via an upcoming Certified Survey May (CSM). Outlot 2 is sized at 0.31 acres and is
located west of Outlot 1. The city currently owns Outlot 2 and has no immediate plans for it.
The surrounding area consists primarily of parkland to the north and west across the N. Koeller
St. extension right-of-way, proposed commercial development to the south and the recent N.
Westfield St. extension to the east. The 10 and 20 year land use recommendations designates
this area as Park, Recreation and Open Space; however, this parcel is adjacent to existing
Corporate Business Park with a Planned Development Overlay (CBP-PD) parcels which
contains proposed commercial development. The comprehensive land use map
recommendations are a general representation of land use patterns and are not intended to be
parcel specific like zoning. The extended zoning will be consistent with adjacent land uses.
ANALYSIS
The petitioner is requesting a rezone from the current Institutional (I) designation to the CBP-
PD designation. This rezone creates consistency with the zoning of the adjacent properties to
the southeast along Oshkosh Avenue. The adjacent property owner was approved for a General
Development Plan at the March 13, 2018 Common Council meeting. At the city's request, the
property owner dedicated 24 feet of additional right-of-way along Oshkosh Avenue and 80 feet
of right-of-way for the extension of N. Westfield Street. This is 21 additional feet for Oshkosh
Avenue and 20 additional feet for N. Westfield Street above and beyond the normal dedication
requirements. It was agreed upon that the city would dispose of Outlot 1 to the property owner

to the south as a "land swap" for the additional right-of-way dedications. The land swap did
occur and Outlot 1 will be incorporated into a new CSM to create two new parcels along

Municipal Golf course and would not be suitable for development due to its irregular shape. It
is a sound planning principal to zone the parcel the same as the adjacent developable land. In
doing so, more land will be available for redevelopment of the parcels along Oshkosh Avenue.
FISCAL IMPACT
Changing the zoning will help to facilitate commercial redevelopment of the site which will add
to value in TID # 35.
RECOMMENDATION
The Plan Commission recommended approval of the zone change at its October 2, 2018 meeting.

The petitioner is requesting a rezoning of Outlots 1 and 2 of Certified Survey Map (CSM) 7398,
generally located north of Oshkosh Avenue, and south of the former Lakeshore Golf Course, from
their current designations of Institutional (I) to the proposed designation of Corporate Business
Park District with a Planned Development Overlay (CBP-PD).
Applicable Ordinance Provisions:
The Zoning Ordinance does not establish criteria relative to appropriateness of changing zoning
from one classification to another but relies on the Comprehensive Plan and good planning
principles.
Property Location and Type:
The approximate 1.14 acre subject site consists of two parcels which were created during the
dedication of the N. Koeller St. extension right-of-way. Outlot 1 is sized at 0.83 acres and was
recently disposed to H2Oshkosh Ave, LLC to the south. The outlot will be incorporated into a new

zoning. Therefore, staff is recommending that the zoning be extended to maintain consistency
with adjacent land uses. Staff will be updating the comprehensive land use recommendations
for this area as part of the ongoing Comprehensive Plan update.

ANALYSIS

Map 7398 as requested.

The Plan Commission approved of the zone change as requested. The following is the Plan
Commission's discussion on this item.
Mr. Nau presented the item and reviewed the site and surrounding area. The petitioner is
requesting a rezone from the current Institutional (I) designation to the Corporate Business Park
with a Plan Development Overlay (CBP-PD) designation. This rezone creates consistency with
the zoning of the adjacent properties to the southeast along Oshkosh Avenue. The adjacent
