HomeMy WebLinkAbout17. 18-502 SEPTEMBER 25, 2018 18-502 ORDINANCE FIRST READING (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE CLOSURE OF OSHKOSH AVENUE FROM PUNHOQUA STREET TO FOX STREET INITIATED BY: DEPARTMENT OF PUBLIC WORKS A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AUTHORIZING A VARIANCE TO SECTION 25-23 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO STREETS TO REMAIN OPEN TO TRAFFIC DURING THE COURSE OF EXCAVATION WORK. WHEREAS, the City of Oshkosh Municipal Code Section 25-23 requires a passageway of not less than ten(10)feet in the travelled portion of the street to remain open on various streets within the City of Oshkosh, including Oshkosh Avenue; and WHEREAS, the City has previously entered into a Contract with PTS Contractors, Inc.which includes the installation of utilities on Punhoqua Street and Fox Street and which permits the closure of Oshkosh Avenue at these intersections to accommodate this utility installation; and WHEREAS, it is necessary therefore to grant a variance from the terms of section 25- 23 for this purpose; and WHEREAS, the timing of the closure is dependent upon progress of the work, weather and other factors. NOW, THEREFORE the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. PTS Contractors, Inc. is hereby granted a variance from the provisions of Section 25-23 of the City of Oshkosh Municipal Code to close Oshkosh Avenue from Punhoqua Street to Fox Street for installation of public utilities subject to the following conditions: SEPTEMBER 25, 2018 18-502 ORDINANCE CONT'D A. PTS Contractors shall provide all necessary and required signage for the closure of the street and detour of traffic. B. PTS Contractors, Inc. shall at least seven (7) days prior to the anticipated closure provide notice to the Department of Public Works and install advance warning signs for motorists. C. PTS Contractors, Inc. shall work with the Department of Public Works to minimize the effects of the street closure upon emergency services and the public. D. The Director of Public Works is hereby authorized to approve such closure, approve such closure with conditions or take such other action as may be necessary and appropriate in consultation with the Police and Fire Chiefs of the City of Oshkosh to protect the health, safety and welfare of the citizens. SECTION 2. This ordinance shall be in full force and effect from and after its passage, publication and placement of the appropriate temporary signage indicating the closure. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #18-502 A GENERAL ORDINANCE OF THE CITY OF OSHKOSH TO APPROVE CLOSURE OF OSHKOSH AVENUE FROM PUNHOQUA STREET TO FOX STREET on September 25, 2018. The ordinance allows the temporary closure of Oshkosh Avenue from Punhoqua Street to Fox Street, for purposes of utility installation. The ordinance makes the contractor responsible for advance notice of the closure to motorists and for installation of all signage and detour signage during the closure. Gohde, Assistant Director of Public Works,506,1"(r DATE: September 20, 2018 RE: Approve Closure of Oshkosh Avenue from Punhoqua Street to Fox Street BACKGROUND The Common Council awarded Contract 18-13 to PTS Contractors, Inc. (PTS) at their June 12, 2018 meeting. The project includes the installation or relaying of utilities on Punhoqua Street from Maple Avenue to Rainbow Drive, and on Fox Street from Graham Avenue to Sawyer Creek. The construction includes the intersections of Oshkosh Avenue with Punhoqua Street and Fox Street. Section 25-23 of the Municipal Code of the City of Oshkosh requires Oshkosh Avenue to remain open during excavation. The Contract documents allow for the closure of Oshkosh Avenue work at the intersection of Oshkosh Avenue and Punhoqua Street to be completed in two (2) weeks, and at the intersection of Oshkosh Avenue and Fox Street to be completed in a separate two (2) week construction window. The work was originally anticipated to be non -concurrent; however, construction scheduling has made it possible to coordinate these closures. Additionally, the work for Contract 18-14, Oshkosh Avenue Area Redevelopment Infrastructure Improvements, will be coordinated with this work to help further minimize the disruptions to the traveling public. A detour route will be posted for the duration of the closure of Oshkosh Avenue using North Sawyer Street, Witzel Avenue, and North Koeller Street. However, we recognize that local, non-commercial traffic will identify and use different routes around the construction area. The Contractor is required to maintain access to businesses for the duration of the project. The closure is anticipated to start on October 1, 2018, weather depending. Advanced warning signs will be placed seven (7) days prior to the closure to warn drivers. 1:\Engineering\2018CONTRACPS\18-13 San Swr Relay\ ProjectInformation\Correspondence\Memo\18-13 Memo for Oshkosh Ave Closure_9-20-18.docx Page I of 2 ANALYSIS Based on the excavation limits necessary for utility construction, staff determined that Oshkosh Avenue from Punhoqua Street to Fox Street would need to be closed to traffic. Worker safety and driver safety will be compromised during the construction work if done under traffic. The Contract Documents limited the time frame to two (2) consecutive weeks for each intersection to minimize the impact to the traveling public. The Contractor will be working in both intersections at the same time to try and reduce the overall time impact from four (4) weeks to three (3) weeks. The sanitary sewers being installed are crossing Oshkosh Avenue and are approximately fifteen feet (15') and twenty one feet (21') deep. This work is being coordinated with the Oshkosh Corporation Global Headquarters project. FISCAL IMPACT The closure was included in the Contract documents, so there are no fiscal impacts to this ordinance. RECOMMENDATIONS I recommend approval of the request to close Oshkosh Avenue from Punhoqua Street to Fox Street for four (4) weeks. Oshkosh Avenue will be reopened earlier if the work is completed.
