Amendment to Professional Services Agreement for Environmental Investigation
and Assessment of the Marion Road Water Tower Site / AECOM Technical
Services, Inc. (AECOM) ($25,810)
A professional services agreement for environmental investigation and assessment of the
Marion Road Water Tower site with AECOM was approved in May 2016. During the course of
this project, additional engineering -related services were requested by City staff.
The additional services requested included coordinating and documenting the initial remedial
effort to remove and dispose of the highest concentrations of mercury -impacted soil; preparing
an initial remedial action documentation report and submitting it to the Wisconsin Department
of Natural Resources (WDNR); documenting removal of the altitude vault and providing
additional soil remedial actions; documenting final remedial actions and site closure plan; and
preparing and submitting a WDNR closure request to the City, the developer, and the WDNR.
The proposed cost of this amendment is not to exceed $25,810. This will raise the total
agreement amount to $72,635. Funding is available within the Capital Improvements Program
(CIP) for this amendment. Various CIP years have allocated a total of $4,933,150 for this project.
This amendment will increase the total project cost, including construction, engineering,
environmental, and other ancillary costs to approximately $4,856,000.
Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a
specialized nature, including engineering services, may be approved by the City Manager
without the use of formal sealed quotes. In accordance with 12-16 of the Code, I am hereby
submitting this report regarding this professional services agreement.

Amendment Request Number 1 to AECOM Proposal No. OPP-485493 for Environmental
Investigation and Remediation Services Related to the Mercury Soil Impacts at the Former
Marion Road Water Tower Site, 429 Marion Road (City Purchase Order #180165)
Dear Mr. Rabe,
AECOM Technical Services, Inc. (AECOM) is requesting an amendment to the agreement dated
May 3, 2016, for the Environmental Investigation and Assessment of the Former Marion Road Water
Tower site (AECOM Proposal No. OPP-485493). This amendment request has been prepared based on
the results of the subsurface investigation, anticipated remedial efforts and requirements outlined in the
developer's agreement in support of the potential land swap of property with Annex 71, LLC, and
documentation and submittal requirements for the Wisconsin Department of Natural Resources (WDNR).
The results of the field and laboratory testing combined with the City's responsibilities outlined in the
developer's agreement related to the property transfer has resulted in a change in the scope of work. The
additional effort includes:
1. Coordinating and documenting the initial remedial effort to remove and dispose of the highest
concentrations of mercury -impacted soil (approximately 24 labor hours for field work, 6 labor hours
for professional staff services, and $1,100 of subcontracted services [laboratory analysis and
equipment rental]).
2. Prepare an initial remedial action documentation report and submit to WDNR (approximately 10
hours for professional staff services).
3. Coordinate a final remedial closure plan with the City, WDNR, and the future landowners (Annex 71
LLC):
a. Attend and provide supporting documents for several meetings with City of Oshkosh and/or
Annex 71 LLC staff (approximately 32 labor hours for professional staff services).
b. Prepare and submit an amended site investigation work plan and remedial action options report
to the WDNR for approval (approximately 12 labor hours for professional staff services).
4. Document removal of the altitude vault and additional soil remedial actions:
a. Collect and submit four (4) soil confirmation samples for laboratory analysis, install and sample
one (1) temporary groundwater monitoring well, and coordinate disposal of additional impacted
soils identified during vault removal (approximately 24 labor hours of field work, 6 labor hours for
professional staff services, and $1,800 of subcontract services [laboratory analysis and
equipment rental]).
5. Document final remedial actions and site closure plan (approximately 40 labor hours of field work and
10 labor hours for professional staff services) to include:
a. Documentation of proper abandonment of the temporary groundwater monitoring well.
b. Documentation that impacted soils removed from the City site are managed in accordance with
the developer's WDNR-approved Soil and Groundwater Management Plan.

c. Documentation of the location of impacted soils remaining in place on the City site after
construction of the detention basin and parking lot.
d. Documentation of any soils removed from the City site and used as fill material on the Annex 71
LLC property.
e. Documentation that the materials and construction methods used to construct the soil cap for the
City site and the Annex 71 LLC property meet WDNR requirements.
6. Prepare and submit a WDNR closure request to City, Annex 71 LLC, and WDNR (approximately 16
hours for professional staff services).
• The current closure plan requirements developed with input from City, WDNR, and Annex 71 LLC
staff will not be significantly changed if unforeseen issues are discovered during site development
activities.
Access agreements between the City and the developer (Annex 71 LLC) will be in place prior to
commencement of construction and allow AECOM staff appropriate access to document the
conditions described above.
• All WDNR fees that may be required for document submittal, review, and site closure are to be paid
by the City.

AECOM is requesting that the budget be increased by $25,810. This increase in budget is anticipated to
cover the additional services described above. AECOM reserves the right to request an increase or
decrease in the budget if the scope of work changes.
The services provided will be performed in accordance with the Negotiated Fee Schedule and conditions
of the General Conditions of Service — City of Oshkosh, April 2009, which are expressly incorporated into,
and are an integral part of, our agreement for professional services. AECOM can begin providing these
services immediately upon receipt of the signed Authorization Form (attached).

I hereby authorize AECOM to proceed with the scope of work outlined in Amendment 1, to amend
AECOM's Proposal No. OPP-485493, dated May 3, 2016, for additional Environmental Services
