FOR CONSTRUCTION MONITORING AND DOCUMENTATION SERVICES FOR MARION ROAD WATER TOWER REPLACEMENT ($8,705.00) INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the City previously entered into a professional services agreement with AECOM Technical Services, Inc. for construction monitoring and documentation services for the Marion Road Water Tower Replacement Project; and WHEREAS, additional services were necessary to complete the project related to fence support pier construction, documentation of the disposal of impacted groundwater, documentation of the contractor's time to remove foundations, documentation of impacted soil stockpiles and parking lot subgrade preparation and asphalt paving. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are authorized and directed pursuant to Section 12-16 of the Municipal Code to enter into an amended agreement with AECOM Technical Services, Inc. BE IT FURTHER RESOLVED that the appropriate City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the final agreement. BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated from: Acct. No. 0541-1810-1799-00000 Water Utility- Construction in Progress City of� Oshkosh MEMORANDUM TO: Honorable Mayor and Members of the on Council FROM: James Rabe, Director of Public Works DATE: September 6, 2018 RE: Approve Amendment No. 2 to Professional Services Agreement for Construction Monitoring and Documentation Services for Marion Road Water Tower Replacement / AECOM Technical Services, Inc. (AECOM) ($8,705) BACKGROUND A professional services agreement for environmental and engineering services for construction monitoring and documentation services for the Marion Road Water Tower replacement was approved by the Common Council on September 13, 2016. An amendment to this agreement was approved by Council on September 25, 2017. During the course of this project, additional engineering -related services were requested by City staff. ANALYSIS The additional services requested included increased documentation and material testing related to the fence support pier construction; additional site visits to document proper disposal of impacted groundwater to sanitary sewer, to document the Contractor's time and materials effort to remove the former water tower foundations; and to provide manifests for disposal of impacted soil stockpiled on the site during construction activities; and documentation of the parking lot subgrade preparation and asphalt paving. FISCAL IMPACT The proposed cost of this amendment is not to exceed $8,705. This will raise the total agreement amount to $118,982.50. Funding is available within the Capital Improvements Program (CIP) for this amendment. Various CIP years have allocated a total of $4,933,150 for this project. This amendment will increase the total project cost, including construction, engineering, environmental, and other ancillary costs to approximately $4,856,000. RECOMMENDATIONS Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature, including engineering services, may be procured without the use of formal, sealed quotes. I have reviewed the amendment and in accordance with Section 12-16 of the Code, I am hereby recommending the Common Council approve this amendment. Approved, Mark A. (AECOM) is requesting an amendment to the agreement dated September 8, 2016, (AECOM Proposal No. OPP-542187) and Amendment 1 dated July 13, 2017, for Construction Monitoring and Documentation Services Related to City of Oshkosh Contract 16-22 Marion Road Water Tower Replacement. This amendment request is for additional effort required to complete the Construction Monitoring and Documentation. The additional effort includes: Increase in documentation and materials testing related to the fence support pier construction, including additional subcontracted laboratory material testing services. a. The original scope of work included construction in normal weather conditions. The fence piers are constructed out of a combination of masonry, brick, mortar and grout which are very temperature sensitive. Since the contractor completed the work in winter conditions (i.e. below freezing temperatures) additional documentation, field and laboratory testing were initiated in an effort to assure Project Document compliance. Approximately 43 hours of additional field documentation, office work, and $500 of subcontracted laboratory costs were required. This work item was not included in the original scope of work. Additional site visits to document proper disposal of impacted groundwater to sanitary sewer. a. The Contractor and all the subcontractors had to be reminded at each dewatering event that all groundwater had to be discharged to the sanitary sewer in compliance with the Sanitary Discharge Permit. Accurate documentation records are required to verify sanitary discharge costs. Approximately 8 hours of additional field documentation was required. Additional site visits to document the contractor time and materials effort to remove the former water tower foundations. a. During demolition of the former water tower, the foundations were discovered to be significantly larger than the available record drawings indicated. The Contractor requested a lump sum change order due to that change in conditions. The Contractor was instructed to proceed with removal under a time and materials basis. In an effort to verify and track the costs, additional documentation of the foundation removal was required. Approximately 10 hours of field documentation and office work was required. This work item was not included in the original scope of work. Additional site visits to provide manifests for disposal of impacted soil stockpiled on the site during construction activities. Approximately 8 hours of additional field documentation was required. Additional impacted soil was generated during final site grading and was not originally anticipated the original scope of work. This material could not be reused on site and because it was solid waste it had to be disposed of at a licensed landfill in compliance with the material management plan. Documentation of the parking lot subgrade preparation and asphalt paving. Approximately 4 hours of field documentation was required. This work item was not included in the original scope of work. This increase in budget will cover the additional services required to complete the project.
