On Tuesday July 17f we will tentatively be holding two workshops.
1. Potential zone change to include a Planned Development Overlay for the Southwest
Industrial Park&Church Hill area.
2. Potential zone to include a Planned Development Overlay for 1755 W. 7h Avenue.
Workshop 1
Parcels of land totaling approximately 250 acres of land within the Southwest Industrial
Park located along the north side of the rail road tracks and both the east and west sides of
Clairville Road. The land is zoned Heavy Industrial (HI) with a land use recommendation of
industrial. It is mostly undeveloped with the exception of the transload terminal. The City has
been approached by multiple businesses interested in expanding near the transload terminal
which include a wide range of potential uses that are allowed within the city's HI Zoning District
by right or with a Conditional Use Permit. As a way to promote business growth in the park
and protect the other surrounding uses, city staff feels it is appropriate to discuss the potential
use of a Planned Development Overlay to aid in shaping the future development pattern for this
portion of the industrial park. The area is uniquely impacted by both the existing residential
development in the area (for example -Sunrise Estates) and intense industrial/rail related uses
(for example—transload terminal).
Workshop 2
The City was approached by a possible tenant for the former AE Jeweler's building located at
1755 W. 7thAvenue. The potential tenant inquired about remove the existing diamond shape sign on top
of the 60' pole and replacing it with a rectangular 100 sq. ft. cabinet sign. Staff advised the potential
tenant that the sign is currently legal non-conforming and removal of the cabinet would require the sign
to conform to current code requirements for 30' maximum height. The potential tenant subsequently
filled for variance with the Board of Appeal to be allowed to keep the 60' sign height.The BOA heard the
request at its August 8,2018 meeting and denied the request, finding that:
"There is no hardship unique to this property for the granting of the variance. Requirements of the
franchise cannot be used as the basis for the granting of the variance."

Part of the BOA's discussion was that other alternative options exist and therefore granting of a variance
would not meet the statutory requirements. One of those options would be too request a zone change to
include a Planned Development overlay and request a Base Standard Modification for sign height.
The potential tenant would like to discuss the possibility of using a Planned Development Overlay to keep
the existing legal non-conforming sign height of 60'.
