BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized and directed to execute any and all documents
necessary to consummate the disposition of Outlot 1, formerly a portion of Lakeshore
Municipal Golf Course to H2Oshkosh, LLC with the following conditions:
1. The proposed outlot will be integrated with a future Certified Survey Map for
new lot configuration and removal of the outlot status;
2. The zoning designation of proposed Outlot 1 shall be changed from Institutional
(I) to Corporate Business Park with a Planned Development Overlay (CSP-PD)

BACKGROUND
Earlier this year the city dedicated street right-of-way of an unnamed street (now known as the
N. Koeller Street extension) connecting the N. Westfield Street extension to Rath Lane. Staff had
little time to properly analyze the dedication due to time constraints, unknown results of soil
conditions and impacts on wetlands. Since then, the street has been redesigned to accommodate
the now verified environmental conditions. Due to this, the previously dedicated street right-
of-way will be vacated and rededicated with the new street design (both scheduled for Common
Council approval on August 28th).
The area in this request involves a 0.831 acre irregular-shaped future outlot located south of a
proposed right-of-way extension of N. Koeller Street. The general area is undergoing major
redevelopment in terms of new commercial development along the north side of Oshkosh
Avenue, the repurposing of the former Lakeshore Municipal Golf Course to a multi -use
community park and the construction of Oshkosh Corporation's global headquarters to the
north.
ANALYSIS
The city is in the process of having a Certified Survey Map (CSM) (see Exhibit A) of the former
golf course property prepared for the purpose of dedicating the realigned extension of N.
Koeller Street. The resulting dedication will result in the creation of two parcels of land located
between the new street and privately -held properties to the south. Dimensionally, these parcels
are undevelopable due to their irregular shapes and shallowness and will be designated as
outlots on the CSM which are defined as undevelopable lots.

Two outlots are planned to be created: Outlot 1, sized at 0.831 acres and Outlot 2, sized at 0.307
acres. Two outlots are being created due to anticipated dispositions to the properties to the
south; the common lot line of the two outlots are aligned with the property lines to the south.
This request focuses on the disposition of Outlot 1 to the properties to the south owned by
H2Oshkosh Ave, LLC. The disposition will make up the difference for land dedicated for the
widening of Oshkosh Avenue to 80 feet wide and oversizing the width of the N. Westfield Street
extension by H2Oshkosh Ave, LLC earlier this year. Staff sees this as a way to dispose of
otherwise undevelopable property while benefiting H2Oshkosh's redevelopment efforts with
the acquisition of additional land. H2Oshkosh will be required to prepare a CSM to integrate
Outlot 1 with their other properties to remove the "Outlot" designation. A preliminary CSM
has been submitted for review but cannot be approved until the Common Council takes action
on the disposition.
The disposition will not impact the future trail system that will be part of the redevelopment of
the former golf course to a public park (see Exhibit B). The city retained an 80 -foot strip of land
located between Oshkosh Corporation's Global Headquarters property to the north, and
properties owned by H2Oshkosh Ave, LLC and Lake Shore Development of Oshkosh, LLC to
the south (see Exhibit C). Part of the 80 -foot strip will be used for construction of a prairie
treatment system for storm water quality. A 15 to 18 feet swath of land will still be available
for construction of a pedestrian trail connecting the east side and west side of the park.
The trail will exit the 80 -foot strip on the western side and connect to a ten -foot wide public
sidewalk on the northerly side of N. Westfield Street/N. Koeller Street (see Exhibit D) and is
included in the infrastructure plans for the N. Westfield Street project. The sidewalk/trail will
continue west and reconnect to the park's trail system. The sidewalk/trail will not require the
crossing of a public street. However, it will cross the driveway entrance to Oshkosh
Corporation's property. Pedestrian safety should be high due to vehicles needing to slow down
for the transition from street grade to driveway grade and vice versa.
Proposed Outlot 1 currently has a zoning designation of Institutional with an Institutional (I)
District while the properties to the south have a Corporate Business Park designation with
Planned Development Overlay (CBP-PD). To alleviate this, the area of the future outlot must
be rezoned to match the properties owned by H2Oshkosh Ave, LLC which is CBP-PD. The
Advisory Park Board reviewed and recommended approval of the disposition of this property
at its August 13, 2018 meeting.
FISCAL IMPACT
This land disposition can be viewed as a land swap with H2Oshkosh Ave, LLC with no funds
exchanged. There was going to be surplus land (Outlots 1 & 2) created from redesign of N.
Koeller Street and the city would need additional right-of-way. In exchange, the city would
dispose of the 36,184 square foot Outlot 1 which contains a portion of wetlands and H2Oshkosh
Ave LLC dedicated or will dedicate a total of 35,250 square feet of right-of-way to the city. This

saved the city from having to purchase the right-of-way, and then dealing with an uncertain sale
of Outlot 1 to H2Oshkosh. Staff has shared the land swap solution to obtain right-of-way needed
for the private developments with the Common Council on multiple occasions and the Council
suggested the land swap plan was acceptable.
The disposition of Outlot 1 will add land assessment value to the proposed hotel development
south of N. Koeller Street. The land is also located in Tax Increment District 35 and will create
additional increment.
RECOMMENDATION
The Plan Commission recommended approval of the land disposition at its August 21, 2018
meeting.

RECOMMENDATION/CONDITIONS
Staff recommends approval of the land disposition of the proposed 0.831 acre Outlot 1 south of N.
Koeller Street as proposed with the following conditions:
1. The proposed outlot will be integrated with a future Certified Survey Map for new lot
configuration and removal of the outlot status;
2. The zoning designation of proposed Outtot 1 shall be changed from Institutional (1) to
Corporate Business Park with a Planned Development Overlay (CBP-PD)
The Plan Commission approved of the land disposition as requested with conditions noted. The
following is the Plan Commission's discussion on this item.
Mr. Nau presented the item and reviewed the site and surrounding area. The city is in the

Mr. Nau confirmed it would.
Item—Land Disposition—N. Koeller Street
Ms. Propp asked how the trail would connect towards the right-of-way and the Oshkosh
Corporation driveway.
Mr. Gohde explained that the trail would come from the 80 -foot strip of land, connect to the
sidewalk on Westfield Street, then go right in front of the Oshkosh Corporation property in the
right-of-way and finally snake up north to the park. There is wetland in the area that cannot be
disturbed, therefore the trail has to work around those areas.
Ms. Propp inquired more about the sidewalk in front of the Oshkosh Corporation driveway.
Mr. Gohde explained that it is a driveway and not an at grade intersection. It will be raised with
an apron and a sidewalk, where vehicles will have to slow down.
Ms. Propp asked if the right-of-way would stay City owned.
Mr. Gohde confirmed it would.
Motion by Vajgrt to approve the land disposition of property located at the former Lakeshore Municipal
Golf Course, 1507 N. Eagle Street with the following conditions:
1. The proposed outlot will be integrated with a future Certified Survey Map for new lot
configuration and removal of the outlot status,
2. The zoning designation of proposed Outlot 1 shall be changed from Institutional (I) to
Corporate Business Park with a Planned Development Overlay (CBP-PLS)
Seconded by Ford. Motion carried 8-0.
