HomeMy WebLinkAbout01. 18-436 AUGUST 28, 2018 18-436 RESOLUTION (CARRIED 5-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE FINAL RESOLUTION VACATING: A PORTION OF NORTH WESTFIELD STREET; ALL OF UNNAMED STREET BETWEEN RATH LANE TO NORTH WESTFIELD STREET; PORTION OF NORTH EAGLE STREET; ALL OF BUTTE DES MORTS STREET; ALL OF SHOMIN STREET; ALL OF WATER STREET; PORTION OF RAINBOW DRIVE; ALL OF PUBLIC ALLEY BETWEEN SHOMIN STREET AND RAINBOW DRIVE; ALL OF PUBLIC ALLEY BETWEEN BUTTE DES MORTS STREET AND SHOMIN STREET; PORTION OF GRAHAM AVENUE INITIATED BY: CITY ADMINISTRATION PLAN COMMISSION RECOMMENDATION: Approved WHEREAS, pursuant to Section 66.1003(4) of Wisconsin Statutes, the Common Council has heretofore initiated proceedings on July 10, 2018 at a regular meeting of the Common Council to vacate and discontinue a Portion of North Westfield Street; all of unnamed Street between Rath Lane to North Westfield Street; portion of North Eagle Street; all of Butte Des Morts Street; all of Shomin Street; all of Water Street; portion of Rainbow Drive; all of public alley between Shomin Street and Rainbow Drive; all of public alley between Butte Des Morts Street and Shomin Street; portion of Graham Avenue, in the City of Oshkosh as described in "Exhibit A"; and WHEREAS, a public hearing on the passage of such resolution has been set by the Common Council, which hearing was set for 6:00 PM in the Council Chambers of the City Hall, Oshkosh, Wisconsin, on the 28th day of August, 2018 and written notice of such meeting was duly served on the owners of all of the frontage of the lots and lands abutting upon that portion thereof sought to be discontinued as provided by law; and AUGUST 28, 2018 18-436 RESOLUTION 0910110 WHEREAS, a public hearing was duly held pursuant to said notice at the time and place therefore affixed and all persons so served and interested were then and there given an opportunity to be heard; and WHEREAS, the lots and lands abutting that portion of said street or alley within said City affected by this resolution are in the 161h Ward, City of Oshkosh, the description of said street or alley heretofore set out in this Resolution. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that it is hereby declared that since public interest requires it, that the described street and/or alley in "Exhibit A" in the 161h Ward, City of Oshkosh, Winnebago County, Wisconsin, is hereby vacated and discontinued, reserving unto the City of Oshkosh and any utility affected by this Resolution, the right to maintain, service, repair, add, replace, or install in the future, sanitary sewer, storm sewer, water main and other utility facilities in said vacated streets or alley, subject to the restriction that no improvements are allowed within the reserved area, including but not limited to, building structures, driveways, parking areas, landscaping or fences. Any improvements shall be allowed only by special exception of the Board of Public Works. BE IT FURTHER RESOLVED that the City Clerk record a certified copy of this Resolution accompanied with a map showing the location of said vacated street or alley in the Office of the Register of Deeds for Winnebago County. Eight of the vacations are located on either the former Lakeshore Municipal Golf Course property or Rainbow Memorial Park, while one is located on recently dedicated N. Westfield Street dedicated by H2Oshkosh Ave. LLC. The first involves the future extensions of N. Westfield and N. Koeller Street while the second group is generally located at the eastern side of the golf course property and Rainbow Memorial Park. ANALYSIS Earlier this year, H2Oshkosh Ave LLC dedicated right-of-way for the N. Westfield extension. Since that time, final street design has been completed and a small portion of the dedicated right- of-way is no longer needed. To simplify the process, the City is recommending the vacation of the entire street segment to be followed by a new street dedication with the new alignment. The remainder of the vacations are located at the east end of the golf course property and Rainbow Memorial Park. The proposed vacations include all of Lake Butte des Morts, Shomin and Water Streets, two public alleys, portions of N. Eagle Street, Rainbow Drive and Graham Street. During review of a preliminary Certified Survey Map for the golf course, research indicated that the aforementioned streets were not officially vacated, although the historic use of the lands were treated as if they were. This request is essentially a cleanup of the area by making the vacations official. Most of the land for the proposed vacations will be reverted back to the City's former golf course property and/or Rainbow Memorial Park, with a few remnants being reverted back to private properties in the area per State Statute. FISCAL IMPACT None anticipated as the majority of lands remain as public lands but revert to the park. The proposed right of way vacations will not require expansion of city services. Property Location and Background Information: Plan Commission is being asked to review several proposed street right-of-way vacations consisting of nine individual vacations. Eight of the vacations are located on either the former Lakeshore Municipal Golf Course property or Rainbow Memorial Park, while one is located on recently dedicated N. Westfield Street dedicated by H2Oshkosh Ave. LLC. The proposed vacations can be broken into two groups: The first involves the future extensions of N. Westfield and N. Koeller Streets while the second group are generally located at the eastern side of the golf course property and Rainbow Memorial Park. At its July 10, 2 018 meeting, the Common Council set a public hearing date of September 11, 2018 to take final action for the vacations. Westfield Street extension which was to provide Oshkosh Corporation access to their global headquarters site. Since then the Army Corps of Engineers conducted a re -delineation of wetlands on the golf course property which removed and reduced some of the wetlands in the area. This caused the City to redesign the alignment of the unnamed street (now known as N. Koeller Street) to avoid the newly mapped wetlands. To simplify the process, the City is Item—Street Vacations — Golf Course Property & Rainbow Memorial Park recommending the vacation of the entire street segment to be followed by a new street dedication with the new alignment. On June 12, 2018 the City approved a dedication to extend N. Westfield Street north of Oshkosh Avenue to provide street and utility access for Oshkosh Corporation and redevelopment areas along Oshkosh Avenue. The dedication included land forming a curve to the west which was mapped in case the Army Corps of Engineers wetland delineation did not alter the existing wetlands. The dedication was necessary to allow the Department of Public Works to begin design work for the N. Westfield Street extension and its intersection at Oshkosh Avenue. With the new delineation and the re -alignment of N. Koeller Street, this curve section is no longer needed and the City recommends its vacation. The land will be reverted back to H2Oshkosh Ave. LLC. The remainder of the vacations are located at the east end of the golf course property and Rainbow Memorial Park. The proposed vacations include all of Lake Butte des Morts, Shomin and Water Streets and two public alleys, and portions of N. Eagle Street, Rainbow Drive and Graham Street. During review of a preliminary Certified Survey Map for the golf course, research indicated that the aforementioned streets were not officially vacated, although the historic use of the lands were treated as if they were. This request is essentially a cleanup of the area by making the vacations official. Most of the land for the proposed vacations will be reverted back to the City's former golf course property and/or Rainbow Memorial Park, with a few remnants being reverted back to private properties in the area. According to the Public Works Department, the alleys are no longer used or needed and can be vacated. Public Works is requesting, however, that the City and any other utility facilities have the right to maintain existing utilities within the proposed right-of-way vacations. Staff supports the right-of-way vacations request as proposed. The vacations will have no impact on adjacent properties as the land has been historically used as if the right-of-ways had been already vacated. RECOMMENDATION/CONDITIONS Staff recommends approval of the proposed street right-of-way vacations as requested. The Plan Commission approved of the street right-of-way vacations as requested. The following is the Plan Commission's discussion on this item. Mr. Nan presented the item and reviewed the sites and surrounding area. Mr. Nan stated that is usually the case however during a partial street vacation of Rainbow Drive, property owners were given back the south 33 feet of Rainbow Drive. The north 33 feet of Rainbow Drive will revert back to parkland. Mr. Burich stated it is not always the case that street vacations are 50/50 going back to the adjacent property owners. If it can be proven the street dedication was taken all from one property owner, the street would revert back to the original property owner if vacated. Barb Repp 1506 Repp Avenue questioned why there was a 6 foot strip to the north of their property. She stated they sold a portion of their property and have an abstract showing that portion of Rainbow Drive was sold to the property owner to the north. Mr. Nan stated the road was never formally vacated according to City records and the proposed actions now would formalize that. Mr. Repp 1506 Repp Avenue questioned who the private property owners are that would get the vacated right or way and if there would be private development on the parkland to the north. Mr. Nan showed on a map the adjacent property owners that would receive the vacated right of way and stated there is no intention for private development to the north and that the vacated right of way will be park.
