HomeMy WebLinkAbout10. 18-413 AUGUST 15, 2018 18-413 RESOLUTION (CARRIED 4-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE CONDITIONAL USE PERMIT FOR OUTDOOR STORAGE AREA; 3300 MEDALIST DRIVE INITIATED BY: SMET INVESTMENTS, LLC PLAN COMMISSION RECOMMENDATION: Approved w/ conditions WHEREAS, the Plan Commission finds that the Conditional Use Permit to expand an existing vehicle storage area at 3300 Medalist Drive, is consistent with the criteria established in Section 30-382(F)(3) of the Oshkosh Zoning Ordinance. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that a conditional use permit is hereby approved to expand the existing vehicle storage area at 3300 Medalist Drive, per the attached, with the following conditions: 1. The outdoor storage area must be completely enclosed by 8 foot tall solid (at least 90% opaque) fencing. 2. A cross access agreement must be drafted and submitted to the Department of Community Development. u TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: August 7, 2018 RE: Approve Conditional Use Permit for Outdoor Storage Area; 3300 Medalist Drive (Plan Commission recommends approval) BACKGROUND The subject site is located at the southeast corner of Medalist Drive and W. 33rd Avenue, north of 34th Avenue and is accessed via entrances/exits from Medalist Drive and W. 33rd Avenue. The site consists of a 134,130 square foot industrial building and associated parking area being leased by Oshkosh Defense for final inspection of vehicles. The site includes an asphalt parking/storage area that extends to the neighboring lot to the east (401 W 33rd Ave). The property is located within the Aviation Industrial Park and the surrounding area consists predominately of industrial uses. ANALYSIS A Conditional Use Permit (CUP) was approved on July 10th for an outdoor storage area on the north side of the building. The petitioner is now requesting approval of a conditional use permit to expand an existing vehicle storage area on the east side of the building. The area will exceed 500 sq. ft. and therefore will require a conditional use permit. The storage area will need to be enclosed with 8' tall solid fencing, as required by the zoning ordinance. FISCAL IMPACT Approval of the CUP will not require the expansion of any city services and there may be some minor assessment increase due to the new fence structure being constructed. GENERAL INFORMATION Applicant: Richard Fisher Owner:Scott Smet - Smet Investments LLC Action(s) Requested: The applicant is requesting a conditional use permit to expand an outdoor storage use on a previously developed lot. Applicable Ordinance Provisions: Outdoor Storage land uses are permitted only through a conditional use permit in the Heavy Industrial District (HI) as regulated in Section 30-62 (C) of the Zoning Ordinance. Criteria used for Conditional Use Permits are located in Section 30-382 of the Zoning Ordinance. The petitioner is now requesting approval of a conditional use permit to expand an existing vehicle storage area on the east side of the building. The area will exceed 500 sq. ft. and therefore will require a conditional use permit. The existing storage area is approximately 12,350 sq. ft. and surrounded by cyclone fencing. The applicant plans to expand the storage area on both the east and west sides of the existing area, totaling an additional 9,262 sq. ft. The proposal states that the new storage areas will be surfaced with gravel and enclosed with 6' tall cyclone fencing. As the storage area expansion extends over the east property line, a cross access agreement will be required. The proposed 6' tall cyclone fencing is not compliant with screening standards for an outdoor storage use. The storage area will need to be enclosed with 8' tall solid fencing, as required by the zoning ordinance. Staff does not see a need for additional landscaping due to the minimal visibility of the subject area from the public right-of-way and adjoining properties. Staff is in support of the proposed outdoor storage use as the use should not be detrimental to the surrounding area, provided the required solid (at least 90% opaque) 8' tall screening is installed around the storage area. The Department of Public Works reviewed the proposal and noted that the existing stormwater management plan will have to be modified and a cross access agreement will be required for stormwater to cross over to the adjacent parcel. This can be addressed during Site Plan Review. RECOMMENDATION/CONDITIONS In its review and recommendation to the Common Council on an application for a Conditional Use Permit, staff recommends the Plan Commission make the following findings based on the criteria established by Chapter 30-382 (11)(3): (1) Is in harmony with the Comprehensive Plan. (2) Would not result in a substantial or undue adverse impact on nearby property, the character of the neighborhood, environmental factors, traffic factors, parking, public improvements, public property or rights-of-way, or other matters affecting the public health, safety, or general welfare. (3) Maintains the desired consistency of land uses, land use intensities, and land use impacts as related to the environs of the subject property. (4) The conditional use is located in an area that will be adequately served by, and will not impose an undue burden on, any of the improvements, facilities, utilities or services provided by public or private agencies serving the subject property. (5) The potential public benefits outweigh any potential adverse impacts of the proposed conditional use, after taking into consideration the applicant's proposal and any requirements recommended by the applicant to ameliorate such impacts. Item — CUP/Outdoor Storage — 3300 Medalist Dr. Staff rQcommends approval of the proposed Conditional Use Permit for an outdoor storage area at 3300 Medalist Drive as proposed, with the findings listed above and the following conditions: 1. The outdoor storage area must be completely enclosed by 8 foot tall solid (at least 90% opaque) fencing. 2. A cross access agreement must be drafted and submitted to the Department of Community Development. The Plan Commission approved of the Conditional Use Permit as requested with conditions. The following is the Plan Commission's discussion on this item. Mr. Slusarek presented the item and reviewed the site and surrounding area. Mr. Lyons stated the ordinance does not require the outdoor storage area to be paved. Ms. Propp questioned if the property owner was agreeable to building over the property line. Mr. Bowen questioned how setbacks work with the proposed storage area crossing the property line. Mr. Lyons responded the cross access agreement will allow for the storage area to cross the property line and setbacks would not be needed along the property line crossed. It is a use that can be removed should ownership of the property change. Rick Fisher with Fisher & Associates stated both parcels are owned by the same entity and has no issues with the conditions placed by staff. Motion by Vajgrt to approve a conditional use permit to establish an outdoor storage use at 3300 Medalist Drive with the following conditions: 1. The outdoor storage area must be completely enclosed by 8 foot tall solid (at least 90% opaque) fencing. 2. A cross access agreement must be drafted and submitted to the Department of Community Development. Seconded by Bowen. Motion carried 8-0. The conditional use permit is to expand and existing outdoor secure storage area. The existing area is approximately 12,350 s.f. with a perimeter cyclone fence with a gate. We are requesting that the fenced area be expanded by approximately 9262 s.f. The current planned use is to secure storage materials that are owned by the federal government. The area is required by contract with the federal government to be secured with a fence. The new paved area will be graveled and the fencing will be 6-0" cyclone fencing. This property is currently an industrial site that was last used by GE for manufacturing Compressors. The property is zoned Hl heavy industrial with all other surrounding properties being Hl heavy industrial as well.
