Gohde, Assistant Director of Public Works S DATE: July 19, 2018 RE: Amendment to Professional Services Agreement for TID #34 and TID #35 Storm Water Support / Brown and Caldwell ($11,944) A professional services agreement was executed on April 27, 2018 with Brown and Caldwell for TID #34 and TID #35 storm water support services. Additional services were requested from Brown and Caldwell due to information requested by the Wisconsin Department of Natural Resources at the Notice of Intent permit pre - submittal meeting and the impacts of water quality basin design on the Oshkosh Corporation site. The additional services include additional hydrologic and hydraulic modeling, Koeller Street/Westfield Street Prairie Treatment System water quality modeling, TID #34 wet detention basin storm water modeling report, and TID #35 storm water modeling report. Staff has reviewed the amendment and the costs. The amount of this agreement amendment is not to exceed $11,944. This will raise the total agreement amount to $35,189 (not to exceed). Funds for this project are included in the Storm Water section of the 2018 Capital Improvement Program. Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature, including engineering services, may be procured without the use of formal, sealed quotes. In accordance with Section 12-16 of the Code, I am hereby submitting this report regarding this professional services amendment. Paragraph C in ARTICLE XII. PAYMENT included the provision that costs for additional services shall be negotiated and set forth in a written amendment to this AGREEMENT executed by both parties prior to proceeding with the work covered under the subject amendment. THEREFORE, the CITY and the CONSULTANT agree to insert the following paragraph after the first paragraph in ARTICLE III. SCOPE OF WORK: The CONSULTANT shall provide the services described in the CONSULTANT's Exhibit A — Scope of Services and Compensation dated July 6, 2018. The CITY and the CONSULTANT further agree to insert the following bullet point after the first bullet point in Paragraph A of ARTICLE XII. PAYMENT: • Payment for Amendment No. 1 shall be a Time and Materials Sum not to exceed $11,944 (Eleven Thousand Nine Hundred Forty Four Dollars). All other terms contained within the April 27, 2018 agreement remain unchanged and in effect. All terms and conditions from that agreement remain in effect for the work and budget described in this Amendment #1. Task #9: Additional Hydrologic & Hydraulic Modeling BC will update the proposed conditions hydrologic and hydraulic model (XPSWMMTm) for the TID #34 and #35 project area. Updates to the model will include: • The TID #35 (Koeller Street / Westfield Street) final storm sewer design, as provided by the City. • The former golf course pond system equalization pipe design, as provided by the City. • The TID #34 (Oshkosh Corporation Global Headquarters) wet detention basin design, as provided by the City. This BMP was previously a prairie treatment system. The model will be executed for the for 10-, 25-, and 100 -year, 30 -minute critical duration storm events (with rainfall depths and distributions from the Midwest Climate Center Bulletin 71) and for the 1-, 2-, 10-, and 100 -year, 24-hour storm event with rainfall depths and distributions consistent with City of Oshkosh Municipal Code Chapter 14. The results of the analysis will be summarized (using graphical and tabular formats) and provided to the City. Graphical maps (2D output from the XPSWMMT" modeling) of the flooding extent in the study area will be prepared for the 10 -year and 100 -year, 24-hour storm events. Tabular results will include peak water surface elevations at key locations in the model and pump run-time information for all events analyzed. Tabular results will include the runoff volumes 1-, 10-, and 100 -year, 24-hour storm events discharged from TID #34 and to the stormwater water quality BMPs designed for Koeller St and Westfield St. The output file for all XPSWMM" model runs will be provided in their standard text format. Copies of the input/output XPSWMMTM model runs will be provided in XPSWMM" standard read only export format. Task #10: Koeller Street / Westfield Street Prairie Treatment System Water Quality Modeling BC will develop a WinSLAMM model to estimate the average annual pollutant reduction for TSS and TP for the proposed Koeller Street / Westfield Street Prairie Treatment Systems. To the extent possible, the model will be consistent with the requirements of current WDNR guidance documents. The City will provide design information including design plans and the design TSS reduction the Prairie Treatment System will achieve. WinSLAMM modeling will be used to estimate the annual runoff volume passing through the treatment system and the annual runoff volume that bypasses the treatment system based upon the design information provided by the City. The report will document the water quality modeling and the hydrologic and hydraulic modeling completed as part of this project. The report will be prepared such that the City may use it as part of a Stormwater Notice of Intent (NOI) submittal for construction of the TID #34 wet detention basin. Included in the report will be a brief narrative of the modeling, model input/output, and supporting figures. A draft report will be prepared and provided to the City for review. Following review, the report will be finalized and a final report delivered to the City. The final report will be delivered as an Adobe Acrobat Portable Document Format (pdf . Task #12: TID #35 Stormwater Modeling Report A stormwater modeling report will be prepared to summarize the modeling of the TID #35 stormwater system. The report will document the water quality modeling and the hydrologic and hydraulic modeling completed as part of this project. The report will be prepared such that the City may use it as part of a Stormwater Notice of Intent (NOI) submittal for construction of the Koeller Street and Westfield Street extensions. Included in the report will be a brief narrative of the modeling, model input/output, and supporting figures. A draft report will be prepared and provided to the City for review. Following review, the report will be finalized and a final report delivered to the City. The final report will be delivered as an Adobe Acrobat Portable Document Format (pdf . Schedule BC anticipates initiating the effort included in this amendment by July 6`', 2018. BC will commence work immediately after the City issues a written (email) Notice to Proceed. A draft TID #35 stormwater modeling report will be provided to the City by July 16, 2018, or ten (10) calendar days after the City issues a written Notice to Proceed and provides all needed data to BC, whichever date is later. A draft TID #34 wet detention basin stormwater modeling report will be provided to the City by July 23, 2018, or seventeen calendar days after the City issues a written Notice to Proceed. Interim information will be provided to the City as requested to meet the City''s project needs. Final reports will be provided to the City three (3) days after review comments are received. The City will provide design drawings (PDFs) of all elements to be included in the modeling. The files for all elements will be provided prior to start of the work. The following design plans will be included: a. Koeller Street / Westfield Street storm sewer. b. Koeller Street / Westfield Street prairie treatment system. c. Former golf course pond system equalization pipes. d. TID #34 wet detention basin. 2. The scope of work assumes there are no changes to the drainage areas or drainage area hydrologic conditions to each of the items identified under Assumption 1 a -d. 3. The scope of work includes one (1) iteration of hydrologic and hydraulic modeling. Evaluations of alternative designs are not included as part of this scope of work. 4. The hydrologic and hydraulic analysis conducted does not include inlet capacity analyses, inlet leads, privately -owned storm sewers, privately -owned structural management measures, or the prairie treatment systems in Koeller Street / Westfield Street. 5. The scope of work does not include preparing permit applications. Stormwater reports will be prepared to supplement the City -prepared applications. 6. No survey or other field work is budgeted. 7. Data required for stormwater analyses will be provided to BC at no cost to the project. 8. The scope and budget does not include any face-to-face meetings with the City or other governmental agencies. All work will be conducted in 2018. TID 34_35 Amendment 1—final-2018-7-O6—v2 Page 3 of 3
