PLACE (STAFF RECOMMENDS WAIVING THE RULES AND
ADOPTING ON FIRST READING)

A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AUTHORIZING A VARIANCE
TO SECTION 25-23 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO STREETS
TO REMAIN OPEN TO TRAFFIC DURING THE COURSE OF EXCAVATION WORK.
WHEREAS, the City of Oshkosh Municipal Code Section 25-23 requires a
passageway of not less than ten (10) feet in the travelled portion of the street to remain open
on various streets within the City of Oshkosh, including 91h Street Road; and
WHEREAS, Excel has requested a variance from the terms of section 25-23 for the
purposes of providing a safe work area and reducing congestion to facilitate the connection
of the proposed Pickart Estates Subdivision to the sanitary sewer main in 91h Street Road;
and
WHEREAS, the timing of the closure is anticipated for a period not to exceed two (2)
consecutive weeks with an anticipated start date of August 1, 2018, to end no later than
August 31, 2018.
NOW, THEREFORE the Common Council of the City of Oshkosh do ordain as
follows:
SECTION 1. That, Excel is hereby granted a variance from the provisions of Section
25-23 of the City of Oshkosh Municipal Code to close 91h Street Road for purposes of
providing a safe work area and reducing congestion as necessary to connect to sanitary
sewer utilties in 91h Street Road for a period not to exceed two (2) consecutive weeks subject
to the following conditions:

A. Excel shall be permitted to close 9th Street Road pursuant to the terms and
conditions of this resolution.
S. Excel shall provide at least seven (7) day notice to the Department of Public
Works prior to any anticipated closure.
C. Excel shall provide all necessary and required signage for the closure of the
street and detour of traffic.
D. Excel shall work with the Department of Public Works to minimize the effects
of the street closure upon emergency services and the public.
E. The Director of Public Works is hereby authorized to approve such closure,
approve such closure with conditions or take such other action as may be
necessary and appropriate in consultation with the Police and Fire Chiefs of
the City of Oshkosh to protect the health, safety and welfare of the citizens.
SECTION 2. This ordinance shall be in full force and effect from and after its
passage, publication and placement of the appropriate temporary signage indicating the
closure.
SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted
ordinance #18-399 APPROVE CLOSURE OF 9TH STREET ROAD (WEST 9TH AVENUE)
FROM LINDEN OAKS DRIVE TO THE PROPOSED PAUL'S PLACE (A GENERAL

PAUL'S PLACE) on July 24, 2018. The ordinance allows temporary closure of 91h Street
Road, for purposes of providing a safe work area and reducing congestion to allow for
sanitary sewer connections to be made in 91h Street Road for a period not to exceed two (2)
consecutive weeks. Anticipated start date of August 1, 2018 to no later than August 31,
2018.

RE: Approve Closure of 91h Street Road (West 911, Avenue) from Linden Oaks Drive to the Proposed
Paul's Place
BACKGROUND
As part of the infrastructure needed to serve Pickart Estates, Phase 1, the sanitary sewer under 91h Street Road
(West 9th Avenue) needs to be extended to the west. The developer for this project, K & P Development, LLC,
has requested to close both lanes of traffic of 911, Street Road (West 9th Avenue) from Linden Oaks Drive to the
proposed Paul's Place for a period of two (2) weeks to complete this work. Their request is attached.
A detour route will be required to be posted for the duration of the construction. Advanced warning signs
will be placed seven (7) days prior to the closure to warn drivers.
ANALYSIS
City Ordinance No. 25.23 requires 9th Street Road (West 9th Avenue) to remain open to traffic at all times. The
developer cited worker and traveling public safety concerns as the basis for the closure request. Based on the
location and depth of the sanitary sewer, construction under traffic will be very difficult and would likely
require a temporary roadway be constructed.
FISCAL IMPACT
There are no fiscal impacts to this ordinance.
RECOMMENDATIONS
I recommend approval of the request to close 911, Street Road (West 9t1i Avenue) from Linden Oaks Drive to
the proposed Paul's Place for a period of two (2) consecutive weeks with the following conditions:
• All work, including restoration, must be completed by August 31, 2018.
• The developer shall post a detour route, approved by the Department of Public Works, and post
warning signs at least seven (7) days prior to the closure.

RE: Pickart Subdivision Sanitary Sewer Main Extension

To facilitate connection of the proposed Pickart Estates Subdivision sanitary sewer main extension to
the existing public main in 91h Street Road, we find it will be necessary to temporarily close both lanes of
91h Street Road. The reasons for this temporary closure are noted below:
The existing sanitary manhole to which the proposed main will connect to is located in the
center of 91h Street Road approximately 100 feet east of the intersection of 9th Street Road and
the proposed Paul's Place; said paved roadway is approximately 21 feet wide.
The proposed sanitary main extension is approximately 17 feet below the current 9th Street
Road centerline. Due to the size of the equipment needed to complete this construction and
the depth of the excavation, the entire roadway will need to be closed.
Duration of this phase of the project will be approximately two (2) weeks from initial pavement
saw cut through final pavement restoration as noted below:
o Day 1; set-up barricades and saw cut pavement.
Day 2; begin excavation.
Day 3-5; excavation and trench shoring.
o Day 6; core existing manhole.
o Day 7; install pipe, bedding, seal pipe connections.
o Day 8-9; backfill and compaction.
o Day 10; roadway restoration with hot -mix asphalt.
DNR approval for this sanitary sewer extension was granted on July 6, 2018. Anticipated start
date of construction is August 1, 2018. Based on this anticipated schedule, construction will be
completed before the start of school.
We therefore respectfully request approval from the City of Oshkosh Common Council to allow the
temporary closing of both lanes of 9th Street Road to provide adequate area and safe working conditions
during this phase of the subdivision development project.
