GENERAL INFORMATION
Petitioner/Owner: City of Oshkosh
Actions Requested:
The City is requesting several vacations of street right-of-way located in the former Lakeshore
Municipal Golf Course property,Rainbow Memorial Park and a portion of recently dedicated N.
Westfield Street. The proposed vacations are as follows:
• A portion of N. Westfield Street: An approximately 3,079 square foot triangular area (0.071
acre) located at the northwest terminus of N.Westfield Street.
• All of unnamed street located between Rath Lane and N. Westfield Street: An 80-foot by
approximately 750-foot,71,130 square foot(1.633 acres) area dedicated on February 23,
2018.
• Portion of N. Eagle Street:A 33-foot by approximately 1,115-foot, 36,795 square foot(0.845
acres) located between Rainbow Drive and Lake Butte des Morts.
• All of Butte des Marts Drive: A 66-foot by 402-foot, 26,720 (0.613 acres) area located
between N. Eagle Street and the Fox River.
• All of Shemin Street:Three segments including a 66-foot by 414-foot,27,324 square foot
(0.627 acres) area, a 66-foot by 58-foot, 3,672 square foot (0.084 acres) area and a 66-foot by
249-foot, 16,289 (0.374 acres) area located between N. Eagle Street and the Fox River.
• All of Water Street: A 60-foot by 862-foot,56,864 square foot(1.305 acres) located north of
Rainbow Drive.
• Portion of Rainbow Drive: Three segments including a 33-foot by 270-foot,8,910 square
foot(0.205 acres) area, a 6-foot by 144-foot, 864 square foot(0.020 acres) area and a 66-foot.
by 374-foot, 24,652 square foot(0.566 acres) located between N. Eagle Street and the Fox
River.
• All of Public Alley between Shomin Street and Rainbow Drive: Two segments including a
20-foot by 414-foot, 8,280 square foot(0.190 acres) area and a 20-foot by 182-foot,3,640
square foot, (0.084 acres) located between N. Eagle Street and Water Street.
• All of Public Alley between Butte des Morts Street and Shemin Street: A 20-foot by 412-
foot, 8,240 square foot(0.189 acres) area located between N. Eagle Street and Water Street.
Portion of Graham Street: A 66-foot by 270-foot, 17,855 square foot(0.410 acres) area
located between Rainbow Drive and the Fox River.
Applicable Ordinance Provisions:
WI State Stats. 66.1003 regulate the discontinuance of a public right-of-way.
Property Location and Background Information:
Plan Commission is being asked to review several proposed street right-of-way yacations
consisting of nine individual vacations. Eight of the vacations are located on either the former
Lakeshore Municipal Golf Course property or Rainbow Memorial Park,while one is located on
recently dedicated N. Westfield Street dedicated by H2Oshkosh Ave. LLC. The proposed
vacations can be broken into two groups: The first involves the future extensions of N. Westfield
and N. Koeller Streets while the second group are generally located at the eastern side of the golf
course property and Rainbow Memorial Park. At its July 10, 2 018 meeting, the Common Council
set a public hearing date of September 11,2018 to take final action for the vacations.

On February 13,2018, the City dedicated an unnamed street between Rath Lane and the N.
Westfield Street extension which was to provide Oshkosh Corporation access to their global
headquarters site. Since then the Army Corps of Engineers conducted a re-delineation of
wetlands on the golf course property which removed and reduced some of the wetlands in the
area. This caused the City to redesign the alignment of the unnamed street(now known as N.
Koeller Street) to avoid the newly mapped wetlands. To simplify the process, the City is

recommending the vacation of the entire street segment to be followed by a new street dedication
with the new alignment.
On furie 12, 2018 the City approved a dedication to extend N. Westfield Street north of Oshkosh
Avenue to provide street and utility access for Oshkosh Corporation and redevelopment areas
along Oshkosh Avenue, The dedication included land forming a curve to the west which was
mapped in case the Army Corps of Engineers wetland delineation did not alter the existing
wetlands. The dedication was necessary to allow the Department of Public Works to begin
design work for the N. Westfield Street extension and its intersection at Oshkosh Avenue. With
the new delineation and the re-alignment of N. Koeller Street, this curve section is no longer
needed and the City recommends its vacation. The land will be reverted back to H2Oshkosh Ave.
LLC.
The remainder of the vacations are located at the east end of the golf course property and
Rainbow Memorial Park. The proposed vacations include all of Lake Butte des Morts, Shomin
and Water Streets and two public alleys, and portions of N. Eagle Street,Rainbow Drive and
Graham Street. During review of a preliminary Certified Survey Map for the golf course,
research indicated that the aforementioned streets were not officially vacated, although the
historic use of the lands were treated as if they were. This request is essentially a cleanup of the
area by making the vacations official, Most of the land for the proposed vacations will be
reverted back to the City's farmer golf course property and/or Rainbow Memorial Park, with a
few remnants being reverted back to private properties in the area.
According to the Public Warks Department, the alleys are no longer used or needed and can be
vacated. Public Works is requesting,however, that the City and any other utility facilities have
the right to maintain existing utilities within the proposed right-of-way vacations.
Staff supports the right-of-way vacations request as proposed. The vacations will have no impact
on adjacent properties as the land has been historically used as if the right-of-ways had been
already vacated.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the proposed street right-of-way vacations as requested.
