HomeMy WebLinkAbout28. 18-373 JULY 10, 2018 18-373 RESOLUTION (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) PURPOSE: SET PUBLIC HEARING DATE TO VACATE: • PORTION OF NORTH WESTFIELD STREET • ALL OF UNNAMED STREET BETWEEN RATH LANE TO NORTH WESTFIELD STREET • PORTION OF NORTH EAGLE STREET • ALL OF BUTTE DES MORTS STREET • ALL OF SHOMIN STREET • ALL OF WATER STREET • PORTION OF RAINBOW DRIVE • ALL OF PUBLIC ALLEY BETWEEN SHOMIN STREET AND RAINBOW DRIVE • ALL OF PUBLIC ALLEY BETWEEN BUTTE DES MORTS STREET AND SHOMIN STREET • PORTION OF GRAHAM AVENUE INITIATED BY: COMMUNITY DEVELOPMENT WHEREAS, it appears that the public interest requires that that portion of the following described streets or alleys within the City of Oshkosh be vacated and discontinued: All of Unnamed Street Between Rath Lane to North Westfield Street; Portion of North Eagle Street; All of Butte Des Morts Street; All of Shomin Street; All of Water Street; Portion of Rainbow Drive;All of Public Alley Between Shomin Street and Rainbow Drive; All of Public Alley Between Butte Des Morts Street and Shomin Street;Portion of Graham Avenue NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that a hearing on the passage of the following resolution shall be held before the Common Council in the Council Chambers in the City Hall, City of Oshkosh, Winnebago County, Wisconsin, on Tuesday, August 28, 2018 at 6:00 PM of said day and the proper City officials are hereby authorized and directed to give notice of said hearing by personal service and publication of said hearing as provided by law. Eagle Street; All of Butte des Morts Street; All of Shomin Street; All of Water Street; Portion of Rainbow Drive; All of Public Alley between Shomin Street & Rainbow Drive; All of Public Alley between Butte des Morts Street & Shomin Street; Portion of Graham Avenue BACKGROUND Council is being asked to set a public hearing date for several proposed street right-of-way vacations consisting of nine individual vacations. One of the vacations is located on recently dedicated N. Westfield Street dedicated by H2Oshkosh Ave. LLC, while the remaining vacations are located on either the former Lakeshore Municipal Golf Course property or Rainbow Memorial Park. The proposed vacations can be broken into two groups: The first involves the future extensions of N. Westfield and N. Koeller Streets while the second group are generally located at the eastern side of the golf course property and Rainbow Memorial Park. State Statutes require that the public hearing be held no less than 40 days after the introductory resolution which would set the public hearing date for this request no earlier than the Council's September 111h meeting. ANALYSIS On February 13, the city dedicated an unnamed street between Rath Lane and the N. Westfield Street extension which was to provide Oshkosh Corporation access to their global headquarters site. Since then the Army Corps of Engineers conducted a re -delineation of wetlands on the golf course property which removed and reduced some of the wetlands in the area. This caused the City Hall, 215 Church Avenue P.O. Box 1 130 Oshkosh, WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us city to redesign the alignment of the unnamed street (now known as N. Koeller Street) to avoid the newly mapped wetlands. To simplify the process, the city is recommending the vacation of the entire street segment to be followed by a new street dedication with the new alignment. On June 12th the city approved a dedication to extend N. Westfield Street north of Oshkosh Avenue to provide street and utility access for Oshkosh Corporation and redevelopment areas along Oshkosh Avenue. The dedication included land forming a curve to the west which was mapped in case the Army Corps of Engineers wetland delineation did not alter the existing wetlands. The dedication was necessary to allow the Department of Public Works to begin design work for the N. Westfield Street extension and its intersection at Oshkosh Avenue. With the new delineation and the re -alignment of N. Koeller Street, this curve section is no longer needed and the city recommends its vacation. The land will be reverted back to H2Oshkosh Ave LLC. The remainder of the vacations are located at the east end of the golf course property and Rainbow Memorial Park. The proposed vacations include all of Lake Butte des Morts and Shomin Streets and two public alleys, and portions of N. Eagle Street, Water Street, Rainbow Drive and Graham Street. During review of a preliminary Certified Survey Map for the golf course, research indicated that the aforementioned streets were not officially vacated, although the historic use of the lands were treated as if they were. This request is essentially a cleanup of the area by making the vacations official. Most of the land for the proposed vacations will be reverted back to the city's golf course property and/or Rainbow Memorial Park, with a few remnants being reverted back to private properties in the area. FISCAL IMPACT None anticipated. The proposed right-of-way vacations will not require expansion of city services. RECOMMENDATION The Plan Commission will be reviewing this request at its July 17, 2018 meeting and provide a recommendation for the September 11, 2018 Common Council Meeting for final action.
