PURPOSE: APPROVE CONDITIONAL USE PERMIT FOR AN OFF-SITE
PARKING LOT LOCATED AT WEST 29TH AVENUE & OREGON

WHEREAS, the Plan Commission finds that the Conditional Use for development of
an off-site parking lot at the southwest corner of W. 291h Avenue and Oregon St., is
consistent with the criteria established in Section 30-382(F)(3) of the Oshkosh Zoning
Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that a conditional use permit is hereby approved to allow an off-site parking lot at
the southwest corner of W. 291h Avenue and Oregon St., per the attached.

BACKGROUND
The subject site is a 1.32 acre vacant parcel located at the southwest corner of West 29th Avenue
and Oregon Street. The property is zoned Heavy Industrial District (HI) with an industrial 10
and 20 year Comprehensive Land Use recommendation.
ANALYSIS
Oshkosh Corporation is proposing to develop a 28,115 sq. ft., 80 stall parking lot to be used by
employees of their site to the west of the subject site. They state this parking lot is needed as
their existing on-site parking areas are overcrowded and employees are currently forced to
park on the street. The use is permitted via a conditional use permit within the HI zoning
district and is compatible with existing uses in the area. The new parking lot will not result in
additional traffic to the area, but is expected to alleviate congestion in the public right-of-way
as it will reduce the level of on -street parking. The proposed parking lot meets HI setback
requirements from all property lines and meets the impervious surface ratio allotted. The
parking stalls and drive aisles are also compliant with the zoning ordinance's performance
standards. Access to the site is proposed via a two-way Class II entrance/exit from W. 29th
Avenue, just west of the center of the site. Staff does not have concerns with the proposed
access or internal traffic circulation. As the proposal is for an off-site parking lot, there is no
required minimum or maximum number of parking stalls. Staff does not have concerns with
the proposed 80 stalls. No signage is being proposed at this time. The submitted lighting plan
is compliant with the City's lighting ordinance. Final landscaping plans for the site will be
addressed during the site plan review process. The project is approved with the condition that
the site will comply with the City's 2018 Standard Specification and the performance
requirements for stormwater described in Chapter 14 of the City's Municipal Code. This will
also be addressed during the site plan review process.

FISCAL IMPACT
No city services will be required to be extended to service the site and stormwater facilities
serving the parking lot will connect to existing city services in 29th Avenue. There should be a
small assessed value improvement resulting from construction of the new parking lot.
RECOMMENDATION
The Plan Commission recommended approval of a conditional use permit at its July 3, 2018
meeting. '

GENERAL INFORMATION

Actions Requested:
The applicant is requesting a Conditional Use Permit for development of an off-site parking lot at
the southwest corner of West 291h Avenue and Oregon Street.
Applicable Ordinance Provisions:
Conditional Use Permit standards are found in Section 30-382 of the Zoning Ordinance.
Property Location and Background Information:
The subject site is a 1.32 acre vacant parcel located at the southwest corner of West 291h Avenue
and Oregon Street. The property is zoned Heavy Industrial District (HI) with an industrial 10
and 20 year Comprehensive Land Use recommendation. The surrounding area consists mostly of
industrial uses to the north, south, west and a mixture of commercial, industrial and residential
uses to the east.

ANALYSIS
Use

street. The use is permitted via a conditional use permit within the HI zoning district and is

Site Design
The proposed parking lot meets HI setback requirements from all property lines. The impervious
surface ratio for the lot will be about 48.5%, which is well under the maximum of 70% for the HI
district. The parking stalls and drive aisles are also compliant with the zoning ordinance's
performance standards.
Access and Circulation
Access to the site is proposed to be a two-way Class II entrance/exit from W. 291h Avenue, just
west of the center of the site. Staff does not have concerns with the proposed access or circulation
for the site.
Parkin
As the proposal is for an off-site parking lot, there is no required minimum or maximum number
of parking stalls. Staff does not have concerns with the proposed 80 stalls.
Signage and Lighting
No signage is being proposed at this time. The submitted lighting plan is compliant with the
City's lighting ordinance.
LandscapjDg
A landscaping plan for the site has been submitted with the application. Some minor
modifications will need to be made to the submitted plan to meet code requirements. This can be
addressed during the site plan review process.
Storm Water Management
The project is approved with the condition that the site comply with the City's 2018 Standard
Specification and the performance requirements for stormwater described in Chapter 14 of the
City's Municipal Code. This will also be addressed during the site plan review process.
RECOMMENDATION/CONDITIONS
In its review and recommendation to the Common Council on an application for a Conditional
Use Permit, staff recommends the Plan Commission make the following findings based on the
criteria established by Chapter 30-382 (F)(3):
(1) Is in harmony with the Comprehensive Plan.
(2) Would not result in a substantial or undue adverse impact on nearby property, the
character of the neighborhood, environmental factors, traffic factors, parking, public
improvements, public property or rights-of-way, or other matters affecting the public
health, safety, or general welfare.

(3) Maintains the desired consistency of land uses, land use intensities, and land use impacts
as related to the environs of the subject property.
(4) The conditional use is located in an area that will be adequately served by, and will not
impose an undue burden on, any of the improvements, facilities, utilities or services
provided by public or private agencies serving the subject property.
(5) The potential public benefits outweigh any potential adverse impacts of the proposed
conditional use, after taking into consideration the applicant's proposal and any
requirements recommended by the applicant to ameliorate such impacts.
Staff recommends approval of the proposed Conditional Use Permit for an off-site parking lot at
the southwest corner of West 291h Avenue and Oregon Street as proposed, with the findings listed
above.
The Plan Commission approved of the Conditional Use Permit as requested with findings
noted. The following is the Plan Commission's discussion on this item.
Mr. Slusarek presented the item and reviewed the site and surrounding area. Oshkosh

David Gloss, 42 Brentwood Lane Appleton, WI questioned if there was any stormwater
management for the property.
Mr. Slusarek responded the stormwater management is located in the northeast portion of the
property.
Motion by Vajgrt to approve the conditional use permit for an off-site parking lot at southwest corner of
West 291h Avenue and Oregon Street.
Seconded by Ford. Motion carried 7-0.

PROJECT NARRAIVE
The applicant requests a Conditional Use Permit to allow development of the site for a parking
lot. Currently the site is unimproved vacant land.
The proposed parking lot would provide 80 stalls for employees to park their vehicles; who are
currently parking on the streets and in overcrowded parking lots. The site will meet the
requirements of Chapter 30-62(F). The parking lot surface will be approximately 28,115 s.f (0.6
acres) which will put the site at 48.5% impervious.
Oshkosh Corporation is not planning on changing their operation. Therefore, the noise, hours of
operation, glare, odor, fumes, vibration will not change.
LAND USE INFORMATION
The surrounding areas are all zoned HI — Heavy Industrial.
The surrounding areas land uses conform to HI Heavy Industrial Zoning District.
SUBMITAL REQUIREMENTS
Briefly explain how the proposed conditional use will not have a negative effect on the issues
below.
1. Health, safety, and general welfare of occupants of surrounding lands.
The general welfare and safety will be improved with the construction of the proposed
parking lot because employees will be concentrated into one location. Off street parking
will also reduce congestion on public streets.
2. Pedestrian and vehicular circulation and safety.
The pedestrian safety will be improved with the construction of a sidewalk. The parking
lot has been designed in accordance to the City's Zoning Ordinance so that vehicular
circulation and safety is maximized.
3. Noise, air, water, or other forms of environmental pollution.
This project meets the requirements of the City's stormwater management plan for water
quality and quantity.
4. The demand for and availability of public services and facilities.
The project has no demand for the City's water.
The project has no demand for the City's sanitary sewer.

The project will connect the proposed stormwater management pond to the inlet located
on the southwest corner of 29th Ave and Oregon Street.
5. Character and future development of the area.
This site would not be able to be further developed. However, at a future date, the
parking lot could be expanded to the west onto the adjacent property.
