HomeMy WebLinkAboutItem IV PLAN COMMISSION STAFF REPORT JULY 3,2018 ITEM IV: CONDITIONAL USE PERMIT REQUEST TO ESTABLISH AN OUTDOOR STORAGE USE AT 3300 MEDALIST DRIVE GENERAL INFORMATION Applicant: Richard Fisher Owner: Scott Smet—Smet Investments LLC Action(s) Requested: The applicant is requesting a conditional use permit to establish an outdoor storage use on a previously developed lot. Applicable Ordinance Provisions: Outdoor Storage land uses are permitted only through a conditional use permit in the Heavy Industrial District (HI) as regulated in Section 30-62 (C) of the Zoning Ordinance. Criteria used for Conditional Use Permits are located in Section 30-382 of the Zoning Ordinance. Property Location and Background Information: The 8.92 acre site is located at the southeast comer of Medalist Drive and W. 33rd Avenue,north of 34ffi Avenue and is accessed via entrances/exits from Medalist Drive and W. 33rd Avenue. The site consists of a 134,130 square foot industrial building and associated parking area. Currently, it is being leased by Oshkosh Defense for final inspection of vehicles and was previously used by GE Power Systems for light manufacturing purposes. The property is located within the Aviation Industrial Park and the surrounding area consists predominately of industrial uses. Subject Site: ExistingLund Ilse. "Z Industrial HI Adjacent Land Use and Zoning: �77777777777 North Industrial HI South Industrial HI West Industrial HI East Industrial HI cofil rehehi i P Plan Laical Use Recommendation Z it Ilse 10-Year Recommended Land Use Plan Industrial 20-Year Recommended Land Use Plan Industrial ANALYSIS The petitioner is requesting approval of a conditional use permit to use a portion of the existing parking area to the north of the building (fronting W. 33rd Ave.) as a secured outdoor storage area for government-owned vehicles. The outdoor storage area will exceed 500 sq. ft. in area and therefore will require a conditional use permit. The proposed outdoor storage area will consist of approximately 11,000 sq. ft. (14 parking spaces) of existing asphalt be to be milled and resurfaced. The area will be enclosed with 8' tall "privacy link" fencing(approximately 98%opaque) with 3 strands of barbed wire above and 16' wide sliding gates for access from both the north and west entrances. The enclosed storage area should not affect vehicle circulation on the rest of the site as the storage area does not obstruct access to the remaining parking areas. Staff is in support of the proposed outdoor storage use as the use should not be detrimental to the surrounding area,provided the required solid (at least 90%opaque) 8' tall screening is installed around the storage area. However, staff is recommending a condition that additional landscaping be installed in the grassed area fronting W. 33rd Avenue to "break up" the solid fencing. The Department of Public Works reviewed the proposal and noted that trucks should use Medalist Drive for access as the pavement on 33rd Avenue will likely deteriorate rapidly with significant truck use. RECOMMENDATION/CONDITIONS In its review and recommendation to the Common Council on an application for a Conditional Use Permit, staff recommends the Plan Commission make the following findings based on the criteria established by Chapter 30-382 (F)(3): (1) Is in harmony with the Comprehensive Plan. (2) Would not result in a substantial or undue adverse impact on nearby property, the character of the neighborhood, environmental factors, traffic factors, parking, public improvements, public property or rights-of-way, or other matters affecting the public health, safety, or general welfare. (3) Maintains the desired consistency of land uses, land use intensities, and land use impacts as related to the environs of the subject property. (4) The conditional use is located in an area that will be adequately served by, and will not impose an undue burden on, any of the improvements, facilities, utilities or services provided by public or private agencies serving the subject property. Item IV—CUP/Outdoor Storage—3300 Medalist Dr. 2 (5) The potential public benefits outweigh any potential adverse impacts of the proposed conditional use, after taking into consideration the applicant's proposal and any requirements recommended by the applicant to ameliorate such impacts. Staff recommends approval of the proposed Conditional Use Permit for an outdoor storage area at 3300 Medalist Drive as proposed, with the findings listed above and the following conditions: 1. The outdoor storage area must be completely enclosed by 8 foot tall solid(at least 90% opaque)fencing. 2. Additional landscaping be installed in grassed area fronting W. 33rd Avenue, as approved by the Department of Community Development. 3. Truck traffic must use Medalist Drive for access. The current planned use is to secure parking space for vehicles that are owned by the federal government. The area is required by contract with the federal government to be secured with a fence. The fencing will be 8'-0" "privacy link"fencing (approx. 98% opaque) with 3 strands of barbed wire above. This area will also be repaved by having the surface milled off and top coated per the attached proposal from NEA North East Asphalt. This property is currently an industrial site that was last used by GE for manufacturing Compressors.
