PURPOSE: APPROVE CONDITIONAL USE PERMIT FOR OUTDOOR
STORAGE USE AT 320 EAST FERNAU AVENUE

PLAN COMMISSION RECOMMENDATION: APPROVED
WHEREAS, the Plan Commission finds that the Conditional Use for outdoor
storage of skids and pallets at 320 E. Fernau Avenue, is consistent with the criteria
established in Section 30-382(F)(3) of the Oshkosh Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that a conditional use permit is hereby approved to allow outdoor storage of
skids and pallets at 320 E. Fernau Avenue, per the attached, with the following
conditions:
1. The outdoor storage area must be completely enclosed by 8 foot tall solid (at least
90% opaque) fencing.
2. Additional landscaping be installed in grassed area fronting Moser Street, as
approved by the Department of Community Development.

BACKGROUND
The 2.75 acre site is located at the northwest corner of E. Fernau Avenue and Moser Street, within
the North Industrial Park, and is being used for industrial/light manufacturing purposes
(Brickham Machining). The property is accessed via two drive entrances/exits from Moser Street
and one from E. Fernau Avenue. The site has one structure totaling 26,996 sq. ft. with associated
paved parking and access areas surrounding the building.
ANALYSIS
The petitioner is requesting approval of a conditional use permit to use a portion of the
existing parking area to the east of the building (fronting Moser Street) for storage of skids and
pallets. The outdoor storage area will exceed 500 sq. ft. in area and therefore requires a
conditional use permit. According to the applicant, the outdoor storage area will be
approximately 2,700 sq. ft., resurfaced with concrete and enclosed with 8' tall privacy slatted
chain link fencing. The proposed site plan shows a 40' wide drive aisle maintained in front of
the storage area. Staff is in support of the proposed outdoor storage use as the use should not
be detrimental to the surrounding area. Staff is recommending conditions that the outdoor
storage area be screened in accordance with the outdoor storage land use requirements in
Section 30-81(B)(1) and additional landscaping be installed in the grassed area fronting Moser
Street.
FISCAL IMPACT
No city services will be required to be extended to service the site due to the proposed storage
area. Approval may result in a small increase in assessed value from the resulting fence
improvement.

RECOMMENDATION
The Plan Commission recommended approval of a conditional use permit at its June 19, 2018
meeting.

STORAGE USE AT 320 E FERNAU AVENUE

GENERAL INFORMATION

Action(s) Requested:
The applicant is requesting a conditional use permit to establish an outdoor storage use on a
previously developed lot.
Applicable Ordinance Provisions:
Outdoor Storage land uses are permitted only through a conditional use permit in the Heavy
Industrial District (HI) as regulated in Section 30-62 (C) of the Zoning Ordinance. Criteria used
for Conditional Use Permits are located in Section 30-382 of the Zoning Ordinance.
Property Location and Background Information:
The 2.75 acre site is located at the northwest corner of E. Fernau Avenue and Moser Street,
within in the North Industrial Park, and is being used for industrial/light manufacturing
purposes (Brickham Machining). The property is accessed via two drive entrance/exits from

ANALYSIS
The petitioner is requesting approval of a conditional use permit to use a portion of the existing
parking area to the east of the building (fronting Moser Street) for storage of skids and pallets.
The outdoor storage area will exceed 500 sq. ft. in area and therefore will require a conditional
use permit.
According to the applicant, the outdoor storage area will be approximately 2,700 sq. ft. and will
be resurfaced with concrete and enclosed with 8' tall privacy slatted chain link fencing. The
proposed site plan shows a 40' wide drive aisle maintained in front of the storage area.
Staff is in support of the proposed outdoor storage use as the use should not be detrimental to
the surrounding area, provided the required solid (at least 90% opaque) 8' tall screening is
installed around the storage area. However, staff is recommending that additional shrubs be
installed in the grassed area fronting Moser Street to "break up" the solid fencing. Also, the
proposed storage area does not require any additional building/pavement area to be installed as
previously used parking area will be utilized and vehicle circulation will not be inhibited. Staff
is recommending conditions that the outdoor storage area be screened in accordance with the
outdoor storage land use requirements in Section 30-81(B)(1) and additional landscaping be
installed in the grassed area fronting Moser Street.
RECOMMENDATION/CONDITIONS
In its review and recommendation to the Common Council on an application for a Conditional
Use Permit, staff recommends the Plan Commission make the following findings based on the
criteria established by Chapter 30-382 (F)(3):
(1) Is in harmony with the Comprehensive Plan.
(2) Would not result in a substantial or undue adverse impact on nearby property, the
character of the neighborhood, environmental factors, traffic factors, parking, public
improvements, public property or rights-of-way, or other matters affecting the public
health, safety, or general welfare.
(3) Maintains the desired consistency of land uses, land use intensities, and land use
impacts as related to the environs of the subject property.
(4) The conditional use is located in an area that will be adequately served by, and will not
impose an undue burden on, any of the improvements, facilities, utilities or services
provided by public or private agencies serving the subject property.
(5) The potential public benefits outweigh any potential adverse impacts of the proposed
conditional use, after taking into consideration the applicant's proposal and any
requirements recommended by the applicant to ameliorate such impacts.
Staff recommends approval of the proposed Conditional Use Permit for an outdoor storage area
at 320 E. Fernau Avenue as proposed, with the findings listed above and the following
conditions:

The Plan Commission approved of the Conditional Use Permit as requested with findings and
conditions noted. The following is the Plan Commissions discussion on this item.
Mr. Slusarek presented the item and reviewed the site and surrounding area. The site is being
used for industrial/light manufacturing purposes (Brickham Machining). The site has one
structure totaling 26,996 sq. ft. with associated paved parking and access areas surrounding the
building. The petitioner is requesting approval of a conditional use permit to use a portion of
the existing parking area to the east of the building for storage of skids and pallets. According
to the applicant, the outdoor storage area will be approximately 2,700 sq. ft. and will be
resurfaced with concrete and enclosed with 8' tall privacy slatted chain link fencing. The

There was no discussion on the item.
Motion by Vajgrt to approve the conditional use permit to establish an outdoor storage use located at
320 E. Fernau Avenue with the following conditions:
1. The outdoor storage area must be completely enclosed by 8 foot tall solid (at least 90% opaque)
fencing.
2. Additional landscaping be installed in grassed area fronting Moser Street, as approved by the
Department of Community Development.
