HomeMy WebLinkAbout09. 18-333 JUNE 26, 2018 18-333 RESOLUTION (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AMENDMENT TO PROFESSIONAL SERVICE AGREEMENT WITH AECOM FOR ENVIRONMENTAL CONSULTING SERVICES; STATE STREET PARKING LOT (+$8,500) INITIATED BY: COMMUNITY DEVELOPMENT BE IT RESOLVED by the Common Council of the City of Oshkosh that an amendment to the professional service agreement with AECOM is hereby approved to provide environmental support services associated with additional site investigation for the State Street parking lot in the amount of $8,500 and the proper City officials are authorized and directed to enter into an appropriate agreement for purposes of same and to take those steps necessary to implement the terms and conditions of the agreement as amended. No. 514-1040-7216 TIF #30 Washington Building Redevelopment TO: Honorable Mayor and Members of the Common Council FROM: Allen Davis, Community Development Director DATE: June 20, 2018 RE: Environmental Consulting Service Agreement Amendment with AECOM for State Street Parking Lot ($8,500) BACKGROUND As part of the construction of garages to serve the Washington Building, Community Development staff requested a proposal for environmental consulting services in order to facilitate the redevelopment of the State Street Parking Lot. The work contained within the proposed scope of services was required for potential redevelopment of the State Street Parking Lot, currently owned by the City. AECOM was chosen to perform the work related to the environmental work required for the site for $70,000: • Complete Voluntary Party Liability Exemption (VPLE) for Wisconsin Department of Natural Resources (WisDNR), which the City would want in order to limit any liability for the City or future owner for environmental contamination on the site. • Additional Subsurface Investigation — completed in March, 2018. • Work Plan for handling/using contaminated soil and groundwater management. • On-site construction documentation. Based on the additional subsurface investigation results from March, 2018, the Wis DNR is requiring additional testing and documentation on the site prior to approving the VPLE. ANALYSIS WisDNR is requiring additional testing and analysis of the subsurface soil conditions on the site due to exceedances for lead, barium and PAHs. Additional samples for metals and VOCs are also required. WisDNR is also requiring resampling of the ground water on the site. The proposed fees are based on an hourly contract, not to exceed $8,500. The City cannot sell the lot to the developers until the VPLE is obtained, so the garages currently remain on leased land. In order to sell the land, the WisDNR must be satisfied with the environmental conditions on the site, and the additional investigation and sampling is required for WisDNR's determination. FISCAL IMPACT The cost of these professional services will be paid by the developers as required in the Development Agreement. The TIF District pay -go agreement will add this cost to the developer's investment and be will included as a TIF -eligible expense for the developer's future pay -go payment.
