TRANSFER OF OWNERSHIP OF FORMER POLICE CANINE
RELEASE AND HOLD HARMLESS FOR FUTURE CLAIMS
For good and valuable consideration which both parties agree is sufficient under the terms of this Agreement,
the City of Oshkosh (hereinafter "City") hereby releases all rights to and transfers all ownership interest in the
police canine known as "Gucci" to Chris Romanowicz (hereinafter "Romanowicz") and Romanowicz hereby
accepts all rights to and all ownership interest in the police canine known as "Gucci".
The City of Oshkosh makes no promises or warranties concerning the physical or mental condition of Gucci and
Romanowicz accepts Gucci on an "as -is" basis. The City of Oshkosh shall provide to Romanowicz a copy of all
records in the City's possession for breeding, veterinarian and other care for Gucci while Gucci served as a
police canine.
Romanowicz was the handler of Gucci while Gucci served as a police canine and Romanowicz understands that
Gucci received training in police canine procedures and tactics that included certain forms of aggressive
behavior. Romanowicz acknowledges that Romanowicz is fully aware of Gucci's training and history and
Romanowicz agrees that he is fully capable of safely handling Gucci.
Romanowicz hereby waives, releases and forever discharges the City of Oshkosh from any and all liabilities
and claims of any nature whatsoever, whether known or unknown, foreseen or unforeseen, arising from or
relating to Gucci including the waiver, release and discharge from any personal injury claim by Romanowicz or
Romanowicz 's family arising from or relating to Gucci.
Romanowicz hereby accepts all responsibility for the care and actions of the dog Gucci. Chris Romanowicz
agrees to hold the City of Oshkosh harmless against all actions, claims and demands of any kind or character
whatsoever which may in any way be caused in whole or in part by or result from the care and/or actions of
Gucci from and after the effective date of this agreement; and shall indemnify or refund to the City all sums
including court costs, attorney fees and punitive damages that the City may be obliged or adjudged to pay on
any such claims or demands within thirty (30) days of the date of the City's written demand therefor.
The City of Oshkosh maintains coverage for the period of time during which Gucci served as a police canine.
Romanowicz shall return to the City of Oshkosh all police equipment, training aids and portable kennels
provided by the City of Oshkosh for use with Gucci while Gucci served as a police canine.
This agreement contains the complete understanding of the parties relating to the subject matter of this
agreement and replaces any and all other written or oral agreements relating thereto. This agreement shall be
governed by the laws of the State of Wisconsin.
This agreement shall be effective immediately upon the signature by both parties below.
