PURPOSE: APPROVE EXTENDING THE CLOSURE OF INTERSECTION OF
WEST 9TH AVENUE /OREGON STREET
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AUTHORIZING A VARIANCE
TO SECTION 25-23 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO STREETS
TO REMAIN OPEN TO TRAFFIC DURING THE COURSE OF EXCAVATION WORK.
WHEREAS, the City of Oshkosh Municipal Code Section 25-23 requires a
passageway of not less than ten(10)feet in the travelled portion of the street to remain open
on various streets within the City of Oshkosh, including intersection of West 91h Avenue /
Oregon Street; and
WHEREAS, the Council previously granted a variance from the terms of section 25-
23 for the purposes of providing a safe work area and reducing congestion during the 2018
reconstruction Oregon Street by Resolution 18-133 adopted on March 3, 2018; and
WHEREAS, an additional week of closure is necessary to allow AT&T to complete
their work in connection with the project.
NOW, THEREFORE the Common Council of the City of Oshkosh do ordain as
follows:
SECTION 1. That a variance from the provisions of Section 25-23 of the City of
Oshkosh Municipal Code to extend the closure of intersection of West 91h Avenue/Oregon
Street by one additional week in coordination with PTS Contractors, Inc. from that granted
in Resolution 18-133 adopted on March 3, 2018 is hereby granted subject to the following
conditions:
A. AT&T Wisconsin shall work with PTS Contractors, Inc. and city staff with regard to
the temporary closure.

S. All other terms and conditions of Resolution 18-133 shall remain effective.
C. The Director of Public Works is hereby authorized to take any action as may be
necessary and appropriate in consultation with the Police and Fire Chiefs of the City
of Oshkosh to protect the health, safety and welfare of the citizens in relation to the
closure.
SECTION 2. This ordinance shall be in full force and effect from and after its
passage, publication and placement of the appropriate temporary signage indicating the
closure.
SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted
ordinance #18-272 APPROVE EXTENDING THE CLOSURE OF INTERSECTION OF
WEST 9TH AVENUE / OREGON STREET (A GENERAL ORDINANCE OF THE CITY OF
OSHKOSH AUTHORIZING A VARIANCE TO SECTION 25-23 OF THE OSHKOSH
MUNICIPAL CODE PERTAINING TO STREETS TO REMAIN OPEN TO TRAFFIC
DURING THE COURSE OF EXCAVATION WORK) on May 8,2018. The ordinance allows
additional temporary closures of intersection of West 91h Avenue / Oregon Street, for
purposes of completing reconstruction of Oregon Street during the 2018 construction
season.

RE: Approve Extending the Closure of Intersection of West 9th Avenue/Oregon Street
BACKGROUND
The Common Council awarded Contract 18-05 to PTS Contractors, Inc. (PTS) at their February
27, 2018 meeting. The project includes the full reconstruction of Oregon Street from West 81h
Avenue to West 161h Avenue, including relay of storm sewer, sanitary sewer, and water main,
and their respective laterals, as well as miscellaneous utility work and patching of Oregon Street
from West 8th Avenue to the Fox River. The reconstruction includes the intersections of Oregon
Street with 91h Avenue and South Park Avenue. Section 25-23 of the Municipal Code of the City of
Oshkosh requires Oregon Street and 9th Avenue to remain open during excavation.
At the March 13, 2018 meeting, the Common Council approved the closure of the intersection of
West 9th Avenue and Oregon Street for a period of two (2) consecutive weeks for the City's
construction activities (Ordinance No. 18-133). AT&T has requested an additional one (1) week
of closure that would allow AT&T and their contractors to safely complete their work within the
intersection. AT&T has significant work to complete in this intersection related to the City's
reconstruction of Oregon Street and related to the damage caused to their communication
infrastructure during construction.
ANALYSIS
The extensive existing underground infrastructure limits the available locations to set a new
vault. As a result, the excavation to construct the new vault would be directly next to narrow live
traffic lanes. This would create an unsafe situation for AT&T's staff, their contractor, and the
driving public. Approval of this request allows the intersection to be closed for a total of three
(3) consecutive weeks.

FISCAL IMPACT
The extended closure is being requested by AT&T. Therefore, there are no fiscal impacts to this
ordinance.
RECOMMENDATIONS
I recommend approval of the request to extend the closure of the intersection of West 91h
Avenue/Oregon Street.

Dear Mr. Gierach:
Per our conversations, AT&T Wisconsin (AT&T) has significant conduit and manhole
infrastructure within the above intersection which requires adjustment in order to
accommodate the reconstruction of Oregon St including the proposed public utilities and the
associated grading work. In addition, conduit and manhole replacement stemming from the
4/5/18 damage incident by PTS is also required. Due to space limitations within the
intersection, our adjustment and replacement work will require an independent working
window outside that of the city contractor (PTS Contractors). As such, we are requesting that
the closure window be extended by (1) additional week in order to safely stage and execute our
work.
